This permit is issued pursuant to the requirements of North Carolina General Statute 143-215.1 and the Memorandum of Agreement between North Carolina and the U.S. Environmental Protection Agency dated May 9, 1994. The Division of Water Quality received the comment letter from your consultant, dated December 19, 2001. We apologize for the delay in issuance of this final permit and offer the following response: Effluent data from the facility was reviewed again through 2002. Effluent values did not appear consistent over the past two years. Additionally, other constituents besides the limited and monitored parameters were shown in detectable quantities, although under levels of concern. For this reason, chronic toxicity testing for this complex wastestream must be included in the final permit. Toxicity testing is a requirement with similar discharges from dewatering operations. The toxicity testing months have been changed to March, June, September, and December (this will allow you until June to obtain a contract laboratory to perform toxicity testing). • Monitoring for iron and manganese will be reduced to quarterly, to correspond with toxicity testing. These constituents are no longer a requirement with the general permit for groundwater remediations. However, values were indicated in levels above detectable amounts, so the reduced monitoring will be maintained. Additionally, please note that the federal human health criteria for manganese is 100 ug/l. Levels should be maintained below this value. If any parts, measurement frequencies, or sampling requirements contained in this modification are unacceptable to you, you have the right to an adjudicatory hearing upon written request within thirty (30) days following receipt of this letter. This request must be in the form of a written petition, conforming to Chapter 150B of the North Carolina General Statutes, and filed with the office of Administrative Hearings, Mail Service Center 6714, Raleigh, North Carolina 27699-6714. EFFLUENT LIMITATIONS AND MONITORING REQUIREMENTS — FINAL During the period beginning on the effective date of this permit and lasting until expiration, the Permittee is authorized to discharge from outfall 001. CHRONIC TOXICITY PERMIT LIAUT (QRTRLY) The effluent discharge shall at no time exhibit observable inhibition of reproduction or significant mortality to Ceriodaphnia dubia at an effluent concentration of 90 The permit holder shall perform at a minimum, guarterlu monitoring using test procedures outlined in the "North Carolina Ceriodaphnia Chronic Effluent Bioassay Procedure," Revised February 1998, or subsequent versions or "North Carolina Phase II Chronic Whole Effluent Toxicity Test Procedure" (Revised -February 1998) or subsequent versions. The tests will be performed during the months of March, June, September & December. Effluent sampling for this testing shall be performed at the NPDES permitted final effluent discharge below all treatment processes. If the test procedure performed as the first test of any single quarter results in a failure or ChV below the permit limit, then multiple -concentration testing shall be performed at a minimum, in each of the two following months as described in "North Carolina Phase II Chronic Whole Effluent Toxicity Test Procedure" (Revised -February 1998) or subsequent versions. The chronic value for multiple concentration tests will be determined using the geometric mean of the highest concentration having no detectable impairment of reproduction or survival and the lowest concentration that does have a detectable impairment of reproduction or survival. The definition of "detectable impairment," collection methods, exposure regimes, and further statistical methods are specified in the "North Carolina Phase II Chronic Whole Effluent Toxicity Test Procedure" (Revised - February 1998) or subsequent versions. All toxicity testing results required as part of this permit condition will be entered on the Effluent Discharge Monitoring Form (MR 1) for the months in which tests were performed, using the parameter code TGP3B for the pass/fail results and THP3B for the Chronic Value. Test data shall be complete, accurate, include all supporting chemical/physical measurements and all concentration/response data, and be certified by laboratory supervisor and ORC or approved designate signature. Total residual chlorine of the effluent toxicity sample must be measured and reported if chlorine is employed for disinfection of the waste stream. Should there be no discharge of flow from the facility during a month in which toxicity monitoring is required, the permittee will complete the information located at the top of the aquatic toxicity (AT) test form indicating the facility name, permit number, pipe number, county, and the month/year of the report with the notation of "No Flow" in the comment area of the form. The report shall be submitted to the Environmental Sciences Branch at the address cited above. Should the permittee fail to monitor during a month in which toxicity monitoring is required, monitoring will be required during the following month. Should any test data from this monitoring requirement or tests performed by the North Carolina Division of Water Quality indicate potential impacts to the receiving stream, this permit may be re -opened and modified to include alternate monitoring requirements or limits. Shorenstein Realty is operating under its existing permit right now (the one that was issued 11/1/96, with an expiration date of 8/31/01). Although the permit has expired - because the renewal application has been submitted, Shorenstein may continue operation under that permit. I'll have to mail or fax you the existing permit (we don't have those on-line). (S&ME), on behalf of Shorenstein Realty Investors Two, LP, submits these comments regarding the Draft NPDES Permit dated November 28, 2001. The facility (Carillon) is a landmark high-rise office building located in uptown Charlotte. The building does not generate any waste but is treating groundwater recovered from the building's dewatering system to protect underground parking levels from flooding. The treatment prior to discharge is required because the groundwater contains chlorinated compounds. The dissolved compounds resulted from a release from a former dry cleaning facility located in upgradient portion of the property. The compounds were discovered during construction of the building in 1988. The building will continue to treat the discharged water until the groundwater plume is depleted. Your cover letter indicated that the whole effluent toxicity testing was inadvertently left out of the existing permit. Testing of