Violations include failing to effectively manage, maintain, and operate the subject collection system so that there is no SSO to the land or surface waters and making an outlet to waters of the State for purposes of G.S. 143-215.1(a)(1), for which a permit is required. Please include any additional documentation about this incident(s) in the response. The submittal will be considered in determining whether the Division will assess a civil penalty for the cited violations. Incident 202400711, though minor in volume on March 26th, was the fifth occurrence of a SSO at this location within the past year. Please provide an explanation as to why these spills are occurring consistently at this location, the steps that Kannapolis has taken to address them, and the steps that Kannapolis is taking to keep this from happening in the future at this location. As appropriate, your response should include specifics and implementation timelines for Capital Improvement Plans (CIP) covering this portion of your system. Center Avenue, Suite 301 Mooresville, North Carolina 28115 Subject: Notice of Violation - Tracking No. NOV-2024-DV-0212 Dear Mr. Pitner, This letter is a follow up to our Notice of Violation of the above referenced NOV that was received on May 17, 2024. 1012 Dakota Street (Incident Number 202400711): • Incident occurred on 03-26-2024. • The SSO was caused by debris in the sewer system. • We dispatched a crew immediately to the site once we became aware of the issue. The line was cleaned of all grease and roots. • The impacted area near the spill was flushed with fresh water, raked and lime spread. • Restoration of the site was completed the same day. • Follow-up CCTV was conducted, and it was found there were no deficiencies. Per your letter, you have requested an explanation as to why these spills are occurring consistently at this location, the steps that Kannapolis has taken to address them, and the steps that Kannapolis is taking to keep this from happening in the future at this location. As appropriate, your response should include specifics and implementation timelines for Capital Improvement Plans (CIP) covering this portion of your system. Dakota Street is quite a long street and we believe that this particular SSO was not related to the two primary trouble spots that have resulted in SSOs on Dakota. The two primary areas 1) "Kentucky Outfall" and 2) "Three Mile Branch behind Royal Oaks Elementary School". We did a large Dukes Root Control in March 2024 to target the "Kentucky Outfall". The bulk of the Dukes Root Control work was performed in the area around Dakota, Kentucky and other state streets (Kentucky Outfall). The cost of the this area in project was $19,319.28 and comes with a two year warranty. We have built the repeat treatment costs (in two years) into our CIP. It is recommended that we do not wash the treated mains for 6-months as the roots need to remain uncut; unless an emergency occurs and we need to jet the lines that were treated. 1401 BETHPAGE ROAD, KANNAPOLIS, NC 28081 704.920.4444 WWW.KANNAPOLISNC.GOV We did a targeted engineering study of the "Three Mile Branch behind Royal Oaks Elementary School" which was finished April 2024. This targeted study cost $5,015 (PO 20240612) for the consultant's portion with the City providing in-kind services for CCTV and outfall clearing. It identified several point repairs that need to be made. Staff believe that these failure locations are resulting in blockage accumulations, so we have requested funding in this year's budget to fix this area. The plan would be for the City to bid the point repairs and manhole rehab/lining with an alternate for CIPP. The City intends to perform all necessary point repairs and manhole rehab/lining, but will evaluate CIPP based on pricing and available budget. The point repairs are what is needed to reduce the blockage accumulation points and reduce a large amount of I&I into this area. CIPP is going to be treated more as a wish list item if funding allows, as the primary purpose of the project is SSO and inflow reduction, with infiltration a secondary purpose. We believe that this will offer the most benefit for the amount rehab money available. Other items that the City is doing in this basin include an internal smoke testing project scheduled for June 2024 for the Dakota Street and Yost Street area. There are a few suspected old laterals from previous houses that have been removed in this area and we believe that this is contributing inflow during rain periods and is allowing debris to enter the main. Targeting this area, and one other further down the outfall, will offer the best opportunity to reduce debris entry into the sewer system. We also are targeting smoke testing of Dakota from 1909 Florida Ave, through this area around 1012/1016 Dakota and ending at 1906 Florida Ave (sketched area attached in email). This block is suspected of contributing debris from possible roof drainage tied into private service laterals. Those rain gutters and yard inlets that are tied into the sewer system will be targeted for correction. We will work with the City Attorney to take action to enforce correction on private property to the extent allowed by state law. I have attached in the response email a copy of our projected CIP. This CIP includes annual allotments for I&I and sewer rehab. We plan to prioritize that spending to do the most good for the most people. That includes attempting to reduce the SSOs at Three Mile Branch behind Royal Oaks Elementary School and to continue targeting root control and inflow reduction in the Royal Oaks neighborhood (all of Dakota Street is in the Royal Oaks neighborhood (also commonly call the states streets)). I do believe that we have noticed several SSOs in this area due to previous budgetary cuts directly related to chemical root control. We had previously performed significant root control in the basin, but for a period of about five years we were not able to fund root control. This period of no root control has now shown itself as the effects of that treatment have well expired. By prioritizing chemical root control again in this basin, we expect to see a significant reduction in SSOs as roots are one of the most common causes of overflows in our system. Follow-up heavy cleaning is scheduled to be completed by end of June 2024. • The impacted area near the spill was flushed with fresh water, raked and lime spread. • Restoration of the site was completed the same day. • Follow-up CCTV was conducted, and it was found there were no major deficiencies but there were some roots still present. At that time, our larger more powerful sewer Vacuum/Jetter truck was down for maintenance. The sewer main was open and there was not an immediate risk of a repeat blockage, so we elected to delay heavy cleaning until our truck was back in service. That vacuum/jetter was returned to service just two weeks ago. This particular address is on the list to be rewashed and that is expected to occur in less than three weeks.
