Accordingly, we are forwarding the attached NPDES discharge permit. This permit is issued pursuant to the requirements of North Carolina General Statute 143-215.1 and the Memorandum of Agreement between North Carolina and the U.S. Environmental Protection Agency dated May 9, 1994 (or as subsequently amended). This final permit includes the following major changes from the draft permit sent to you on July 16, 2003: ➢ Aluminum monitoring has been deleted. D Monitoring for all non -nutrient parameters has been reduced to Quarterly, with the exception of Total Residual Chlorine (TRC). TRC monitoring will be conducted weekly, due to concerns about potential TRC impacts from your facility's discharge. ➢ The monitoring frequencies for Total Nitrogen (TN), TN components and Total Phosphorus have been reduced to semi-annually, based on the minimal flow (<5000 gallons/day) from your facility. This reduction in sampling frequency makes it imperative that representative samples are collected. Collect the TN and TP samples on days when flow is monitored. • Data from the semi-annual samples will be used to calculate the TN load for the facility. The Permittee should maintain accurate estimates of the total discharge each month (total monthly flow, or TMF). The TMF values will be multiplied by the TN values for the semi-annual samples to calculate a TN load for the facility. This permit includes a TRC limit that will take effect on May 1. 2005. If you wish to install dechlorination equipment, the Division has promulgated a simplified approval process for such projects. Guidance for approval of dechlorination projects is attached. If any parts, measurement frequencies or sampling requirements contained in this permit are unacceptable to you, you have the right to an adjudicatory hearing upon written request within thirty (30) days following receipt of this letter. This request must be in the form of a written petition, conforming to Chapter 150B of the North Carolina General Statutes, and filed with the Office of Administrative Hearings (6714 Mail Service Center, Raleigh, North Carolina 27699-6714). Unless such demand is made, this decision shall be final and binding. Please note that this permit is not transferable except after notice to the Division. The Division may require modification or revocation and reissuance of the permit. This permit does not affect the legal requirements to obtain other permits which may be required by the Division of Water Quality or permits required by the Division of Land Resources, the Coastal Area Management Act or any other Federal or Local governmental permit that may be required. There shall be no discharge of floating solids or visible foam in other than trace amounts. Permit NC0085863 .4{ A. (2) CALCULATION OF TOTAL NITROGEN LOADS a. The Permittee shall calculate monthly and annual TN Loads as follows: L Monthly TN Load (pounds/month) = TN x TMF x 8.34 where: TN = TN concentration (mg/L) of the sample collected during the semi-annual monitoring event. Use the TN value for the month in which the sample was taken and successive months until another TN sample is collected. TMF = Total Monthly Flow of wastewater discharged during the month (MG/month). If all discharges are not recorded at the facility, document the calculation(s) used to determine total monthly flow. 8.34 = conversion factor, from (mg/L x MG) to pounds ii. Annual TN Load (pounds/year) = Sum of the 12 Monthly (calculated) TN Loads for the calendar year b. The Permittee shall report the semi-annual Total Nitrogen results in the discharge monitoring report (DMR) for that month. The calculated pounds of TN load per month will be reported on each month's DMR. The Permittee shall report each year's annual results (pounds per year) on the December DMR. The terms, parameters and frequencies appear appropriate. I would suggest: •Putting a date on the limits page for when the TRC 1' it is effective rather than saying "18 months" after the effective date of the permit. This anguage makes it hard to track compliance with the terms of the permit. I would reco en this change be made "universally" to all permits with new TRC limits being added. way the date on the computer system is written in the permit also in plain terms. • The agency should be explicit with Neuse pemrittees as to how they are to report the "Calculated" totals for flow, TKN, TN etc. Should it be reported on DMR's with a parameter code of 50050 and put into a column labeled "MGM"? In this permit it won't make much difference but in others it certainly could make it hard to evaluate. Consistency in reporting is needed. These are very small intermittent discharges which have little to no impact on the environment and when time permits, we would like to investigate the possibility of covering these type permits under a general permit. They are not at all like water treatment plant discharge from a typical surface water treatment plant such as those operated