iron and manganese are included and has also been performed in the past. The toxicity and metals testing were first required when the dewatering system was S&ME, Inc. The treated water from the dewatering system is discharged to the same point where it mixes with up -gradient storm water sources in Uptown Charlotte. The relatively low concentrations of chlorinated solvents in the groundwater have decreased and A ►P the dewatering system remains unchanged since 1988. S&ME does not believe that performance a Su LT5 of these tests would provide any additional or beneficial data based on our experience of thirteen I c,, pis 1 sTCA r years of consistent water quality data. Therefore, we request that the chronic toxicity and metals testing requirements be removed from the permit. Since the discovery of impacted groundwater during building construction in 1988, this site has been monitored by the Division of Waste Management Inactive Hazardous Sites Branch Superfimd Section (Ms. Charlotte V. Jesneck). Shorenstein Realty Investors Two, LP is performing the groundwater capture and treatment on a voluntary basis. Due to the uniqueness of the site and voluntary action on part of Shorenstein Realty Investors Two, LP, a site description is provided below. Site Description The site, known as Carillon, is located in uptown Charlotte, North Carolina at 227 West Trade Street. The office building contains an underground parking garage. Due to shallow groundwater, approximately ten feet below land surface, a permanent dewatering system was installed to prevent uplift of the lowest floor slab and flooding of the underground portion of the parking garage at levels greater than ten feet below land surface. Dewatering systems for similar facilities (i.e. office buildings) are located in the uptown area. We do not know if these facilities are not required to treat the groundwater prior to discharge. The subject groundwater treatment was initially installed (adjacent to the building) in order to treat groundwater generated by dewatering activities during construction of the building in 1988. The N NCDENR, Central Files, NPDES Permit No. NCO085731 S&ME Job No. 1354-96-111 Response to November 28 2001 letter December 19 2001 decision to continue treatment of the discharged groundwater was based on laboratory analyses of groundwater samples (obtained during construction) that indicated low levels of chlorinated solvents. The solvents originated from former dry cleaners located up -gradient of Carillon. A permanent activated carbon filtration system was installed to treat the groundwater recovered from eight de -watering wells. Design details of the carbon filtration system are included in the March 1996 National Pollutant Discharge Elimination System Application for Permit Discharge. The system consists of a vertical polyethylene holding tank (est. 850-gallons), two transfer pumps and two poly -glass adsorbers containing 1,100 pounds of activated carbon each. Eight de -watering wells deliver recovered groundwater to the holding tank at an average rate between 13 to 22-gallons per minute. The float controlled transfer pumps move water from the influent holding tank through the carbon adsorbers and the totalizer flow meter with discharge to the storm -water sewer. Request for Modifications to NPDES PERMIT No. NCO085731 In accordance with the November 28, 2001 NCDENR letter, S&ME, on behalf of Shorenstein - Realty Investors Two, LP request the following modifications to the Draft NPDES Permit. The requests are based on discharge information obtained for the past thirteen years when dewatering began at the site. The modifications are as follows: 1. That the proposed effluent sampling not include the toxicity testing. The treated water discharged from the dewatering system mixes with numerous up -gradient sources in Uptown Charlotte including street runoff. Water quality data obtained since 1988 show consistent influent and effluent water quality for the system. Groundwater sampling results since 1988 indicate that concentrations of tetrachloroethene, resulting from the former dry cleaners, continue to decrease. Past groundwater monitoring results have been submitted to the Inactive Hazardous Sites Branch Superfund Section (Ms. Charlotte Jesneck). We, however, do not have actual data to support this claim. 2. That the effluent monitoring requirements no longer include Iron and Manganese. These two parameters are not related to the targeted chlorinated compound (tetrachloroethene) and are not affected by the dewatering system. Laboratory results for monthly effluent samples, obtained since April 1998, indicate concentrations of manganese and iron below the laboratory quantitation limits and/or below the 15A NCAC 2B Standards. The site, known as the Carillon Building (office building), is located in downtown Charlotte, North Carolina at 227 West Trade Street as indicated in Figure 1 and Sheet No. 5. The office building MR contains an underground parking garage. Due to shallow groundwater, approximately ten feet below ground surface, a permanent de -watering system was installed to prevent uplift of the lowest MR floor slab and flooding of the underground portion of the parking garage. De -watering systems for PM similar facilities (i.e. office buildings) are located in the downtown area. We do not know if these facilities are required to treat the groundwater prior to discharge. The subject groundwater treatment was initially installed (adjacent to the building) in order to treat groundwater generated by de -watering activities during construction of the building in 1988. The decision to continue treatment of the discharged groundwater was based on laboratory analyses of MRP groundwater samples (obtained during construction) that indicated low levels of chlorinated solvents. The solvents originated from a former dry cleaners located up gradient of the Carillon M" Building. A permanent treatment system has since been installed to treat the groundwater recovered fm from eight de -watering wells. Design details of the groundwater treatment system are included in the March 1996 National Pollutant Discharge Elimination System Application for Permit Discharge. The system consists of a vertical polyethylene holding tank (est. 850-gallons), two transfer pumps and two poly -glass adsorbers containing 1,000 pounds of activated carbon each. Eight de -watering wells deliver recovered groundwater to the holding tank at an average rate of 13 to 22-gallons per minute. The MM float controlled transfer pumps move water from the influent holding tank through the adsorbers and the totalizer flow meter with discharge to the storm -water sewer.
