The Division of Water Resources (the Division) hereby issues the attached NPDES permit for the subject
facility. This permit is issued pursuant to the requirements of North Carolina General Statute 143-215.1
and the Memorandum of Agreement between North Carolina and the U.S. Environmental Protection
Agency dated October 15, 2007, or as subsequently amended.
The Division understands that you have made no significant changes to your facility the last permit
renewal. We have made the following updates to your previous permit:
• added updates to facility map, outfall locations and parameter codes to Section A. (L)
• updated Total Residual Chlorine (TRC) limit to 17 µg/L because the outfall discharges to
unnamed tributary to Ivy Creek (River) with a 7QIO/30Q2 that equals zero
• added monthly monitoring of Manganese with a Monthly Average Limit of 0.1 mg/L (100 µg/L)
because a reasonable potential analysis (RPA) of the facility's data indicated a reasonable
potential to exceed the Water System (WS-II; HQW, CA) stream standard of 100 µg/L (HQW
reduces water quality standard to half); compliance with this limit shall commence on
December 1, 2019, approximately 48 months from the permit effective date
• added monthly effluent Turbidity monitoring
• removed upstream and downstream Turbidity monitoring
• removed Total Iron monitoring.
We have made the following updates to the draft permit:
• added Total Fluoride monitoring with the following footnote 6: Fluoride monitoring should apply
only if the facility backwashes with fluoridated, finished water.

Proposed federal regulations require electronic submittal of all discharge monitoring reports (DMRs) and
specify that, if a state does not establish a system to receive such submittals, then permittees must submit
DMRs electronically to the Environmental Protection Agency (EPA). The Division anticipates that these
regulations will be adopted and is beginning implementation.
The requirement to begin reporting discharge monitoring data electronically. using the NC DWR's
Electronic Discharge Monitoring Report (eDMR) internet application has been added to your NPDES
permit. (See Special Condition A. (2.)] For information on eDMR, registering for eDMR and obtaining

If any parts, measurement frequencies, or sampling requirements contained in this permit are
unacceptable, you have the right to an adjudicatory hearing, upon written request submitted within thirty
(30) days after receiving this letter. Your request must take the form of a written petition conforming to
Chapter 150B of North Carolina General Statutes, and you must file it with the Office of Administrative
Hearings, 6714 Mail Service Center, Raleigh, North Carolina 27699-6714. Unless such a demand is
made, this permit shall remain final and binding.
Please note that this permit is not transferable except after notice to the Division. The Division may
require modification or revocation and reissuance of the permit. This permit does not affect the legal
requirements to obtain other permits which may be required by the Division of Water Resources or any
other Federal, State, or Local governmental permits that may be required.

In compliance with the provisions of North Carolina General Statute 143-215.1, other -lawful standards

is hereby authorized to discharge treated wastewater from a facility known as
Lawrence T. Sprinkle, Jr. Water Treatment Facility (VVTF)

to receiving waters designated as an unnamed tributary to Ivy Creek (River), within the French Broad
River Basin, in accordance with effluent limitations, monitoring requirements, and other applicable
conditions set forth in Parts I, II, III, and IV hereof.
The permit shall become effective December 1, 2015.
This permit and the authorization to discharge shall expire at midnight on September 30, 2020.

SUPPLEMENT TO PERMIT COVER SHEET
All previous NPDES Permits issued to this facility, whether for operation or discharge are hereby
revoked, and as of this issuance, any previously issued permit bearing this number is no longer effective.
Therefore, the exclusive authority to operate and discharge from this facility arises under the permit
conditions, requirements, terms, and provisions described herein.
Town of Weaverville
is hereby authorized to:
1. continue to operate a conventional technology water treatment plant [coagulation, flocculation,
sedimentation, and filtration] with discharge of wastewaters from media filter backwash and
sedimentation basins with a design potable flowrate of 1.5 MGD and a maximum, monthly average
wastewater discharge of 0.0461 MGD, with water and wastewater treatment consisting of;
• an upflow clarification tank
• flash mix vault and flash mixer
• flocculation
• media filter backwash
• two (2) sedimentation basins
• two (2) media filters
• . clearwell
• a 250,000 gallon waste basin (circular clarifier)
• dechlorination equipment
• chemical usage consists of
o Delpac 2020 (aluminum chloride hydroxide sulfate)
o caustic (sodium hydroxide)
o phosphoric acid
o chlorine gas
o sulfur dioxide
located at the Lawrence T. Sprinkle, Jr. Water Treatment Facility (WTF), 50 Sams Road,
Weaverville, Buncombe County; and
2. discharge from said treatment works via Outfall 001 at a location specified on the attached map,
into an unnamed tributary to Ivy Creek (River) [Stream Segment 6-96-(11.3)], currently a Class
WS-lI; HQW, CA waterbody within Subbasin 04-03-04 [HUC: 060101050805] of the French
Broad River Basin.

