The self-reported Sanitary Sewer Overflow (SSO) 5-Day Report submitted by City of Hickory indicates violations of
permit conditions stipulated in the subject permit and North Carolina G.S. 143-215.1. Violations include failing to
effectively manage, maintain, and operate the subject collection system so that there is no SSO to the land or
surface waters and making an outlet to waters of the State for purposes of G.S. 143-215.1(a)(1), for which a
permit is required.

Remedial actions, if not already implemented, should be taken to correct the above noncompliance. Please submit
a written response to this Notice of Violation. Your response is to be received by the regional office within 15
business days following receipt of this violation. Please include any additional documentation about this incident(s)
in the response. The submittal will be considered in determining whether the Division will assess a civil penalty for
the cited violations. Regarding the SSO's that occurred on January 9 & 10, 2024, and in keeping with the
Governor's Executive Order No. 300, which declared a statewide state of emergency for the Severe Weather Event
that occurred, the Division of Water Resources is utilizing its enforcement discretion and only issuing a Notice of
Violation for events that noted'Severe Natural Conditions'as contributing to SSO's on those dates. No Additional
response to the Division is necessary for events that occurred within those dates.

Notice of Violation, Tracking No: NOV-2024-DV-0113
Dear Mr. Pitner:
The purpose of this correspondence is to respond to the Notice of Violation (Tracking No.: NOV-2024-DV-
0113)for the City of Hickory Collection System (Permit No.WQCS00020)that occurred January 9 2024.
Incident #202400071 was the result of heavy rain, that began the morning of January 9th 2024 and
continuing through the afternoon, with periods of heavy rainfall. This rain caused localized flooding which
effected the flow to Moose Club Pump Station. The pump station, even with all pumps pumping to full
capacity, could not keep up with the amount of flow due to the flooding. Once the SSO stopped, the
crews cleaned the area of the SSO, picking up any debris left from the SSO.
Incident#202400227 was the result of pipe failure due to creek bank erosion. The creek bank had eroded
past where the PVC line attached to the ductile iron pipe at the creek crossing. The PVC line broke
behind the coupling. The City of Hickory crews plugged the line to stop the SSO and repaired the line.
They replaced the PVC line with ductile more than 10ft into the bank and then restored the creek bank.
The City of Hickory takes all violations seriously and works diligently in promoting and protecting the
environment, health and natural resources of our community through responsible stewardship in the
collection and treatment of wastewater and hopes you will consider the above factors when considering
enforcement action against the violation that occurred. Should you have any further questions, please do
