Trimarchi 401 Olive Branch Rd Durham, NC 27703 SUBJECT: COMPLIANCE EVALUATION INSPECTION NPDES Wastewater General Permit: NCG550000 Certificate of Coverage: NCG550533 Single Family Residence Wastewater Treatment System 401 Olive Branch Rd, Durham, NC 27703 Durham County Dear Ms. Wieland-Trimarchi and Mr. Trimarchi: On June 19, 2024, Division of Water Resources (DWR) Raleigh Regional Office (RRO) staff Jesse Barnes conducted a routine compliance evaluation inspection of the single family wastewater treatment system located at 401 Olive Branch Rd, Durham, NC 27703 in reference to NPDES General Permit NCG550000 and Certificate of Coverage (COC) NCG550533. Owners Sarah Wieland-Trimarchi and Alexander J. Trimarchi (yourselves) were present during the inspection. A review of the subject permit, operations, and maintenance was completed. This review reflected noncompliance with the subject permit. Any determined permit violation(s) and item(s) of concern are listed below, along with other observations. Inspection findings are detailed in the attached Water Compliance Inspection Report. s) of Concern 1. The subject COC (NCG550533) under general permit NCG550000 expired on July 31, 2018 and has not been renewed due to outstanding annual fees totaling $120.00. Part I, Section D. (7.) of the subject permit requires active COCs to pay annual fees or risk nonrenewal. Annual permit fees can be viewed and paid by accessing https://epay.deg.nc.gov/wg-epayments.htmI and entering our permit number, NCG550533. 2. The date of last septic tank inspection and/or pumping was unknown and no records were provided. Some floating solids (grease and biosolids) were observed in the septic tank during the inspection. Part I, Section D. (3.) of the subject permit requires septic tanks to be inspected at least yearly to determine if solids must be removed or if other maintenance is necessary. Additionally, septic tanks shall be pumped out at least once every five years or when the solids level is found to be more than 1/3 of the liquid depth in any compartment, whichever is greater. Records of septic tank inspection and maintenance must be maintained and available for review for a period of three years. 3. No tablets were present in the chlorinator tube during the inspection. Part I, Section D. (1.) of the subject permit requires tablet chlorinators to be inspected weekly to ensure there is an adequate supply of tablets for continuous and proper operation. Please ensure disinfection tablets contain the active ingredient calcium hvpochlorite and are appropriate for domestic wastewater treatment (pool tablets are not acceptable). 4. The location of the outfall is unknown and was not located during the inspection. Part I, Section D. (4.) of the subject permit requires the outfall to be maintained at all times and in good operating order. Part I, Section D. Any visible signs of a malfunctioning system shall be documented, and steps taken to correct the problem. Please locate and regularly inspect the outfall to ensure proper operation. 5. Annual effluent sampling has not been conducted and no laboratory data were available for review during the inspection. Part I, Section C. (3.) of the subject permit requires the system effluent to be sampled annually by a certified laboratory for multiple parameters (see permit) and such data must be retained and available for review for at least three years. Other Observations The subject facility is a single family wastewater treatment system located at 401 Olive Branch Rd, Durham, NC 27703. Version 5.0 of Certificate of Coverage NCG550533 for NPDES General Permit NCG550000 became effective August 1, 2013, and expired at midnight on July 31, 2018. (See Item 1, above.) The system consists of the following known components: septic tank, chlorinator tube, effluent pipe, and outfall area. The subject facility is authorized to discharge wastewater treated in accordance with the subject permit via outfall 001 to the nearby Lick Creek (Stream Index: 27-11-(0.5)), classified as Water Supply IV (WS-IV) and Nutrient Sensitive Waters (NSW) of the State within the Neuse River Basin (Sub -basin: 03-04-01). The residence is currently owned and occupied by Ms. Wieland-Trimarchi and Mr. Trimarchi. There is currently no inspection and/or maintenance agreement with a contractor in place. The septic tank is buried, accessible via riser, and located near the rear (northeastern side) of the residence. Some floating solids (grease and biosolids) were observed in the septic tank during the inspection. No seepage was observed around the septic tank. The date of last septic tank inspection and/or pumping was unknown and no records were provided. See Item 2, above. One chlorinator tube was observed in the rear yard (northeastern corner) of the parcel. Wastewater was observed flowing through the bottom of the chlorinator tube. No tablets were present in the tube during the inspection. See Item 3, above. The location of the outfall was unknown and annual effluent sampling has not been conducted. See Items 4 and 5, above. No issues were reported by the owners. Corrective actions that address all violation(s) and/or item(s) of concern listed above should be planned and completed within a reasonable time. Failure to complete corrective actions and achieve permit compliance within a reasonable time may result in further enforcement actions. Please be aware that the Division may take enforcement action against any individual who fails to comply with the requirements of all applicable permits, regulations, and/or statutes. Pursuant to NC General Statute (NCGS) 143- 215.6A, a civil penalty of not more than twenty-five thousand dollars ($25,000.00) may be assessed against any person who violates or fails to act in accordance with the terms, conditions, or requirements of any permit, or applicable regulations, issued pursuant to G.S. 143-215.1.
