I think for BIMS to register the addinfo, you need to have the received date one day after the request
date. So,technically, it could still work because it could be 5/8 Addinfo request, 5/9 Addinfo received, and
permit 5/10.
If strictly following procedures, we still have the issue of setting it back 90 days, but under manager's
discretion, we could issue it earlier. This would also be similar to issuing it on a Friday afternoon as a filler,
which we can do from time to time.
So, unless you disagree, I will go ahcad with it.
Also, let me know if you have any other issues with this one.

My recommendation would be to log in the 5/8 addinfo and 5/8 received date and issue the permit 5/10. That way the

In response to your questions:
1. We are transferring in accordance with 143-214.7 (c5). Reference email I sent for clarification.
2. This was just a minor clarification via email so ! don't agree that it needs to be logged into BIMS. !
definitely would not consider it an official Addinfo. If you want to make if dear for a possible audit,
then maybe we should just change the received date on that page to reflect the original BIMS received
date of 2/10/23. It also presents problems because they have already had 2 Addinfos, and this would
restart the clock at 90 days, which would delay the permit unnecessarily.
It's up to you. Let me know.

I went through this today:
1. Signatures: Section B of the application says that only the proposed permittee is signing, but both the current
and proposed have signatures? The permit text is set up for.1045(1)(c)/N.C.G.S. 143-214.7(c5). Ellis Coleman
signed for the current permittee and his is listed as a manager with the NC SoS. Was this intended to be under
.1045(1)(a)?

2. Addlnfo Events: This had the first Addlnfo on 1/26/23 and the response was 2/10/23. i see that you also
emailed them on 5/8/23 asking for some small revisions to the application and that that page of the application
was re-submitted on 5/8/23 and stamped "received" on that date. Even though it was a small request on 5/8/23
I think we still need to log those events as an Addlnfo and a response because if we were to get audited the
dates in the paperwork need to match the dates in BIMS. Please log those events in BIMS.

We are writing this letter in response to comments dated January 26, 2023. Each of the comments are
repeated below,followed by our response.
1. 15A NCAC 02H.1045(2)(a): Since the current permit includes the original property owner, Alvin
Bryan Willis, Ill,and it is desired to transfer the permit in accordance with 02H.1045(1)(a), it is also
required that Mr. Willis sign the transfer application in section D on page 4. Also, please provide
complete contact information for Mr.Willis,including phone number and e-mail address,in Section
D.1-6 of the transfer application form.
If the original property owner is not available to sign, then the transfer application can be revised
where the proposed permittee is signing and accepting responsibility per 02H.1045(1)(c) and G.S.
143-214.7(c5)(reference requirements below). This would require a revised application where the
proposed permittee meets the requirements under section B.3 of the application. Note that the
revised application would still be considered as being received on the original application date and
would not cause unnecessary delay.
► Please see attached updated Page 2 of the Transfer Application. We are unable to get a
signature from the previous property owner. Attached is the current deed for the project
showing that Heartsease Calabash,LLC is the current property owner.
2. As a reminder, in accordance with the permit, the new permittee will be responsible for providing
the following information in the future:
a. Permit Condition 10 and 15A NCAC 02H.1042(4)(a) effective January 1, 2017: Please
provide a copy of the Designer's Certification for all completed SCMs.
Noted, as the project is under construction, we will work to provide the certification
when the project is complete.
b. Permit Condition 7 and 15A NCAC 02H.1050(11): Please provide a copy of the recorded
Operation and Maintenance agreement.

Notice of Inspection
On December 21,2022,the Wilmington Regional Office of the Division of Energy,Mineral and Land Resources
(DEMLR)inspected the subject project to determine the status of compliance with this permit, most recently
renewed and reissued on August 18,2022. DEMLR file review and site inspection revealed that the site is in
compliance with the terms and conditions of this permit. A copy of the completed form entitled"Compliance
Inspection Report"summarizing the findings of the recent inspection is attached to this letter.
All of the requested information listed above should be received in this Office by February 23,2023 in
accordance with 15A NCAC 02H.1045(4)(axi).Please note that only two letters requesting additional
information is allowed in the State Stormwater Program, this being the first. If the required information is not
satisfactorily provided by this date,the project will be returned in accordance with 15A NCAC
02H.1045(4Xaxii). If the project is returned and you wish to re-submit later,you will need to resubmit all
required items at that time, including the application fee.
Please note that if,upon review of the submitted information or upon a deficient compliance inspection of the
project,it is determined that a major modification to the permit is required to resolve the compliance issues,the
transfer application will be returned as incomplete.Upon the issuance of the modified permit,and the successful
completion of any work required by the modified permit and/or the restoration of the site to design condition,the
applicant will need to submit an updated transfer application and a new fee to the Division to start the transfer
process over again.
Please remember that the permittee is responsible for complying with the terms and conditions of the permit and
the approved plans and specifications until the Division approves the transfer request.

Our office is in receipt of a transfer application packet for the above referenced permit(possibly?). The cover letter
included with the packet references state stormwater permit SW8 220711 which I show in my system belongs to
Heartsease at Calabash (facility)with current permit owners as EYC Companies. However,when I move past the cover
letter to the applications,they reference state stormwater permit SW8 200507. Our system indicates this belongs to a
facility with a different name in Ocean Isle Beach and has different permit owners. The applications list the project
name as Heartsease at Calabash which matches the name on the cover letter. The application appears to indicate
transfer to Heartsease Calabash, LLC with supporting documentation from the NC Secretary of State. Therefore, I feel
fairly confident that this is the correct facility. However,your applications contain the incorrect permit number to be
able to move forward with your request. Please clarify which information is correct and provide corrected applications
accordingly.
