Division personnel have reviewed and approved your application for renewal of the subject permit.
Accordingly, we are forwarding the attached NPDES permit. This permit is issued pursuant to the requirements
of North Carolina General Statute 143-215.1 and the Memorandum of Agreement between North Carolina and
the U.S. Environmental Protection Agency dated October 15, 2007 (or as subsequently amended).
Summpa of Changes in Final Permit from Existing Permit
1) Ammonia as Nitrogen monthly monitoring was added. Ammonia as Nitrogen is a toxicant of concern for
this type facility and monitoring is required.
2) Total Arsenic limits were added. Total Arsenic effluent data suggest reasonable potential to violate state
water quality standards. Total Arsenic limits were added with monthly monitoring maintained.
3) Total Copper and Total Zinc monitoring were reduced to quarterly in conjunction with the acute toxicity
test. Total Copper and Total Zinc effluent data suggest reasonable potential to violate state water quality
standards. These parameters have action level standards based on aquatic toxicity, monitoring was
maintained in the permit and reduced to quarterly in conjunction with the acute toxicity test.
4) Total Iron monitoring was removed. Total Iron monitoring is no longer required.
5) Acute toxicity test species was corrected to designate mysidopsis bahia, and the acute toxicity special
condition narrative A. (2) was amended per a memo from the Aquatic Toxicology Unit dated June 11,
2012. The amended narrative provides the procedure for the Permittee to request a different test species.
6) Supplement to Cover Letter component list narrative was updated, instream sample location narrative
was updated, and parameter codes were added.

If any parts, measurement frequencies or sampling requirements contained in this permit are
unacceptable to you, you have the right to an adjudicatory hearing upon written request within thirty (30) days
following receipt of this letter. This request must be in the form of a written petition, conforming to Chapter
150B of the North Carolina General Statutes, and filed with the Office of Administrative Hearings (6714 Mail
Service Center, Raleigh, North Carolina 27699-6714). Unless such demand is made, this decision shall be final
and binding.
Please note that this permit is not transferable except after notice to the Division. The Division may
require modification or revocation and reissuance of the permit. This permit does not affect the legal
requirements to obtain other permits which may be required by the Division of Water Quality or permits
required by the Division of Land Resources, the Coastal Area Management Act or any other federal or local
governmental permits that may be required.

In compliance with the provision of North Carolina General Statute 143-215.1, other lawful standards
and regulations promulgated and adopted by the North Carolina Environmental Management

in accordance with effluent limitations, monitoring requirements, and other conditions set forth in Parts
I, II, III and IV hereof.
This permit shall become January 1, 2013.
This permit and authorization to discharge shall expire at midnight on November 30, 2016.

SUPPLEMENT TO PERMIT COVER SHEET
All previous NPDES Permits issued to this facility, whether for operation or discharge are hereby
revoked. As of this permit issuance, any previously issued permit bearing this number is no longer
effective. Therefore, the exclusive authority to operate and discharge from this facility arises under
the permit conditions, requirements, terms, and provisions included herein.
Village of Bald Head Island
is hereby authorized to:
1. Continue to operate a Water Treatment Plant with Reverse Osmosis (RO) wastewater concentrate
discharge. This water treatment plant currently has a design potable flowrate of 0.288 MGD and a
maximum, monthly average wastewater discharge of 0.066 MGD. The plant consist of the
following components:
o Antiscalant injection system
o Two (2) 0.101 MGD capacity primary RO systems with reject water flow totalizer
o One (1) 0.086 MGD capacity polishing RO system with reject water flow totalizer
Located at Bald Head Island, 256 Edward Teach Extension, Bald Head Island in Brunswick
County.
2. Discharge from said treatment works at the location specified on the attached map into Bald Head
Island Marina Basin channel, classified SC waters in the Cape Fear River Basin.

A. (2) ACUTE TOXICITY MONITORING (QUARTERLY)
The permittee shall conduct acute toxicity tests on a quarterlX basis using protocols. defined in the
North Carolina Procedure Document entitled "Pass/Fail Methodology For Determining Acute Toxicity
In A Single Effluent Concentration" (Revised December 2010 or subsequent versions). The monitoring
shall be performed as a Mysid Shrimp (Mysidopsis bahia) 24 hour static test. The effluent
concentration at which there may be at no time significant acute mortality is 90% (defined as treatment
two in the procedure document). Effluent samples for self -monitoring purposes must be obtained
during representative effluent discharge below all waste treatment. The tests will be performed during
the months of January, April, July, and October. These months signify the first month of each three
month toxicity testing quarter assigned to the facility.
All toxicity testing results required as part of this permit condition will be entered on the Effluent
Discharge Monitoring Form (MR-1) for the month in which it was performed, using the parameter
code TGE3E. Additionally, DWQ Form AT-2 (original) is to be sent to the following address:

