Pursuant to G.S. 143-215.6A, a civil penalty of not more than twenty-five thousand dollars ($25,000.00) may be assessed against any person who violates or fails to act in accordance with the terms, conditions, or requirements of any permit issued pursuant to G.S. 143-215.1. Regarding the SSO's that occurred on January 9 & 10, 2024, and in keeping with the Governor's Executive Order No. 300, which declared a statewide state of emergency for the Severe Weather Event that occurred, the Division of Water Resources is utilizing its enforcement discretion and only issuing a Notice of Violation for events that noted'Severe Natural Conditions'as contributing to SSO's on those dates. No Additional response to the Division is necessary for events that occurred within those dates. This office requests that you respond to this Notice, in writing,within 10 business days of its receipt. In your response, you should address the causes of non-compliance, remedial actions, and all other actions taken to prevent the recurrence of similar situations. The response to this correspondence will be considered in this process. Enforcement decisions will also be based on volume spilled, volume reaching surface waters, duration and gravity, impacts to public health, fish kills or recreational area closures. Other factors considered in determining the amount of the civil penalty are the violator's history of non-compliance, the cost of rectifying the damage, whether the spill was intentional and whether money was saved by non-compliance. Center Avenue, Suite 301 Mooresville, North Carolina 28115 Subject: Notice of Violation - Tracking No. NOV-2024-DV-0111 Dear Mr. Pitner, This letter is a follow up to our Notice of ViolatiomQf the above referenced NOV. 400 East 23rd Street (Incident Number 202400303) ) • Incident occurred on 01-15-2024. • The SSO was caused by a creek bank failure resulting the sewer line breaking. • Pursuant to NC G.S. 143-215.1C, the City of Kannapolis gave notice of an untreated wastewater spill to surface waters. • We immediately dispatched a crew out to the location to inspect and make temporary repairs; these temporary repairs stopped the SSO. The temporary repair took some time to install safely due to the steep terrain and ground conditions. A contract for the permanent repair has been issued and this repair should be sufficient to avoid a creek bank failure in this area. The permanent repair will result in an armored and more resilient creek bank. The permanent repair work has begun is scheduled to be complete within the next week. Center Avenue, Suite 301 Mooresville, North Carolina 28115 Subject: Notice of Violation - Tracking No. NOV-2024-DV-0111 Dear Mr. Pitner, This letter is a follow up to our Notice of Violation of the above referenced NOV. 1025 Kansas Street (Incident Number 202400028): • Incident occurred on 01-04-2024. • The SSO was caused by a partial root blockage. • We immediately dispatched a crew out to the location to inspect and cleaned the line. • The impacted area near the backup was flushed with fresh water, raked and lime spread. • Restoration of the site was completed as soon as the blockage was unstopped. City staff inspected downstream conditions and found no evidence of fish kills or any environmental impacts. • This section of sewer main is scheduled for contractor applied (Duke's Root Control) root control in the next few months. The project is funded and moving forward. Center Avenue, Suite 301 tSV►P.LEREGIONALA gee Mooresville, North Carolina 28115 Subject: Notice of Violation - Tracking No. NOV-2024-DV-0111 Dear Mr. Pitner, This letter is a follow up to our Notice of Violation of the above referenced NOV. 307 Cadillac Street (Incident Number 202400058): • Incident occurred on 01-08-2024. • The SSO was caused by a pipe failure from a utility strike while replacing a stormwater culvert. • The City of Kannapolis transportation department was on scene at the time of the strike and contacted the utility department. The utility department immediately dispatched a crew out to the location to inspect and began planning for an emergency bypass pump around. The manhole was plugged, and a bypass pump was installed. • The sewer flowing from the broken pipe was mostly contained and rerouted back to the sewer system. • The broken pipe section was bypassed for over two weeks while a contractor repaired the sewer main at a cost of over $26,500. • The final repair has been made and the system is in full operation.
