Violations include failing to effectively manage, maintain, and operate the subject collection system so that there is no SSO to the land or surface waters and making an outlet to waters of the State for purposes of G.S. 143-215.1(a)(1), for which a permit is required. Incidents 202400620 and 20240621 were the fourth and fifth occurrences of SSOs from the line along McKay Road Since December 2023. Please provide an explanation as to why these spills are occurring consistently at this location, the steps that Newton has taken to address them, and the steps that Newton is taking to keep this from happening in the future at this location. As appropriate, your response should include specifics and implementation timelines for Capital Improvement Plans (CIP) covering this portion of your system. Pitner, P.G.,Assistant Regional Supervisor Water Quality Regional Operations Section Mooresville Regional Office Division of Water Resources, NCDEQ 610 East Center Street,Suite 301 Mooresville, NC 28115 Subject: Notice of Violation: NOV-2024-DV-0214 Sanitary Sewer Overflows—March 2024 Collection System Permit No. WQCS00044 Newton Collection System Catawba County Mr. Pitner: I received your letter dated 4/22/2024 on 4/26/2024, regarding the sanitary sewer overflows the incidents regarding Inflow and infiltration during heavy rains and debris restricting flow in W.W.T.P.: • 202400620 • 202400621 The Wastewater Collection Department has been working hard to prioritize this area. The manhole immediately downstream of Clark Creek Wastewater Treatment plant was bolted down and risers installed on the M.H. Sewer crews smoked the primary collection outfall from the Clark Creek W.W.T.P. to the Fair Grounds. Staff has increased cleaning in areas upstream and bolted down and replaced damaged lids in several areas where damaged.The City takes very seriously issues concerning safety and the environment. We inspect the creek crossings and aerials also after rain events. We investigate lines,treat lines for root control. City sewer crews C.C.T.V. and when issues arise, repair them as soon as possible upon discovery. The Wastewater Treatment Plant staff has been investigating a possible problem area between the lime/grit building and the primary clarifiers that could be restricting process volume. Contractors came in and cleaned the Bar Screen Pit,the Wet Well, Lime and Grit Chamber. It is of the upmost importance to resolve any problems issues found and repair any potential sources of infill and infiltration. The City has also contracted with an engineering consultant firm to design and rehabilitate the WWTP. Current project estimates suggest a $50 million (or more) cost. The design is at 30%, with 60% plans expected in mid-May, and construction to start in late 2024 or early 2025.