Completed Aquatic Toxicity Test Forms shall be filed with the Environmental Sciences Section no
later than 30 days after the end of the reporting period for which the report is made.
Test data shall be complete and accurate and include all supporting chemical/physical measurements
performed in association with the toxicity tests, as well as all dose/response data. Total residual
chlorine of the effluent toxicity sample must be measured and reported if chlorine is employed for
disinfection of the waste stream.
Should there be no discharge of flow from the; facility during a month in which toxicity monitoring is
required, the permittee will complete the information located at the top of the aquatic toxicity (AT) test
form indicating the facility name, permit number, pipe number, county, and the month/year of the
report with the notation of "No Flow" in the comment area of the form. The report shall be submitted
to the Environmental Sciences Section at the address cited above.
Should the permittee fail to monitor during a month in which toxicity monitoring is required, then
monthly monitoring will begin immediately. Upon submission of a valid test, this monthly test
requirement will revert to quarterly in the months specified above. Assessment of toxicity compliance
is based on the toxicity testing quarter, which is the three month time interval that begins on the first
day of the month in which toxicity testing is required by this permit and continues until the final day of
the third month.
Should any test data from either these monitoring requirements or tests performed by the North
Carolina Division of Water Quality indicate potential impacts to the receiving stream, this permit may
be re -opened and modified to include alternate monitoring requirements or limits.
If the Permittee monitors any pollutant more frequently then required by this permit, the results of such
monitoring shall be included in the calculation and reporting of the data submitted on the DMR and
AT Forms.

NOTE: Failure to achieve test conditions as specified in the cited document, such as minimum control
organism survival and appropriate environmental controls, shall constitute an invalid test and will
require immediate follow-up testing to be completed no later than the last day of the month following
the month of the initial monitoring.
USE OF A DIFFERENT TEST ORGANISM
The permittee may request the use of a different test organism upon documentation that the alternate
test organism would provide an equal or greater level of protection and is appropriate based on the
characteristics of the discharge and receiving stream. Such documentation would consist of one of the
following:
1. For saltwater classified streams, a fathead minnow may be assigned as the acute testing species
if the salinity of the receiving stream at the point of discharge is <5 ppt throughout the tidally
influenced cycle. This determination may be based on the best professional judgment of DWQ
staff or data collection provided by the permittee and approved by DWQ staff. This evaluation
should include vertical profiles of salinity/conductivity measurements at both high tide and low
tide over several 24 hr cycles.
2. Three consecutive "side -by -side" tests with results indicating that the alternate test organism is
as or more sensitive to the facility's effluent. Each test series would consist of two separate
toxicity tests conducted on the same sample of effluent with the length of exposure specified by
the permit, the only difference between the tests being the organism used.
3. An alternate plan developed by the permittee and approved by the Aquatic Toxicology Unit
that demonstrates an equal level of protection is offered by the test organism.
For items 2 and 3, it must also be demonstrated that viable and standardized culture techniques are
available for that organism and standardized testing methodologies have been developed and
validated. This demonstration should meet guidance provided by EPA in Section 6 of EPA-821-R-02-
012, Short Term Methods for Estimating the Acute Toxicity of Effluents and Receiving Waters to
Freshwater Organisms. Fifth Edition, 2002. Requests to use a different test organism and supporting
documentation should be sent to NC DWQ, ESS at the address listed above.

ADDENDUM - FACT SHEET FOR NPDES PERMIT DEVELOPMENT

11/19/12:
During the period after draft development and before preparation of the final permit, a revised
WTP strategy was issued. In this new strategy this facility meets the criteria to remove iron
monitoring:
- Discharge is into a saltwater receiving stream, no water quality standard applies.
- No chemical additives with iron components are used.
In addition, the revised WTP strategy included an amended acute toxicity monitoring narrative
developed by the Aquatic Toxicology Unit to address criteria for alternative test species.
Ammonia as nitrogen continues to be a toxicant of concern for reverse osmosis wastewater
dischargers and requires monthly monitoring. During the next permit renewal, if the ammonia
as nitrogen effluent data does not exceed 1 mg/L then removal of ammonia as nitrogen
monitoring may be considered.
To be consistent with the current WTP strategy, the final permit will be issued and include the
following changes from the draft permit:
- no iron monitoring requirement
- an amended acute toxicity narrative
an ammonia as nitrogen monthly monitoring requirement.
The Permittee was contacted and reminded the new permit contained an arsenic limit, and
currently there was no recognized treatment ability in his process to address arsenic removal.
After further review, the Permittee concluded improvements in the arsenic measurement
techniques would allow the facility to meet arsenic compliance, and no additional treatment was
warranted.

The Village of Bald Head Island is requesting renewal of permit # NC0085553. Please see attached
Permit Renewal Application (Signed original and (2) copies).
The Village of Bald Head Island has made an addition to our water treatment facility since issuance
of our last permit. The addition was "Secondary Recovery Reverse Osmosis Treatment" (DEH
Serial # 08-01690) which consists of a 3 d Reverse Osmosis (RO) System configured to our existing
RO inventory. This 3n° RO unit we now call "unit C" was operational March 2009.
The secondary recovery unit (unit C) was installed to: (a) reduce the amount of water resource
being discharged off island and (b) increase potable water production. Our treatment facility had
consist of (2) RO units & unit B) configured parallel, both units in full operation would
produced approximately 140) PM of permeate and (60) GPM would be discharged off island as
reject water.
To reduce the amount of "reject water" from being discharged off the island, RO unit C was installed
in series after units A & B and configured to accept their reject water as feed water.
The feed water for unit C consists of approximately (36) GPM well (raw) water and (60) GPM reject
water from units A & B. This new configuration at full operation, has reduced RO reject water
discharge off island from (60) PM to approximately (32) GPM and produces an additional (60)
GPM of permeate. Our w eatment facility can now produce (200) GPM of permeate during full
operation.
