This final permit includes no major change from the draft permit send to you on January 30, 2008. If any parts, measurement frequencies or sampling requirements contained in this permit are unacceptable to you, you have the right to an adjudicatory hearing upon written request within thirty (30) days following receipt of this letter. This request must be in the form of a written petition, conforming to Chapter 150B of the North Carolina General Statutes, and filed with the Office of Administrative Hearings (6714 Mail Service Center, Raleigh, North Carolina 27699-6714). Unless such demand is made, this decision shall be final and binding. Please note that this permit is not transferable except after notice to the Division. The Division may require modification or revocation and reissuance of the permit. The Permittee shall calculate monthly and annual TN Loads as follows: i. Monthly TN Load (pounds/month) = TN x TMF x 8.34 where: TN = TN concentration (mg/L) of the sample collected during the semi-annual monitoring event. Use the TN value for the month in which the sample was taken and successive months until another TN sample is collected. TMF = Total Monthly Flow of wastewater discharged during the month (MG/month). If all discharges are not recorded at the facility, document the calculation(s) used to determine total monthly flow. 8.34 = conversion factor, from (mg/L x MG) to pounds ii. Annual TN Load (pounds/year) = Sum of the 12 Monthly (calculated) TN Loads for the calendar year b. The Permittee shall report the semi-annual Total Nitrogen results in the discharge monitoring report (DMR) for that month. The calculated pounds of TN load per month will be reported on each month's DMR. The Permittee shall report each year's annual results (pounds per year) on the December DMR. A. (3) SPECIAL CONDITIONS The permittee shall maintain records and document the disposal of all solid waste including description of disposed materials and method of disposal. Any purchase order and/or receipts from a contracted disposal service obtained for solid disposal should also be keep as part of the maintained record. Alerted consultant and owner in November 2007 of application missing information but still had not received by the end of December 2007. On December 28, 2007 sent formal certified mail to consultant and owner that the renewal application was not acceptable and could not be processed. Included a copy of the renewal application with a cover letter (return letter #2274) citing the specific missing items. Received 3 copies of amended renewal application 1/17/08 which addressed errors in original application. Noted only two minor discrepancies, (1) applicant did not check the Greensand Filter box and (2) solid waste is generated, able to disposed to landfill. I made correction notations and initial on the 2 copies in the file, 3"d copy has been previously sent to Regional Office. Attempted to alert Michael Harwood, designated Aqua contact, to changes but he is no longer employed by Aqua. Aqua became new owner in 2007 (former owner Heater Utilities). During existing permit cycle TRC limit 28 µg/L had been imposed and owner added dechlorination. Current permit requires monitoring only of calculated TN (2/year) and measured TP (2/year) with no allocation. N-lbs/month calculation uses calculated monthly flow and latest calculated TN (2/year). N-lbs/year is sum of 12 months calculated N-lbs/month. Calculated monthly flow is based on sum of daily flow values on DMR, source of daily flows unknown (estimated, recorder). Current permit limits include TSS (quarterly), Settleable Solids (quarterly), TRC (weekly), and Turbidity (quarterly). Other current permit monitoring items include Iron (quarterly), NO2+NO3 (2/year), TKN (2/year), and Flow instantaneous (quarterly). All samples are grab samples. Fine assesses for permit violation in Oct 2004. Process: Well water is chlorinated as it enters an iron oxidation system. After an initial solid removal step the chlorinated water passes through parallel greensand filters. The backwash water from the greensand filters is dechlorinated as it enters a final sand filter before being discharged. There are two points sources of solid type waste, both are accepted as landfill materials, history of quantity and frequency of disposal unknown. Facility is automated and has a part time certified operator, Ricky Scarborough. Other additives are unknown but based on a conversation with Mr. Scarborough a filter aid may be used seasonally, possibly a pH additive. Mr. Scarborough also stated the plant instrumentation provides a backwash time stamp and records backwash water flow. No changes to TN, TP, NO2+NO3, TKN, Total Monthly Flow, N-lbs/month, N- lbs/year requirements. No changes to A. (2) Calculation of Total Nitrogen Loads and no