Thorpe, Ph.D., Acting Director Division of Water Quality March 18, 2002 Subject: Issuance of NPDES Permit NC0085812 Grassy Branch WWTP Union County Division personnel have reviewed and approved your application for renewal of the subject permit. Accordingly, we are forwarding the attached NPDES discharge permit. This permit is issued pursuant to the requirements of North Carolina General Statute 143-215.1 and the Memorandum of Agreement between North Carolina and the U.S. Environmental Protection Agency dated May 9, 1994 (or as subsequently amended.) The following modifications are included in the final permit: • In concurrence with your request, the Division agrees that influent samples for BODS and Total Suspended Solids (TSS) may be grab samples until August 31, 2002. Effective September 1, 2002, both influent and effluent samples for BODS and TSS most be composite. • The monthly average effluent BODS and TSS concentrations shall not exceed 15% of the respective influent value. There must be at least an 85% removal rate (per the secondary treatment requirement per 40 CFR Part 133). • Daily maximum limits for BODS and TSS have been changed to weekly average limits. - • Dechlorination has been added as a backup treatment component. • A special condition has been added noting the provisional waiver of instream monitoring as long as Grassy Branch W WIP remains a member of the Yadkin River Basin Association. If any parts, measurement frequencies or sampling requirements contained in this permit are unacceptable to you, you have the right to an adjudicatory hearing upon written request within thirty (30) days following receipt of this letter. This request must be in the foam of a written petition, conforming to Chapter 150B of the North Carolina General Statutes, and filed with the office of Administrative Hearings, 6714 Mail Service Center, Raleigh, North Carolina 27699-6714. Unless such a demand is made, this permit shall be final and binding. Please take notice that this permit is not transferable. The Division may require modification (or revocation and reissuance) of the permit. This permit does not affect the legal requirements to obtain other permits which may be required by the Division of Water Quality or permits required by the Division of Land Resources, Coastal Area Management Act, or any other Federal or Local governmental permits may be required. (3) PROVISIONAL WAIVER OF INSTREAM MONITORING REQUIREMENTS Instream monitoring requirements in this NPDES permit shall be provisionally waived so long as the Permittee remains a member of the Yadkin River Basin Association and the Association continues to function as approved by the Division and Environmental Management Commission. If the Permittee does not participate in the Association or if the Association ceases to function, the instream monitoring requirements in this permit become effective immediately; and the Division may reopen this permit by administrative letter to establish additional instream monitoring requirements, it deems necessary to adequately characterize the effects of the discharges on water quality in the receiving stream. Nowell NPDES Unit NCDENR DWQ 1617 Mail Service Center Raleigh, North Carolina 27699-1617 SUBJECT: Draft NPDES Permit NCO085812 Union County Public Works - Grassy Branch W WTP Dear Ms. Nowell, Public Works is in receipt of the referenced Draft Permit. Only recently has Public Works become aware of the requirement for all POTW's to demonstrate a removal efficiency of not less than 85%. We currently have three (3) permitted facilities that have Daily Maximums as opposed to Weekly Averages. These facilities are Grassy Branch W WTP NC0085812, Tallwood W WTP NCO069523 and Olde Sycamore WWTP W00011928. There are no objections to the limits or conditions contained in the Draft Grassy Branch Permit. Public Works does, however, request that "grab" samples be allowed to be substituted for influent "composite" samples until mid -August 2002. As you are aware, in order for a composite sample to be representative of the incoming waste -load, the sample needs to be flow proportional. Additionally, the flow proportionate samples need to be kept at temperature around YC to ensure sample integrity. Public Works is of the opinion that the best way to ensure proper sample collection and field preservation is through the use of a programmable refrigerated sampler with the ability to accept and process sampling queues. A sampler that meets the above description, such as lsco's Model 3710FR lists for S4500.00. The S4500.00 price tag does not include sampler tubing, sample container or a "flow detection probe". Public Works would like to simultaneously outfit each of the three (3) W WTP s with a programmable flow proportional refrigerated sampler. By outfitting each facility, Public Works will be ready to meet permit requirements for removal efficiency as they arise and Public Works will most likely get a price break for buying three (3) units at the same time. Whether purchased one at a time or in multiple, the end cost is a fiscal year budget amount. The County fiscal year runs Julyl to July 1. The above mentioned request to allow grab samples until mid -August would allow Public Works adequate time to get proper budget appropriations, order and install the units. Public Works Dept is requesting renewal of an existing NPDES permit discharging from the Grassy Branch WWTP to the receiving stream, Crooked Creek. The permit is for a discharge of treated domestic wastewater. The design capacity of the facility is 0.050 MGD. This facility was constructed and wasteflow from three schools was routed here. The average wasteflow as of August 2001 was 0.007 MGD, approximately 13% of design capacity. Application indicates that facility serves between 1000 —4999 persons. Review of compliance data indicates plant had problems meeting limits at startup with violations of BOD5, and NH3 limits in 1998, but performance has improved greatly in the last year and a half. Crooked Creek is listed on the North Carolina 2000 303(d) list, from source to the Rocky River with potential sources of urban runoff/storm sewers. The recommended TMDL and management strategy for addressing oxygen consuming waste is that before any new outfalls are permitted, additional chemical/physical data be collected to aid in assessing the assimilative capacity of the proposed receiving stream. The entire Crooked Creek has a use support rating of partially supporting. The 1996 benthic classification for Crooked Creek was fair. All residuals at the Crooked Creek facility will be aerobically digested. The residuals will be considered stable and therefore suitable for land application when the following criteria are met: I. At least seven (7) residuals samples will be collected and analyzed for Fecal Coliform each monitoring period. The geometric mean of the densities of these samples will be calculated and will be less than 2,000,000 most probable number per gram of dry solids, or less than 2,000,000 Colony Forming Units per gram of total dry solids prior to application. 2.
