Violations include failing to effectively manage, maintain, and operate the subject collection system so that there is no SSO to the land or surface waters and making an outlet to waters of the State for purposes of G.S. 143-215.1(a)(1), for which a permit is required. Pitner Assistant Regional Supervisor Water Quality Regional Operations Section NCDEQ Mooresville Regional Office 610 East Center Avenue, Suite 301 Mooresville, NC 28115 Subject: Response to Notice of Violation Tracking#NOV-2024-DV-0152 Sanitary Sewer Overflow- February 2024 Collection System Permit No. WQCS00026 Monroe Collection System Union County Dear Mr. Pitner, This letter is in response to the NC Department of Environmental Quality(NCDEQ)Notice of Violation, the letter dated March 12th, 2024 and received by City of Monroe Water Resources on March 14th, 2024. NCDEQ identified the following Sanitary Sewer Overflow (SSO) on February 21st, 2024 as ineffectively managing, and maintaining the collections system. In response the City of Monroe is providing the following evidence that the SSO was unintentional and that the overflow was beyond the reasonable control of our operations and that compliance with our collections system permit remains our utmost responsibility. Incident#202400506 occurred on an off-street easement in the rear a residential area off of Curtis Street. This specific line had been cleaned on January 25, 2023, the area had previously been smoke tested back on February 28, 2017. There was debris noted in the manhole, as noted in the 5-day BIMS report. It was noted when staff was on-site that there was a significant amount of rags, wipes, FOG (Fats, Oil, and Grease) found in the line, which is an all residential area on an off-street easement. The lids in the area are to be water tight. It was noted that the SSO was coming out around the pick holes in the cover. The spill was called in by a home owner off of West Park Drive, a Water Resources crew responded to the call immediately. Upon identifying the area and checking an elevated upstream manhole that was surcharged it was determined, where the blockage was located. When cleaning the line to rid the blockage, it was determined that the spill was a result of rags, wipes, and grease which had created a blockage on the 8" Mr. Andrew Pitner March 15, 2024 Page 2 HDPE gravity sewer main. A City of Monroe Water Resources representative was stationed onsite during the duration of the spill to monitor any changes and when the spill mitigated. Once the spill was stopped the affected area was treated with lime as stated in the BIMS report. We also notified the City of Monroe Storm Water Division of the spill as indicated in the BIM's report. The City of Monroe Water Resources Maintenance Staff are currently working in the area on smoke testing and is distributing educational information to the public using our social media page with the help of the City of Monroe Public Information Officer. The goal is to increase public awareness to help eliminate the spills in the area. While cleaning the line we found debris and have now cleaned the entire area of the line. The Maintenance Superintendent, as well as the Pre-Treatment Coordinator, visited the site and determined that the area is all residential and the debris is coming from a home in the area. After the smoke testing is completed, crews will be using CCTV in the area in the coming months as part of a basin project. The SSO was not within reasonable control of the permittee; the SSO could not have been prevented by the exercise of reasonable control, such as proper management,preventive maintenance. The permittee followed all City of Monroe Sanitary Sewer Overflow Response Plan(SSOP)procedures. The City of Monroe meets and exceeds the 10% cleaning goal each year with various methods including pipe bursting, CIPP,basin cleaning, CCTV and cleaning. The City of Monroe has staff available 24 hours a day 7 days per week with anticipated response time of less the 45 minutes to respond to any given call. This helps us to reduce the impact and duration of sanitary sewer spills. In addition, contracts are utilized with construction companies for emergency situations. The City of Monroe respectively requesting that no civil penalties be applied to the above SSO that occurred during the month of February 2024, due to the above factors being satisfied and evidence showing that the overflow was not expected to occur.
