Bateman 3505 Primrose Ave. Greensboro, NC 27408 Subject: NOTICE OF VIOLATION Stormwater Project SW7971029 Croatan Village Craven County Dear Mr. Bateman: This letter is to notify you that staff of the Washington Regional Office of the Division of Water Quality conducted a compliance inspection at the stormwater treatment facilities serving Croatan Village on January 31,2008. This inspection was conducted in connection with your request for renewal of permit SW7971029. This inspection revealed that the permitted wet detention pond has not been satisfactorily maintained which is a violation of permit SW7971029. The following items were noted during the inspection and subsequent meeting with Mr. Allen Ross, Maintenance Manager: 1. No maintenance record was kept for the wet pond. 2. Erosion was present at embankment of pond. 3. The appearance of water in pond looks very turbid and trash was visible on the surface of pond. 4. Fountain in the pond which was not part of the initial permit and hence information about the capacity of the pump based on the permanent pool volume is required. 5. An additional building has been added to the existing building and therefore a stormwater permit modification is required specifying the additional impervious area before a new permit can be issued. New plans should be submitted to this office reflecting the addition impervious area to the site. Please submit a proposed plan and schedule to address each of the above items. The plan should include recordkeeping, filling and reseeding, the addition of riprap, etc. as appropriate. Permit SW7971029 includes requirements for proper operation and maintenance including recordkeeping. The "Wet Detention Basin Operation and Maintenance Agreement' which was submitted with your application renewal provides further details regarding maintenance activities. Please refer to these documents in developing your plan. Please submit a proposed list of maintenance activities and schedule within 30 days of receipt of this letter for cleaning and returning the wet detention pond to its original design. All work should be completed no later than March 5, 2008. Please be advised that any violation of the conditions contained in permit SW7971029 may subject you to appropriate enforcement actions in accordance with North Carolina General Statute 143-215.6A which provides that a civil penalty of not more than twenty-five thousand dollars ($25,000.00) per violation may be assessed against a person who fails to comply with permit conditions. Permit Number SW7971029 was issued to you on April 1, 2008 for the Croatan Village, located at Old Cherry Point Road,New Bern, Craven County,North Carolina. This letter is to notify you that deficiencies were found during your file inspection. As a result you may be in violation of Title 15A North Carolina Administrative Code(NCAC) 2H .1003 for failing to comply with terms,conditions and limitations of a Stormwater Management Permit No. SW7971029. Due to the deficiencies noted in your file, DWQ will be performing a site inspection within the next 6-12 months. Please take this time to submit the required documents and inspect your permitted system. Please correct any issues including the maintenance tasks listed in the enclosed O&M agreement. Long term operation and maintenance are the responsibility of the permit holder until such time that the permit is formally transferred through DWQ to another responsible entity. As a result of the DWQ file review,the following deficiencies are noted: 1. Failure to Submit a Designer's Certification Title 15A NCAC 2H .1008 0) requires that upon completion of construction, the designer for the type of stormwater system installed must certify that the system was inspected during construction, was constructed in substantial conformity with plans and specifications approved by DWQ, and complies with the requirements of this Section. As of the date of this letter, DWQ has not received this certification. Mr. Bateman spent $5,250.00 in January 2008 to make repairs to the pond that was discovered during an inspection.Al feels that the certification should have been requested before Mr. Bateman was required to fix the retention pond.
