Accordingly, we are forwarding the attached NPDES discharge permit. This permit is issued pursuant to the requirements of North Carolina General Statute 143-215.1 and the Memorandum of Agreement between North Carolina and the U.S. Environmental Protection Agency dated May 9, 1994 (or as subsequently amended). There has been one significant change from the draft permit previously sent to you. The outfall construction requirements at Part I. A. (2.) have been amended to add a reopener clause for any proposed discharge of reverse - osmosis backwash. The Division understands that no immediate discharge is planned from your facility but that discharge may be necessary during this permit cycle. If you wish to discharge reject water from a reverse -osmosis treatment system, characterization data will be required along with your request to construct an outfall line. The permit will likely require modification if you wish to discharge reverse osmosis reject. If any parts, measurement frequencies or sampling requirements contained in this permit are unacceptable to you, you have the right to an adjudicatory hearing upon written request within thirty (30) days following receipt of this letter. This request must be in the form of a written petition, conforming to Chapter 150B of the North Carolina General Statutes, and filed with the Office of Administrative Hearings (6714 Mail Service Center, Raleigh, North Carolina 27699-6714). Unless such demand is made, this decision shall be final and binding. Please note that this permit is not transferable except after notice to the Division. The Division may require modification or revocation and reissuance of the permit. This permit does not affect the legal requirements to obtain other permits which may be required by the Division of Water Quality or permits required by the Division of Land Resources, the Coastal Area Management Act or any other Federal or Local governmental perrnit that may be required. Monitoring is required only if chlorine is added to the treatment system. All samples collected should be from a representative discharge event. There shall be no discharge of floating solids or visible foam in other than trace amounts. A. (2.) OUTFALL CONSTRUCTION / REVERSE OSMOSIS REOPENER Prior to construction of an outfall line, the permittee must obtain an Authorization to Construct (AtC) from the Division, as well as a Coastal Area Management Act (CAMA) permit. Any request for an AtC for an outfall line must be accompanied by analytical data that characterizes any reverse -osmosis backwash to be discharged. Please provide regional perspective for each option evaluated. In the past the utility discharged water softener backwash to the wastewater treatment plant with final disposal through an infiltration basin. The discharge now is sent directly to the infiltration basin. In the future, the infiltration pond may be connected to the golf course spray irrigation system. The permittee is concerned that the discharge of brine could impact groundwater since the shallow unconfined aquifer is the only available potable water supply on the island. Discharge of the wastewater into the adjacent saline surface water is preferable in this case to onsite disposal. S. Other Special Items: PART IV - EVALUATION AND RECOMMENDATIONS The permit was issued five years ago but never used. Because of the concern about possible groundwater impacts from the current practice of infiltration, the permittee wants to renew the permit for another cycle. In the event that groundwater impacts are indicated through monitoring well data, the permittee wants to have the option of installing piping to allow the backwash to be discharged to surface waters in the marina. The Cape Fear River at the entrance to the marina is very close to the confluence with the ocean and is tidal, salty and extremely well flushed. The proposed brine discharge from potable water treatment using reverse osmosis should have little impact on the receiving waters. A policy has been developed for permit conditions for reverse osmosis process discharges. It is the opinion of this office that this level of monitoring is not necessary for discharges to saline waters because of the minimal potential for water quality impact. The current permit contains limits and monitoring requirements for Total Suspended Solids, Settleable Solids, and Turbidity. Additionally, there are monitoring requirements for Total Residual Chlorine, Iron, Chloride, and Flow. It is felt that this level of monitoring is sufficient. Monitoring for Iron and Chloride are not very significant for a discharge to saline, tidal waters and could be removed. It is recommended that a permit be drafted containing the existing level of monitoring, or with the removal of monitoring for Iron and Chloride., If no significant adverse comments are received, it is recommended that a permit be issued for a period of five years. Therefore sludge handling would not pertain. This permit is for the benefit of potable water treatment using a Reverse Osmosis (RO) treatment system. An examination of the Cape Fear basin plan and the NPDES permit schedule has revealed that the existing expiration dates in Cape Fear NPDES permits do not coincide with the revised permit expiration dates for the basin. This discrepancy could create unnecessary delays in the processing of over 200 permit renewals. Accordingly, the Division is changing the permit expiration dates for NPDES permits in the Cape Fear river basin. This permit modification changes the expiration date of the subject permit in subbasin 30617 to November 30, 2001. Please find enclosed the revised permit cover page. Insert the new cover page into your permit and discard the old page. All other terms and conditions contained in the original permit remain unchanged and in full effect. This permit modification is issued under the requirements of North Carolina General Statutes 143-215.1 and the Memorandum of Agreement between North Carolina and the U. S. Environmental Protection Agency. In accordance with the modification of the permit expiration date, the new due date for your renewal application is June 3, 2001.
