The self-reported Sanitary Sewer Overflow (SSO) 5-Day Report submitted by Town of Mooresville indicates
violations of permit conditions stipulated in the subject permit and North Carolina G.S. 143-215.1. Violations include
failing to effectively manage, maintain, and operate the subject collection system so that there is no SSO to the
land or surface waters and making an outlet to waters of the State for purposes of G.S. 143-215.1(a)(1), for
which a permit is required.

Remedial actions, if not already implemented, should be taken to correct the above noncompliance. Please submit
a written response to this Notice of Violation. Your response is to be received by the regional office within 15
business days following receipt of this violation. Please include any additional documentation about this incident(s)
in the response. The submittal will be considered in determining whether the Division will assess a civil penalty for
the cited violations. Regarding the SSO's that occurred on January 9 & 10, 2024, and in keeping with the
Governor's Executive Order No. 300, which declared a statewide state of emergency for the Severe Weather Event
that occurred, the Division of Water Resources is utilizing its enforcement discretion and only issuing a Notice of
Violation for events that noted'Severe Natural Conditions'as contributing to SSO's on those dates. No Additional
response to the Division is necessary for events that occurred within those dates.

Subject: Response to Notice of Violation& Intent to Issue Civil Penalty

Dear Mr. Pitner,
An investigation was conducted of the Sanitary Sewer Overflows (SSO) listed below within the
wastewater collections system maintained and operated by the Town of Mooresville immediately
after the event occurred. The investigation revealed these to be isolated incidents that occurred
due to very heavy rains, flash flooding,and heavy winds following the storm. Further explanation
of this SSO is listed below including a discussion of remedial and corrective actions.
INCIDENT NUMBER AND ADDRESS:
Incident#202400131 which occurred on 01/09/2024 near 253 Golf Course Drive
Incident#202400132 which occurred on 01/09/2024 near 169 Kilborne Road
Incident#202400133 which occurred on 01/10/2024 near 130 Rockhopper Lane
Incident#202400314 which occurred on 01/13/2024 near 400 West Park Avenue
REMEDIATION EFFORTS:
On January 9, the Town of Mooresville experienced very heavy rains and flash flooding due to a
severe weather system that affected the entire Charlotte region.Local rain gauges indicate between
2.5-4 inches of rain fell during a 24-hour period. As a result, the Town had three discharges of
untreated wastewater directly related to the storm and one a few days later from heavy winds.
Incident#202400131-Reed Creek Pump Station
The flash flooding occurred at Reed Creek. Since Lake Norman was completely full, this creek
that leads to it, could not keep up resulting in a flash flood. The flooding covered a large portion
of the golf course and was all the way against the pump station building. All three pumps in the
building were pumping fine, it just could not keep up with the amount coming in.
Incident#202400132-Autumn Breeze Pump Station
This is a smaller station near Lake Norman. Higher than normal lake levels contributed to more
amounts of infiltration that overwhelmed the station. The pump crew called the vacuum truck to
start pumping and hauling but it spilled an estimated amount of 530 gallons between trips.

Incident#202400133-Northside Pump Station
Something happened to the power grid causing Duke Energy to drop a phase of power to the
station. The automatic transfer switch didn't like the anomaly resulting in it not operating.As soon
as technicians arrived,they quickly troubleshot the problem and manually transferred it, allowing
the generator to power the station,and the overflow ended.
Incident#202400314-400 West Park Avenue
Heavy winds and saturated ground caused a large oak tree to fall, landing across an aerial sewer
line.A staff member noticed it on his day off while driving and gathered a crew to make the repair.
Once they cut and removed the tree out of the way, they replaced the section of aerial sewer line
with temporary piers and bracing. Once the material was delivered, we constructed permanent
supports for the aerial.
COMMENTS:
The Town budgets $1,000,000 annually to sewer rehab which involves I&I studies and SSES to
eliminate sources of inflow and infiltration. These rehabs projects have shown to be effective as
we will continue them and I feel sure these would've been worse if we had not been doing so.
The Town of Mooresville will continue to make operational and system improvements to further
reduce and eliminate all SSOs within the system. If you have any questions regarding this
