North Carolina Administrative Code (15A NCAC 2H.0105 (e)) requires that an application for permit renewal be filed at least 180 days prior to expiration of the current permit. To satisfy this requirement, your renewal package should have been sent to the Division postmarked no later than January 1, 2011. The Division has not received a renewal request for the subject permit. This is a violation of your permit at Part II. B. 10., which states "Any permittee that has not requested renewal at least 180 days prior to expiration... will subject the permittee to enforcement procedures as provided in NCGS 143-215.6 and 33 USC 1251 et. seq.". In order to prevent an assessment of civil penalties you must submit a completed permit application (see enclosed forms) no later than March 4, 2011. use the enclosed checklist to complete your renewal package. After considering the recommendations of the staff in the Winston-Salem Regional Office, I have agreed to waive the requirement to submit monthly DMRs for the subject facility, effective May 1, 2010 The DMRs up through (and including) April 2010 should be submitted as usual. Be advised that if and when any wastewater discharge resumes, the discharge must be monitored as per the terms of the NPDES permit and other applicable rules or statutes. The Strategy includes a Wastewater Discharge rule (T15A NCAC 02B .0270) that applies to your wastewater treatment facility. Pursuant to Sub -Item (6)(d) of the rule, I am writing to notify you of the nutrient allocations assigned to your facility. This letter addresses only certain provisions of the Jordan Lake Wastewater Discharge rule. I encourage you to familiarize yourself with the remainder of this rule. Nutrient Allocations. The Wastewater Discharge rule establishes the maximum loads of nitrogen and phosphorus that can be released from wastewater treatment facilities into the Jordan Lake watershed. The rule provides that these wasteload allocations are to be divided among the existing facilities in proportion to (with specific exceptions) their 2001 permitted flows. It also provides that facilities permitted to discharge 100,000 gpd or more are to receive nitrogen and phosphorus limits equivalent to their individual allocations. Your facility has been assigned nitrogen and phosphorus allocations. The allocations are expressed as annual mass loadings delivered to the lake. Due to foreseeable losses between the discharge point and the lake, they are also expressed as the equivalent discharge loads at the point of discharge. However, any nutrient limits already in your NPDES permit will remain in effect. If the facilities permitted for less than 100,000 gpd, as a group, approach their allocations for nitrogen or phosphorus, the Division will consider whether nutrient limits are necessary to protect water quality at that time. In the event that nutrient limits become necessary, the limits would equal your facility's discharge allocations. Nutrient TradinZ. The rule provides that, when one utility connects to another, the allocations held by the closing facility are transferred to the remaining facility. The rule also provides for the trading of allocations among dischargers within each of the major Jordan subwatersheds. Be sure to consult with the Division's NPDES staff before you consider selling allocation: transactions can have profound implications for your facility and its permit. The only solids that could be said to be indirectly produced by the system are the carbon canisters which are properly recycled by the subcontractor that services the facility. This carbon is recycled via thermal processes that in effect `recharge' the carbon for reuse. Approximately 100 pounds of used carbon is recycled per year. An examination,of the Cape Fear basin plan and the NPDES permit schedule has revealed that the existing expiration dates in Cape Fear NPDES permits do not coincide with the revised permit expiration dates for the basin. The source of groundwater contamination is a petroleum release from an underground storage tank formerly located on -site. Preliminary investigations revealed that the contamination is dissolved phase petroleum product contained on -site in a 55 ft. by 62 ft. plume. The remediation system will consist of 5 recovery wells, a water meter, alarm system, STAT 15 low profile air stripper, and activated carbon adsorption to treat 14,400 gpd (10 gpm). The effluent will be piped to the on -site storm drain system for discharge. Sampling results were provided for one monitoring well located in direct vicinity to the former 3,000 gallon gasoline UST designated as the source of contamination. A copy of the submitted data is attached. Reported treatment system removal efficiencies are in excess of 99% for Benzene, Toluene, Ethylbenzene, and Xylenes. Predicted effluent concentrations based on removal efficiency calculations (attached) show that monitoring is required for Toluene, Benzene, Ethylbenzene, Lead, and Phenols. Proposed monitoring requirements shall also include TSS due to reported concentrations of 2,750 mg/1 in MW- 13. MTBE monitoring is also recommended. The sludge generated from these treatment facilities must be disposed of in accordance with G.S. 143-215.1 and in a manner approved by the North Carolina Division of Environmental Management. In the event that the facilities fail to perform satisfactorily, including the creation of nuisance conditions, the Permittee shall take immediate corrective action, including those as may be required by this Division, such as the construction of additional or replacement wastewater treatment or disposal facilities. The Winston-Salem Regional Office, telephone number (910) 771-4600 shall be notified at least forty-eight (48) hours in advance of operation of the installed facilities so that an in -place inspection can be made. Such notification to the regional supervisor shall be made during the normal office hours from 8:00 a.m. until 5:00 p.m. on Monday through Friday, excluding State Holidays. The operator must hold a certificate of the type and grade at least equivalent to or greater than the classification assigned to the wastewater treatment facilities by the Certification Commission. The Permittee must also employ a certified back-up operator of the appropriate type and grade to comply with the conditions of Title 15A, Chapter 8A, .0202. The ORC of the facility must visit each Class I facility at least weekly and each Class II, III, and IV facility at least daily, excluding weekends and holidays, and must properly manage and document daily operation and maintenance of the facility and must comply with all other conditions of Title 15A, Chapter 8A, .0202. Once the facility is classified, the Permittee must submit a letter to the Certification Commission which designates the operator in responsible charge within thirty days after the wastewater treatment facilities are 50% complete. A copy of the approved plans and specifications shall be maintained on file by the Permittee for the life of the facility. The Operational Agreement between the Permittee and the Environmental Management Commission is incorporated herein by reference and is a condition of this Permit. Noncompliance with the terms of the Operational Agreement shall subject the Permittee to all sanctions provided by G. S. 143- 215.6 for violation of or failure to act in accordance with the terms and conditions of this Permit. Failure to abide by the requirements contained in this Authorization to Construct may subject the Permittee to an enforcement action by the Division of Environmental Management in accordance with North Carolina General Statute 143-215.6A to 143-215.6C.
