Deed restrictions and protective covenants are necessary to ensure that the development maintains a "built-upon" area consistent with the design criteria used to size the stormwater control facility. I, Scott Stearns , acknowledge, affirm and agree by my signature below, that I will cause the following deed restrictions and covenants to be recorded prior to the sale of any lot: 1. The following covenants are intended to ensure ongoing compliance with State Storm water Management Permit Number , as issued by the Division of Energy, Mineral and Land Resources under the Storm water Management Regulations. 2. The State of North Carolina is made a beneficiary of these covenants to the extent necessary to maintain compliance with the storm water management permit. 3. These covenants are to run with the land and be binding on all persons and parties claiming under them. 4. The covenants pertaining to storm water may not be altered or rescinded without the express written consent of the State of North Carolina, Division of Energy, Mineral and Land Resources. 5. Alteration of the drainage as shown on the approved plan may not take place without the concurrence of the Division of Energy, Mineral and Land Resources. 6. The maximum built-upon area per lot, in square feet, is as listed below: Lot# BUA Lot# BUA Lot# BUA Lot# BUA LOT NUMBER LOT AREA(SQ FT) MAX BUA(SQ FT) 1 10888 7000 2 10425 7000 - 3 10135 7000 4 12193 7000 5 13177 7000 6 12460 7000 7 12057 7000 8 13890 7000 9 30926 7000 10 17804 7000 11 16640 7000 12 10080 7000 13 10607 7000 14 14187 7000 15 17867 7000 16 13060 7000 17 10080 7000 18 11130 7000 19 11130 7000 20 10080 7000 Form DRPC-3 Rev.2 05Nov2009 Page 1 of 4 High Density Residential Subdivisions Deed Restrictions & Protective Covenances 21 10080 7000 22 10080 7000 23 11745 7000 24 17297 7000 25 10500 7000 26 10500 7000 27 10500 7000 28 11200 7000 29 11200 7000 30 10044 7000 31 10050 7000 32 10501 7000 33 12580 7000 34 14691 7000 35 11544 7000 36 10080 7000 37 10080 7000 38 10080 7000 39 11015 7000 40 12234 7000 41 12000 7000 42 12000 7000 43 12000 7000 44 14100 7000 45 15941 7000 46 14877 7000 47 14471 7000 48 13868 7000 49 13065 7000 50 11345 7000 51 11382 7000 52 13252 7000 53 11232 7000 54 12433 7000 55 12425 7000 56 11209 7000 57 11200 7000 58 11200 7000 59 13821 7000 60 15302 7000 61 14517 7000 62 12777 7000 63 10010 7000 Form DRPC-3 Rev.2 05Nov2009 Page 2 of 4 High Density Residential Subdivisions Deed Restrictions & Protective Covenances 64 10010 7000 65 10528 7000 66 12213 7000 67 12205 7000 68 17992 7000 This allotted amount includes any built-upon area constructed within the lot property boundaries, and that portion of the right-of-way between the front lot line and the edge of the pavement. Built upon area includes, but is not limited to, structures, asphalt, concrete, gravel, brick, stone, slate, coquina and parking areas, but does not include raised, open wood decking, or the water surface of swimming pools. 7. Each lot will maintain a 30**foot wide vegetated buffer between all impervious areas and surface waters. **50 foot for projects located in the 20 coastal counties. 8. All runoff from the built-upon areas on the lot must drain into the permitted system. This may be accomplished through a variety of means including roof drain gutters which drain to the street, grading the lot to drain toward the street, or grading perimeter swales to collect the lot runoff and directing them into a component of the stormwater collection system. Lots that will naturally drain into the system are not required to provide these additional measures.
