Durham County
On September 23, 2015, Autumn Romanski of the Raleigh Regional Office (RRO) conducted a
phone conference with Mr. Kurt Ness, Senior Project Manager at Cardno regarding compliance
evaluation inspection of the Town N Country Durham, subject facility. The assistance provided
by Mr. Ness was greatly appreciated. The inspection report checklist is attached.
The following summary of observations is provided:
Cary Oil Company, Inc. operates a groundwater remediation system for petroleum contaminated
groundwater treatment and associated wastewater discharge from Town N Country to receiving
waters, UT to Third Fork Creek, Class WS-IV, NSW waters in the Cape Fear River Basin. The
NPDES Wastewater General Permit NCG510251 was renewed in 2006, and continues under
Certificate of Coverage effective October 1, 2011 through September 30, 2016.
1) The following observations were noted:
a) The permittee record requested with the last date of system operation as December 1,
2004 was received. The system has not been operated for approximately eleven
years.
b) It is recommended that the permittee maintain the wastewater treatment system in
operational condition. Please consult with UST Section to determine if the system
will remain in use/optimally maintained, or request a rescission of the permit if the
wastewater discharge treatment system is no longer required.
c) No wastewater discharge effluent sampling records were reviewed, since the system
was reported as having been shut down with no discharge since 2004. The permittee
is reminded that measurement of quarterly effluent pH monitoring was added in the
2011 permit and that quarterly pH monitoring should be completed using an approved

Funding for the site has been reduced to 80 percent reimbursement. The system was
permitted in the 1997 and it was explained that treatment is unlikely to resume.

Dear Permittee:
The Division received your request for renewal of NCG510251 on March 31, 2011. The revised General
Permit was signed on September 20tb, 2011 and took effect October 1, 2011. This renewed CoC is issued
pursuant to the requirements of North Carolina General Statute 143-215.1 and the Memorandum of
Agreement between North Carolina and the US Environmental Protection agency dated October 15, 2007 [or
as subsequently amended].
A copy of the NCG510000 is enclosed, as well as an updated Technical Bulletin. The Technical
Bulletin summarizes the changes from the previous version of NCG510000. If any parts, measurement
frequencies or sampling requirements contained in this permit are unacceptable to you, you have the right to
request an individual permit by submitting an individual permit application. Unless such demand is made,
this CoC shall be final and binding.
The CoC is not transferable except after notice to the Division. You must notify the Division if you sell
or otherwise transfer ownership of the permitted facility. The Division may require modification or reissuance
of the CoC.
If your facility ceases discharge of wastewater before the expiration date of this permit, contact the
Regional Office listed below. Once discharge from your facility has ceased, this CoC may be rescinded. This
permit does not affect the legal requirements to obtain other permits which may be required by the Division of
Water Quality, the Division of Land Resources, Coastal Area Management Act or any other Federal or Local

Water Quality (DWQ) is forwarding herewith the reissued wastewater general permit Certificate of Coverage
(COC). This COC is reissued pursuant to the requirements of North Carolina General Statute 143-215.1 and the
Memorandum of Agreement between the state of North Carolina and the U.S. Environmental Protection Agency,
dated May 9, 1994 (or as subsquently amended).

requirements to obtain other permits which may be required by DENR or relieve the permittee from responsibility
for compliance with any other applicable federal, state, or local law rule, standard, ordinance, order, judgment, or
decree.

In accordance with your application for renewal of the subject Certificate of Coverage, the Division is forwarding
the enclosed General Permit. This renewal is valid until September 30, 2001.
This permit is issued pursuant to the requirements of North Carolina General Statute 143-215 .1 and the
Memorandum of Agreement between North Carolina and the U.S. Environmental Protection Agency dated December
6, 1983. If any parts, measurement frequencies or sampling requirements contained in this permit are unacceptable to
you, you have the right to request an individual permit by submitting an individual permit application. Unless such
demand is made, this certificate of coverage shall be final and binding.
The Certificate of Coverage for your facility is not transferable except after notice to the Division. Use the enclosed
Permit Name/Ownership Change form to notify the Division if you sell or otherwise transfer ownership of the
subject facility. The Division may require modification or revocation and reissuance of the Certificate of Coverage.
If your facility ceases discharge of wastewater before the expiration date of this permit, contact the Regional
Office listed below at (919) 571-4700. Once discharge from your facility has ceased, this permit may be rescinded.
This permit does not affect the legal requirements to obtain other permits which may be required by the Division of
Water Quality, the Division of Land Resources, Coastal Area Management Act or any other Federal or Local
governmental permit that may be required.

On January 2, 1997, ATC/ATEC Associates Inc. (ATC), on behlaf of Cary Oil Company (Cary
Oil), notified your office of the discontinued use of NPDES Permit No. NCG510251.
Specifically, all remedial activities at the above referenced site have been suspended in accordance
with Senate Bill 1317.
ATC was previously informed that continuance of this permit was not required until such time that
modifications are made to the site ranking, nor would the permit fee or the time to prepare the
renewal permit be reimbursed through the Noth Carolina Trust Fund. Additionally, ATC was
informed that should the above referenced facility become a high priority site, that re -issuance of
the NPDES permit will be streamlined based on the existing information in the NCDEHNR files.
Recent information suggests that the cost to prepare the renewal permit and the permit fee will be
reimbursed, and that it is recommended that the permit not be allowed to expire in July 1997.
Therefore, ATC is resubmitting the renewal request and asking for continuance of the permit.
ATC is forwarding the attached renewal notice for the above -referenced NPDES Permit and a
check for $400.00 as requested.
