Ivy River WTP
Buncombe County
It has come to the attention of the Division that a typographical error exists in your currently issued
NPDES permit. The permit cover sheet and supplement to permit cover sheet incorrectly states that
the facility discharges to the Ivy River. The discharge should be listed as discharging to an
unnamed tributary to the Ivy River. In accordance with this determination, your NPDES permit
has been modified to reflect the appropriate changes.
Attached to this correspondence are an amended cover sheet and supplement to permit cover sheet
which should be inserted into your permit. The old cover sheet and supplement to permit cover
sheet should be discarded. All other terms and conditions contained in the issued permit remain
unchanged and in full effect. These permit modifications are issued pursuant to the requirements
of North Carolina General Statutes 143-215.1 and the Memorandum of Agreement between North
Carolina. and the U.S. Environmental Protection Agency. This permit modification becomes
effective immediately.
If any parts, measurement frequencies or sampling requirements contained in this permit are
unacceptable to you, you have the right to an adjudicatory hearing upon written request within
thirty (30) days following receipt of this letter. This request must be in the form of a written
petition, conforming to Chapter 150B of the North Carolina General Statutes, and filed with the
Office of Administrative Hearings, Post Office Drawer 27447, Raleigh, North Carolina 27611-
7447. Unless such demand is made, this decision shall be final and binding.

NATIONAL POLLUTANT DISCHARGE ELIMINATION SYSTEM
In compliance with the provision of North Carolina General Statute 143-215.1,
other lawful standards and regulations promulgated and adopted by the North Carolina
Environmental Management Commission, and the Federal Water Pollution Control Act, as
amended,

is hereby authorized to discharge wastewater from a facility located at
Ivy River Water Treatment Plant
Sams Road (NCSR 1769)
north of intersection with NCSR 1768
north of Weaverville
Buncombe County
to receiving waters designated as an unnamed tributary to the Ivy River in the French Broad River
Basin
in accordance with effluent limitations, monitoring requirements, and other conditions set forth in
Parts I, II, and III hereof.
This permit shall become effective March 1, 1996.
This permit and authorization to discharge shall expire at midnight on January 31, 2001.

SUPPLEMENT TO PERMIT COVER SHEET
Town of Weaverville
is hereby authorized to.
Permit No. NCO085154
1. After receiving an Authorization to Construct from the Division of Environmental
Management (see Part III of this permi,), construct a water treatment plant filter backwash
facility as necessary to meet the limits of this permit for wastewater at outfall 001, and
2. Operate said facility located at Ivy River Water Treatment Plant on Sams Road (NCSR
1769), just north of the intersection v ith NCSR 1768, north of Weaverville in Buncombe
County
3. Discharge wastewater from said treat ent works at the location specified on the attached
map into an unnamed tributary to the Ivy River which is classified Class WS-II CA waters in
the French Broad River Basin.