1. No later than 270 days from the effective date of this permit, begin submitting discharge monitoring reports
electronically using NC DWR's eDAM application system. See Special Condition A. (3.).
2. For instantaneous flow monitoring, the duration of the discharge must be reported in addition to the
total flow.
3. The Division shall consider all effluent TRC values reported below 50 µg/L to be in compliance with
the permit. However, the Permittee shall continue to record and submit all values reported by North
Carolina certified test methods (including field certified), even if these values fall below 50 µg/L.
4. Compliance with this limit shall commence on December 1, 2019, approximately 48 months from the
permit effective date.
5. Samples shall be collected concurrently with WET -test samples.
6. Fluoride monitoring should apply only if the facility backwashes with fluoridated, finished water.
7. Whole Effluent Toxicity (WET) testing - testing of acute Ceriodaphnia dubia shall be performed as 48 hour
pass/fail test at 90% effluent concentration, during January, April, July and October [See A. (2.)].
Comments:
• Samples shall be taken at the outfall but prior to mixing with the receiving waters.
• There shall be no discharge of floating solids or foam visible in other than trace amounts.

A. (2.) CHRONIC TOXICITY PASS/FAIL MONITORING (QUARTERLY)
[ 15A NCAC 02B .0500 et seq.]
The permittee shall conduct quarterly chronic toxicity tests using test procedures outlined in the "North
Carolina Ceriodaphnia Chronic Effluent Bioassay Procedure," Revised December 2010, or subsequent
versions.
The effluent concentration defined as treatment two in the procedure document is 90%. The testing shall
be performed as a Ceriodaphnia dubia 7-day. pass/fail test. The tests will be performed during the
months of January, April, July and October. These months signify the first month of each three
month toxicity testing quarter assigned to the facility. Effluent sampling for this testing must be
obtained during representative effluent discharge and shall be performed at the NPDES permitted final
effluent discharge below all treatment processes.
All toxicity testing results required as part of this permit condition will be entered on the Effluent
Discharge Monitoring Form (MR-1) for the month in which it was performed, using the parameter code
TGP3B. Additionally, DWR Form AT-1 (original) is to be sent to the following address:

Completed Aquatic Toxicity Test Forms shall be filed with the Water Sciences Section no later than 30
days after the end of the reporting period for which the report is made.
Test data shall be complete and accurate and include all supporting chemical/physical measurements
performed in association with the toxicity tests, as well as all dose/response data. Total residual chlorine
of the effluent toxicity sample must be measured and reported if chlorine is employed for disinfection of
the waste stream.
Should there be no discharge of flow from the facility during a month in which toxicity monitoring is
required, the permittee will complete the information located at the top of the aquatic toxicity (AT) test
form indicating the facility name, permit number, pipe number, county, and the month/year of the report
with the notation of "No Flow" in the comment area of the form. The report shall be submitted to the
Water Sciences Section at the address cited above.
Should the permittee fail to monitor during a month in which toxicity monitoring is required; then
monthly monitoring will begin immediately. Upon submission of a valid test, this monthly test
requirement will revert to quarterly in the months specified above.
Should any test data from this monitoring requirement or tests performed by the North Carolina Division
of Water Resources indicate potential impacts to the receiving stream, this permit may be re -opened and
modified to include alternate monitoring requirements or limits.

NOTE: Failure to achieve test conditions as specified in the cited document, such as minimum control
organism survival, minimum control organism reproduction, and appropriate environmental controls,
shall constitute an invalid test and will require immediate follow-up testing to be completed no later
than the last day of the month following the month of the initial monitoring.
A. (3.) ELECTRONIC REPORTING OF DISCHARGE MONITORING REPORTS
[G.S. 143-215.1(b)]
Proposed federal regulations require electronic submittal of all discharge monitoring reports (DMRs)
and specify that, if a state does not establish a system to receive such submittals, then permittees must
submit DMRs electronically to the Environmental Protection Agency (EPA). The Division adopted
these regulations in 2013.

