Subject: Approval for Pump and Haul Halifax County Industrial Pretreatment Facility Halifax County — iii I> 1 LzvUxJ In response to your request and application dated March 5, 2007, and request for modification made verbally to the Division on March 16, 2007, the Division of Water Quality’s Raleigh Regional Office hereby grants approval for the pumping and hauling of wastewater from the Halifax County Industrial Pretreatment Facility. Up to 150,000 gallons of primarily food process wastewater will be pumped from an equalization basin and hauled or transferred to the City of Rocky Mount’s Wastewater Treatment Plant (Permit No. NC0030317), or the Roanoke Rapids Sanitary District treatment plant (Permit No. NC0024201) for treatment and disposal. This approval shall become voidable unless the agreements between Halifax County, the City of Rocky Mount, the Roanoke Rapids Sanitary District and Granville Farms, Inc., for the hauling and final treatment of the wastewater are in full force and effect. The pumping and hauling herein described shall be performed in accordance with the description, terms, and conditions specified in this document. If any parts, requirements, or limitations contained in this approval are unacceptable, please provide a written response within thirty days after receipt of this approval, describing your concerns. This cover letter shall be considered a part of this approval and is therefore incorporated therein by reference. We understand this document will be attached to the County’s outstanding Pump and Haul permit and collectively will be the State’s permit covering this emergency event. No type of wastewater other than that generated by Reser’s Fine Foods, Inc., and removed from the equalization basin shall_ be included in these pump and haul activities. This approval specifically prohibits the inclusion of any domestic wastewater in the pump and haul activities. In the event that the facilities fail to perform satisfactorily, including the creation of nuisance conditions, Halifax County shall cease operation of all pump and haul activities and take such immediate corrective actions as may be required by this Division. Halifax County is liable for any damages caused by a spill or failure of the pump and haul operations carried out within their premises. Halifax County shall keep a daily inspection log or summary including, as a minimum, the date and time of inspections, observations made, and any maintenance, repairs, or corrective actions taken by Halifax County affecting any aspect of the pump and haul process including any significant changes which could affect the type or character of the wastewater. 9. Any duly authorized officer, employee, or representative of the Division of Water Quality may, upon presentation of credentials, enter and inspect any property, premises, or place on or related to the pump and haul collection facilities at any reasonable time for the purpose of determining compliance with the Division’s approval; may inspect or copy any records that must be maintained under the terms and conditions of this approval; and may obtain samples. 13. Failure to abide by the conditions and limitations contained in this approval may subject Halifax County to appropriate enforcement actions available to the Division. 14. The granting of this approval does not preclude Halifax County from complying with any and all statutes, rules, regulations, or ordinances which may be imposed by other government agencies (local, state, and federal) which have jurisdiction. 15. This approval shall expire 90 calendar days from the date of issuance.