additional support sections required. Maximum N-lbs per year since 2004 is 3.38lbs, 2007 estimated to be less than 1 lb. Concerns/Changes: FLOW monitoring, currently a total monthly value is provided on the DMR and is calculated from daily values listed on the DMR. Monthly flow required to calculate monthly TN-lbs. WTP guidelines require monthly limit using the monthly average daily flow. Current DMR reports a calculated monthly average daily flow but it is calculated incorrectly, should NOT divide monthly total by total days in the month unless discharge occurs everyday. Will address in draft cover letter. Application states maximum discharge to be 0.005 MGD, current DMR data supports this value so will adopt as permitted flow. Current permit requires quarterly instantaneous flow monitoring which is redundant and will be removed. TTS limit, currently in permit with quarterly measurements required. WTP guidelines require daily and monthly average limits (the same limit value as in current permit) but with 2/month measurements. Will change frequencies in renewal permit. Historical data review indicates violation in 2004. Settleable Solids limit, curreenly in permit with quarterly measurements required. WTP guidelines do NOT require this measurement so it will be removed. Historical data review indicates no violations. Iron monitoring, currently in permit with quarterly measurements required. WTP guidelines require the monitoring of iron but on a monthly bases. Will change frequencies in renewal permit. TRC limit, currently in permit with weekly measurements required. WTP guidelines require the daily limit but with 2/month measurements. Will change frequencies in renewal permit. Validated daily limit value (28µg/L) by recalculating IWC. Will modify footnote narrative to reflect current status. Historical data review indicates no violations. pH limit, NOT in current permit. A check of the low -flow files here at the USGS North Carolina Water Science Center does not indicate any previous determination of low -flow characteristics for your point of interest on Horse Creek. However, there are previous low -flow determinations for other locations on Horse Creek (determined in 1972 and 1982). The location closest to your point of interest was Horse Creek near Wake Forest (station id 0208717450, drainage area 15.3 sgmi, at Secondary Road 1922, now inundated by Falls Lake). In the absence of data, estimates of low -flow characteristics can be determined by assessing the range of low -flow yields (expressed as flow per square mile drainage area, or cfsm) at nearby sites where values have been previously estimated. The annual 7Q10 low -flow yield used in the previous estimate was 0.189 cfsm, based on the 7Q10 yields at some nearby streams. The "most recent" low -flow information published for this area is USGS Water -Resources Investigations Report 98-4135, "Low -flow characteristics and discharge profiles for selected streams in the Neuse River basin, North Carolina" (Weaver, 1998). This report provides low -flow characteristics (based on data through 1996) for USGS continuous- and partial -record sites in the Neuse River basin where sufficient data is available for analyses. However, the report does not provide statistical relations for estimating low -flow characteristics at ungaged locations. There is no online version of the report available, but ordering information for the report is available at hftp://pubs.er.usgs.gov/usgspubs/wri/wri984l35. In Table 7 of this report, there are 3 nearby partial -record sites on Horse and Richland Creeks for which 7Q10 discharge estimates are provided. Expressing these estimates as low -flow yields provides some indication of the yield range that could potentially be applicable to your location. The annual 7Q10 low -flow yields at these sites range from 0.07 to 0.17 (average at about 0.10 cfsm). Similarly, the winter 7Q10 low -flow yields range from 0.18 to about 0.28 (average at about 0.22 cfsm). The annual 7Q10 low -flow yield at the Horse Creek partial -record site is 0.17 cfsm, much closer to the yield used in the previous estimate. No drainage area is listed in our files for your point of interest, but a "quick-n-dirty" delineation of the basin using mapping software indicates the drainage area for your point of interest on Horse Creek is between 11 and 12 sgmi. Applying a drainage area of 11.5 sgmi to the above yield ranges results in an annual 7Q10 discharge ranging from 0.8 to 2.0 cfs and winter 7Q10 discharge ranging from 2.0 to 3.2 cfs. Please be aware that data available at the 3 nearby sites are records that generally date from the 1950's through the mid 1970's. Additional data needs to be collected and analyzed to consider whether the characteristics provided above are reflective of current stream characteristics.