1. Reporting [Supersedes Section D. (2.) and Section E. (5.) (a)]
Beginning no later than 270 days from the effective date of this permit, the permittee shall report
discharge monitoring data electronically using the NC DWR's Electronic Discharge Monitoring
Report (eDMR) internet application.
Monitoring results obtained during the previous month(s) shall be summarized for each month and
submitted electronically using eDMR. The eDMR system allows permitted facilities to enter
monitoring data and submit DMRs electronically using the internet. Until such time that the state's
eDMR application is compliant with EPA's Cross -Media Electronic Reporting Regulation
(CROMERR), permittees will be required to submit all discharge monitoring data to the state
electronically using eDMR and will be required to complete the eDMR submission by printing,
signing, and submitting one signed original and a copy of the computer printed eDMR to the
following address:

If a permittee is unable to use the eDMR system due to a demonstrated hardship or due to the facility
being physically located in an area where less than 10 percent of the households have broadband
access, then a temporary waiver from the NPDES electronic reporting requirements may be granted
and discharge monitoring data may be submitted on paper DMR forms (MR 1, 1. 1, 2, 3) or
alternative forms approved by the Director. Duplicate signed copies shall be submitted to the
mailing address above.

Requests for temporary waivers from the NPDES electronic reporting requirements must be
submitted in writing to the Division for written approval at least sixty (60) days prior to the date the
facility would be required under this permit to begin using eDMR. Temporary waivers shall be valid
for twelve (12) months and shall thereupon expire. At such time, DMRs shall be submitted
electronically to the Division unless the permittee re -applies for and is granted a new temporary
waiver by the Division.

Regardless of the submission method, the first DMR is due on the last day of the month following
the issuance of the permit or in the case of a new facility, on the last day of the month following the
commencement of discharge.
2. Signatory Requirements [Supplements Section B. (11.) (b) and supersedes Section B. (11.) (d)1
All eDMRs submitted to the permit issuing authority shall be signed by a person described in Part H,
Section B. (11.)(a) or by a duly authorized representative of that person as described in Part 11,
Section B. (I 1.)(b). A person, and not a position, must be delegated signatory authority for eDMR
reporting purposes.
For eDMR submissions, the person signing and submitting the DMR must obtain an eDMR user
account and login credentials to access the eDMR system. For more information on North

Certification. Any person submitting an electronic DMR using the state's eDMR system shall make
the following certification [40 CFR 122.22].. NO OTHER STATEMENTS OF CERTIFICATION
WILL BE ACCEPTED:
"I certify, under penalty of law, that this document and all attachments were prepared under my
direction or supervision in accordance with a system designed to assure that qualified personnel
properly gather and evaluate the information submitted. Based on my inquiry of the person or
persons who manage the system, or those persons directly responsible for gathering the information,
the information submitted is, to the best of my knowledge and belief, true, accurate, and complete. I
am aware that there are significant penalties for submitting false information, including the
possibility of fines and imprisonment for knowing violations. "
3. Records Retention [Supplements Section D. (6.)]
The permittee shall retain records of all Discharge Monitoring Reports, including eDMR submissions. These
records or copies shall be maintained for a period of at least 3 years from the date of the report. This period
may be extended by request of the Director at any time [40 CFR 122.41 ].

January, April, July and October [TGP3B]. The facility has passed 12 of the last quarterly toxicity tests

