Harlan - considering that the verdict is still out on what type of permit will
ultimately be applied to this project, we cannot proceed with issuance of the 401 as
you requested, nor is is waived. Furthermore, please note that you should include DWQ
in your correspondence reflecting the decision the Town intends to take with regards
to the existing and proposed actions at the site. When you arrive at your conclusion,
please be sure to provide us five copies of your updated application materials
reflecting the corrected impacts and project description details. We would anticipate
treating this application in a similar fashion regarding enforcement versus an
Individual Certification. Please advise of the Town's decision. Thanks very much, and

I have spoken with Justin and while we recognize that the impacts for permanent
impacts at one crossing now total 306 feet of permanent impacts versus the
permitted 294', and that the Corps now has the ability to require a Department of
the Army (DA) individual permit. However, while we might tend toward proceeding
with the remediation through enforcement protocol versus the individual permit, we
would prefer an official response from the town prior to finalizing that decision.
My apologies for not having gotten to this the yesterday, but I got tied up with
other issues and it slipped my mind until it was after 5 and likely wouldn't have
helped at that point.

Jean, could you provide me with a response to the following question related to
the subject project? Has the Corps made a decision as to whether or not the agency
will require an Individual Permit for the project under construction at this time
and if so what can I tell the town related to that decision?
Thank you for your help in bringing this situation closer to resolution and I we
will be getting you the survey information on the as-built vs.. permitted impacts
within the next couple of days. I will be out of the office until next Monday but
will have Chad Evenhouse coordinate getting information to you and Monte and if
you have questions, please feel free to call Chad at 677-2121.
