A review has been conducted of the self-reported Sanitary Sewer Overflows (SSO's) 5-Day Report/s submitted by
City of Shelby. The Division's Mooresville Regional Office concludes that the City of Shelby violated Permit
Condition I (2) of Permit No. WQCS00037 by failing to effectively manage, maintain, and operate their collection
system so that there is no SSO (Sanitary Sewer Overflow) to the land or surface waters and the SSO constituted
making an outlet to waters of the State for purposes of G.S. 143-215.1(a)(1), for which a permit is required by
G.S. 143-215.1.
The Mooresville Regional Office is providing the City of Shelby an opportunity to provide evidence and justification
as to why the City of Shelby should not be assessed a civil penalty for the violation(s) that are summarized below:

Natural Condition
This Notice of Violation / Notice of Intent to Enforce (NOV/NOI) is being issued for the noted violation. Pursuant
to G.S. 143-215.6A, a civil penalty of not more than twenty-five thousand dollars ($25,000.00) may be assessed
against any person who violates or fails to act in accordance with the terms, conditions, or requirements of any
permit issued pursuant to G.S. 143-215.1.
This office requests that you respond to this Notice, in writing,within 10 business days of its
receipt. In your response, you should address the causes of non-compliance, remedial actions, and all other
actions taken to prevent the recurrence of similar situations. The response to this correspondence will be
considered in this process. Enforcement decisions will also be based on volume spilled, volume reaching surface
waters, duration and gravity, impacts to public health, fish kills or recreational area closures. Other factors
considered in determining the amount of the civil penalty are the violator's history of non-compliance, the cost of
rectifying the damage, whether the spill was intentional and whether money was saved by non-compliance.

Dear Mr. Pitner:
This letter is in reference to the Notice of Violation regarding the sanitary sewer overflows that occurred
on December 26&27, 2023.
Although, the City of Shelby has made strides to limit the number of sanitary sewer overflows, our
system is unable to prevent the inflow and infiltration of rainwater we see on the First Broad River
Outfall with rain over 4 inches, especially when the ground is saturated from previous rains (Exhibit A).
As outlined in other SSO responses we have worked with HDR Engineering as part of the Asset Inventory
and Assessment (AIA) Grant to build a wastewater collection system hydraulic model and have focused
on the First Broad Outfall improvements to minimize future spills.The AIA grant funded $300,000 but to
include more in-depth modeling the City of Shelby funded an additional$180,000 that allowed us to use
Gavel & Dorn Engineering and Bankhead Surveying to increase the number of flow monitoring
equipment and extend surveying to make the model as accurate as possible(Exhibit B).
To this end, the City of Shelby has requested and received funding from North Carolina through S.L.
2023-134 in the amount of$12,087,655 for replacing 8,000 LF (cost dependent)of sewer line (Exhibit C).
The City of Shelby Water Resources Department has recently selected an engineer for this project that
will be approved by City Council on February 5, 2023. Once we have approval of engineering selection,
we will get them under contract and begin SUE and design. We have preliminary model runs that show
greatly reduced sanitary sewer overflows by increasing the size of the pipe from what is currently 24"to
a combination of 30" &36" pipe (Exhibit D).
Previously, I mentioned we would be purchasing SmartCovers for our system. I am happy to report that
we have purchased ten (10) SmartCovers at a cost of just under$45,000.We have deployed these in our
system to help locate sources of I&I in various areas of the City (Exhibit E). The SmartCovers have
already identified areas where we have fixed taps and found homes that have roof drains and carport
drains tapped directly into the City of Shelby sewer system (Exhibit F).

The City of Shelby recognizes that rainwater I&I is a major source of our SSO issues and are making it a
priority of Water Resources Department to find, fund and fix. The funding from NC will go a long way to
help minimize these overflows but more work will still be needed. We have a dedicated annual budget
line item of$50,000 for I&I Repairs in our Capital Projects that we will use to continue to make progress.
Regarding the spill at 400 Johnsfield Drive, this was the first SSO since 2010, only having one other SSO
in 2008 (Exhibit G). This line was found to have a root ball that was impacted by non-disposable wipes
that were flushed further into the line during the rain event. An eight-foot section of sewer line had to
be removed to fully clear out the root ball and wipes. Our FOG program manager has since placed door
hangers at homes in the area where we suspect many non-disposable wipes originated (Exhibit H).
In review of the SSO's that occurred on December 26 & 27 there were no identified impacts to
public health, no fish kills observed, and no recreational areas were closed due to any of these
overflows.All spills were reported, monitored, and remediated in a timely manner.
The City of Shelby asks DWR to consider the work that is being done to reduce I&I in our system and the
planned future work to reduce I&I when determining civil penalties.