Stream — Discharge from Lawrence T. Sprinkle, Jr. Water Treatment Facility (WTF) for Outfall 001 is
into an unnamed tributary to Ivy Creek (River) [Stream Segment 6-96-(11.3)]. The pervious permit had
incorrect information for the location of discharge to the wrong stream segment for Ivy Creek. In
addition, the correct stream classification is WS-II; HQW, CA. The classification of High Quality Waters
(HQW) now applies to this stream segment. The 7Q 10/30Q2 data for the unnamed tributary at the
location of the discharge is zero. Stream flow data for an unnamed tributary or effluent channel was
applied to the RPA. Flow information for the main body of Ivy Creek was used in the previous permit.
The segment is not currently listed as impaired on the 2014 North Carolina 303(d) List for fish tissue
Mercury and Fecal Coliform.
RPA — A Reasonable Potential Analysis (RPA) was conducted on Copper, Aluminum, Iron, Manganese and
Turbidity effluent parameters data because Discharge Monitoring Reports (DMRs) reported concentration
above method -detection levels (MDLs), [with the exception of Copper], for the past three (4) years and one
half (1/2) years (Jan2011-Jun2015) that discharge was reported. 7Q10/30Q2 data at the location of the
discharge is zero. Stream flow data for an unnamed tributary or effluent channel was applied to the RPA.

Iron did not show reasonable potential to violate state WQS; since predicted maximum was less than
50%, no monitoring is required.
Manganese effluent data suggest reasonable potential to exceed its WQS standard of 100 µg /L (one
half of the water supply (WS) standard 200 µg /L is applied for HQW waters). Renewal will require
monthly monitoring of Manganese with a Monthly Average Limit of 100 µg /L. This limit will
become active four (4) years from the effective date.

RESPONSE:
I have reviewed the draft permit and determined that the proposed discharge is not located
sufficiently close to any existing or known proposed public water supply intake (_miles) so as
to create an adverse effect on water quality. The DWR concurs with the issuance of this permit
provided the Permittee properly operates and maintains the facility; the Permittee meets the stated
effluent limits prior to discharge; and the discharge does not contravene the designated water
quality standards.

I am reviewing the permit renewal application for NPDES permit NCO085154 Lawrence T. Sprinkle Jr. WTF and had a
question foryou. I'm not sure if you were aware of the general permit NCG590000 for greensand and conventional
WTPs, but appears from a preliminary review that you may be eligible for coverage. I have attached for your review a
copy of the general permit, technical Bulletin and the Pros and Cons of the general permit. Monitoring for you facility
would be found in condition B.(3). Conventional WTP Effluent Limitations and Monitoring Requirements— Discharging to
Freshwater.
Please let me know if you would like to have your Individual NPDES permit converted to the general permit NCG590000.

7. Describe the treatment process(es) for the raw water:
Raw water is injected with Delpac 2020 (Aluminum Chloride Hydroxide Sulfate) and 12.5%
caustic (Sodium Hydroxide) before reaching our up -flow clarifier. Then it is injected again at the
start of our conventional treatment process at the flash mixer. Water then runs through settling
basins to dual media filters. At this point chlorine gas is injected for disinfection. Once filtered
we adjust PH with caustic and add a corrosion inhibitor (phosphate) then to our storage tank to
be pumped to town.
S. Describe the wastewater and the treatment process(es) for wastewater generated by the
facility:
Our 250,000 gal waste basin receives all of our process water and backwash water, this water is
injected with S02 (Sulfur Dioxide) to remove chlorine residual just before it enters the waste
basin. We also empty our settling basins into the waste basin biannually. The clarified water is
decanted to the designated stream and all sludge is pumped from the waste basin into a tanker
and hauled to MSD in Buncombe County.

Waste Water Sludge Management Plan
The Lawrence T. Sprinkle Jr. Water Treatment Facility is a 1.5 MGD municipal
water treatment facility. The facility incorporates the use of an up -flow clarifier
for pre-treatment of surface water. After clarifier treatment process is
conventional in design.
We have a 250,000 gal waste clarification basin for process and backwash water
collection and clarification. Clarified waste water is decanted via use of joined
pipe with winch depth control. Decant of waste waters are controlled by the
following procedures.
Waste waters collected in waste basin are allowed to settle to acceptable limits
set forth in NPDES permit #0085154 requirements. Settled water meeting
NPDES requirements are periodically removed by use of winch controlled
decant pipe. Sludge generated in process is pumped (as needed) by vertical
turbine pump into a licensed waste tanker and hauled to MSD of Buncombe
County for disposal. Disposal is in accordance with North Carolina General
Statues regulating waste disposal.
Daily average effluent is calculated by totaling all filter wash waters, calculated
process sample pump totals and basin volume if drained for cleaning. Typically
the effluent is estimated over a 7 day period. No effluent metering device is in
plac .