by cities. Each of these permits requires a chlorine limit to be implemented within 18 months which would require installation of chlorine removal equipment on each of these systems. This seems extreme for these small intermittent discharges. Please consider exempting these systems form the chlorine policy due to the insignificance of the discharge. The five permits that Heater has pending are as follows along with my comments: (1) Waterfall Plantation - Permit NC0085863 This draft permit issued on 7/16/03 requires monthly monitoring for everything but TSS which is 2/month and residual chlorine which is required weekly. All of the other draft permits (except Nottingham Forest as discussed below) and existing permits generally require quarterly monitoring for everything including residual chlorine. The Waterfall Plantation draft also includes a monitoring requirement for Aluminum which seems inappropriate ince t is is not a surface water treatment plant and would not have any aluminum. REnldVt Please consider changing the monitor,ng frequency for Waterfall Plantation to quarterly for all parameters, eliminatin4 the Aluminum monitoring requirement, and eliminating the chlorine; jimit as discussed above. (2) Nottingham Forest - Permit NC0055701 This draft permit issued on 7/23/03 requires quarterly monitoring on everything except TSS and Iron which are required monthly. Please consider changing the monitoring frequency for TSS and Iron to quarterly and eliminating the chlorine limit as discussed above. (3) Oak Hollow - Permit NC0073679 This draft permit issued on 7/23/03 requires quarterly monitoring on all parameters which Heater believes is appropriate for this type facility. Please consider eliminating the chlorine limit as discussed above. (4) Hollybrook - Permit NC0082996 This draft permit issued on 7/23/03 requires quarterly monitoring on all parameters which Heater believes is appropriate for this type facility. Please consider eliminating the chlorine limit as discussed above. (5) Stanstead Well #2 - NC0086690 This draft permit issued on 7/23/03 requires quarterly monitoring on all parameters which Heater believes is appropriate for this type facility. Construction No construction of wastewater treatment facilities or additions to add to the plant's treatment capacity or to change the type of process utilized at the treatment plant shall be begun until Final Plans and Specifications have been submitted to the Division of Water Quality and written approval and Authorization to Construct has been issued. B. Groundwater Monitoring The permittee shall, upon written notice from the Director of the Division of Water Quality, conduct groundwater monitoring as may be required to determine the compliance of this NPDES permitted facility with the current groundwater standards. C. Changes in Discharges of Toxic Substances The permittee shall notify the Permit Issuing Authority as soon as it knows or has reason to believe: a. That any activity has occurred or will occur which would result in the discharge, on a routine or frequent basis, of any toxic pollutant which is not limited in the permit, if that discharge will exceed the highest of the following "notification levels'; (1) One hundred micrograms per liter 000 µg/L); (2) Two hundred micrograms per liter (200 µg/L) for acrolein and acrylonitrile; five hundred micrograms per liter (500 µg/L) for 2.4-dinitrophenol and for 2-methyl-4.6-dinitrophenol; and one milligram per liter P mg/L) for antimony; (3) Five (5) times the maximum concentration value reported for that pollutant in the permit application. That any activity has occurred or will occur which would result in any discharge, on a non -routine or infrequent basis, of a toxic pollutant which is not limited in the permit, if that discharge will exceed the highest of the following "notification levels'; p) Five hundred micrograms per liter (500 µg/L); (2) One milligram per liter P mg/L) for antimony; (3) Ten 00) times the maximum concentration value reported for that pollutant in the permit application. If the facility is in substantial non-compliance with the terms and conditions of the NPDES permit or governing rules, regulations or laws, the permittee shall submit a report in such form and detail as required by the Division evaluating these alternatives and a plan of action within sixty (60) days of notification by the Division. PART IV ANNUAL ADMINISTERING AND COMPLIANCE MONITORING FEE REQUIREMENTS A. The permittee must pay the annual administering and compliance monitoring fee within 30 (thirty) days after being billed by the Division. The iron and manganese residue in the backwash water is captured on a sand filter. There is no sludge production. The iron and manganese residue is periodically raked from the top of the sand filter and disposed of in a landfill. Heater Utilities (Heater) other facilities similar to this one are only required to perform quarterly monitoring on most parameters.
