Accordingly, we are forwarding the attached NPDES discharge permit. This permit is issued pursuant to the requirements of North Carolina General Statute 143-215.1 and the Memorandum of Agreement between North Carolina and the U.S. Environmental Protection Agency dated October 15, 2007 (or as subsequently amended). This permit includes the following major changes from the draft permit sent to you on October 12, 2011: Turbidity monitoring and limit have been removed from the permit. The French Broad River, while impaired for turbidity in some sections, is not at the discharge location. pH limits have been removed due to concern about naturally occurring low pH of the groundwater. If any parts, measurement frequencies, or sampling requirements contained in this permit are unacceptable, you have the right to an adjudicatory hearing upon written request within thirty (30) days after receiving this letter. Your request must take the form of a written petition conforming to Chapter 150B of the North Carolina General Statutes, and must be filed with the Office of Administrative Hearings, 6714 Mail Service Center, Raleigh, North Carolina 27699-6714. Unless such demand is made, this permit remains final and binding. This permit is not transferable except after notifying the Division of Water Quality. Chemicals that are to be monitored using an EPA approved method equivalent to the detection levels obtainable by Method 624 and 625 or better are as follows: 2,4-Dinitrophenol, 2-Chloroethylvinyl ether, 3,3-Dichlorobenzidine, 4,6-Dinifro-2-methylphenol, 4 Nitrophenol, Acrolein, Acrylonitrile, Benzidine, Hexachlorocyclopentadine, Pentachlorophenol and Toluene. There shall be no discharge of floating solids or visible foam in other than trace amounts. Permit NCO085979 A.(2.) ACUTE TOXICITY MONITORING (QUARTERLY) The permittee shall conduct acute toxicity tests on a quarterly basis using protocols defined in the North Carolina Procedure Document entitled "Pass/Fail Methodology For Determining Acute Toxicity In A Single Effluent Concentration" (Revised-July,1992 or subsequent versions). The monitoring shall be performed as a Fathead Minnow (Pimephales promelas) 24 hour static test. The effluent concentration at which there may be at no time significant acute mortality is 90% (defined as treatment two in the procedure document). Effluent samples for self -monitoring purposes must be obtained during representative effluent discharge below all waste treatment. The tests will be performed during the months of January, April, July and October. The parameter code for Pimephales promelas is TGE6C. All toxicity testing results required as part of this permit condition will be entered on the Effluent Discharge Form (MR-1) for the month in which it was performed, using the appropriate parameter code. Additionally, DWQ Form AT-2 (original) is to be sent to the following address: Attention: North Carolina Division of Water Quality Environmental Sciences Section 1621 Mail Service Center Raleigh, N.C. 27699-1621 Completed Aquatic Toxicity Test Forms shall be filed with the Environmental Sciences Section no later than 30 days after the end of the reporting period for which the report is made. Test data shall be complete and accurate and include all supporting chemical/physical measurements performed in association with the toxicity tests, as well as all dose/response data. Total residual chlorine of the effluent toxicity sample must be measured and reported if chlorine is employed for disinfection of the waste stream. Should there be no discharge of flow from the facility during any month, the permittee will complete the information located at the top of the aquatic toxicity (AT) test form indicating the facility name, permit number, pipe number, county, and the month/year of the report with the notation of "No Flow" in the comment area of the form. The report shall be submitted to the Environmental Sciences Section at the address cited above. Should any test data from either these monitoring requirements or tests performed by the North Carolina Division of Water Quality indicate potential impacts to the receiving stream, this permit may be re -opened and modified to include alternate monitoring requirements or limits. If the Permittee monitors any pollutant more frequently then required by this permit, the results of such monitoring shall be included in the calculation & reporting of the data submitted on the DMR & all AT Form submitted. NOTE: Failure to achieve test conditions as specified in the cited document, such as minimum control organism survival and appropriate environmental controls, shall constitute an invalid test and will require immediate follow-up testing to be completed no later than the last day of the month following the month of the initial monitoring. In 1992, a salt (chloride) pollution plume was detected in the groundwater <1 mile from the former salt storage facility operated by the NCDOT. Monitoring of the plume was done from 1992-1998. The highest contamination in GW occurred 10/19/95, 9950 mg/L in MW-3. The facility was not planning any remediation; just pump it to the French Broad River. After performing an EAA in 1996, ARO suggested that the facility pump the contaminated groundwater and discharge it into the French Broad River. On 10-2-96 the facility was changed to an individual permit, NC0085979, that discharges into the French Broad River with monitoring requirements. The facility pumps from three (3) recovery wells contaminated with chlorides (road salt). The facility is required to do monthly monitoring for flow, Chloride and pH. Quarterly monitoring is required for Chemicals - EPA Method 624/625 and Acute Tonicity (Fathead Minnow) Pass/Fail. Originating in Transylvania County, the headwaters of the French Broad and Little Rivers are in Subbasin 04-03-01. Most of this Subbasin is forested, and half of the land is protected as part of the Pisgah National Forest. According to the EPA approved 2010 303(d) list for the French Broad River, there are approximately 43.4 miles of impaired water, from Craggy Dam to the Tennessee State line. The waters are impaired for turbidity or for ecological/ biological integrity benthos in different sections, but do not include the Rosman discharge site. TOXICITY TESTING: Current Requirement: Acute P/F @ 90% (also recommended with renewal). NCDOT Rosman Maintenance Facility GWR NPDES NCO085979 Renewal Page 1 COMPLIANCE SUMMARY: BASED ON THE PREVIOUS 2 YEARS The facility has passed all 10 WET tests from January 2009 through March 2011. Quarterly sampling utilizing EPA Methods 624/625 for chemical monitoring has not identified chemical pollutants above North Carolina Water Quality Standards. All samples were below the reporting level. Quarterly sampling for all parameters monitored on the previous permit will continue in this permit. EPA 624/ 625 monitoring is not due to the chloride salts, but rather because there is an inactive coon landfill adjacent to the DOT facility. Monitoring wells on the DOT site etected contamination from the andfill migra°d'ting towards the area where groundwater pumping is taking place. Vinyl chloride, benzene, tetrachlo_roethene, trichloroethene, and xylenes have been detected by the monitoring wells, but reportable Tevels have not been detected in the GWR effluent. RPA: An EPA approved RPA was performed for chlorides. No Reasonable Potential to exceed state water quality standards was found; no limit is required. INSTREAM MONITORING: Not in current permit. Not requested for renewal permit. PERMIT CHANGES: The Asheville Regional Office recommends that pH be monitored without the normal 6.0 - 9.0 S.U. limits because the pH of groundwater in that area tends to be low naturally. A review of DMR data showed several instances of pH in the 5.4 to 5.7 S.U. range. The discharge flowrate is very small compared to the river flow - the IWC is 0.06%; the dilution factor is 1,603, so any pH variation would be very quickly overcome by the dilution of the river. The 2000 permit renewal did not have pH limits because of the low pH of groundwater. In the 2005 renewal, pH limits were added. In the 2010/ 2011 renewal draft permit, the 6.0 - 9.0 limits were retained, but should be removed. Removing the limits but retaining pH monitoring should be considered a minor modification, not requiring new public notice due to provisions of 15A NCAC 02H .0114(b) (1).
