I ran this project by USFWS due to concerns of potential suitable habitat for Atlantic pigtoe at the southernmost crossing (S3 (UT2 to Little Black Creek)), where open-cut pipe installation is currently proposed. The Raleigh USFWS Office confirmed that it this stream did appear suitable for Atlantic pigtoe, which is found downstream in Black Creek. To continue processing this permit request and remain complaint with Section 7 of the Endangered Species Act, please update plans to reflect stream avoidance at S3 (UT2 to Little Black Creek) via a trenchless crossing, or you may provide an aquatic species survey reflecting 200 m 100 m upstream and 400 m downstream from the proposed crossing, in order for us to initiate consultation with USFWS at this proposed crossing. Is this project in compliance with FEMA-approved state and/or local floodplain management requirements? Yes, the project follows FEMA-approved state and local floodplain management requirements. 1. Please complete the 'water resources' tab in the attached worksheet and return it to me. Please refer to the attached ORM excel spreadsheet for the completed 'water resources' tab. 1. Please confirm that all impact locations would be revegetated and regraded to preconstruction contours after any permitted work is complete. All locations will be revegetated with the appropriate wetland or riparian buffer seed mixture, as identified on Drawing Number G2 in the attached design plans. All jurisdictional areas undergoing disturbance during construction have been labeled to reference the appropriate seed mixture to ensure proper revegetation by the contractor following project completion. All jurisdictional areas undergoing disturbance will be regraded to preconstruction contours following any permitted work. 1. The existing grade at the proposed bank stabilization location seems relatively steep. In similar projects, applicants have opted to list a temporary impact at these locations to err on the side of 'permit noncompliance' as opposed to an 'unauthorized activity' in the event of riprap falling back into the stream. Would including this temporary 'work area' as an impact be agreeable to your client, or are other measures proposed to address this potentiality?" There is an area of existing riprap shown at STA 5+00 on Drawing Number P1. The pipe will be installed via trenchless methods at this location and no adjustments will be made to the existing riprap. The riprap is shown on the design drawings as an existing feature for the contractor to be aware of during construction activities. There will be a temporary modification of existing permanent impacts at both S1 and S3. The temporary modification will include removal and restoration of existing riprap along the stream bank for open-cut pipe installation. Both S1 and S3 provide temporary limits of disturbance to ensure the contractor stays in compliance with federal and state permitting regulations. Thank you! This project has been assigned the file number SAW-2023-01788 and is known as Kennebec & Maude Stewart Waterline Extension. This file number should be referenced in all correspondence concerning this project. A review of the information provided indicates that the proposed work would include the crossing of five streams and one wetland for the installation of approximately 2 miles of a 12-inch PVC waterline. Three stream crossings would have no impacts due to trenchless installation methods under aquatic resources. Impact S1 at UT2 to Black Creek would result in 0.0031 acre of temporary stream impact for open-cut installation of the waterline, construction access, and temporary stream pump around. Impact S2 at UT3 to Black Creek would result in 0.0037 acre of temporary stream impact for open-cut installation of the waterline, construction access, and temporary stream pump around. There would be a temporary wetland impact at Wetland W1/WA for open-cut installation of the waterline and construction access (0.018 acre). The project/review area is located from Kennebec Road, just north of Buck Rowland Road, to the intersection of Maude Stewart Road and Tram Road, or at Latitude 35.558125 and Longitude -78.739652 (center point); in Fuquay-Varina, Wake County, North Carolina. We have determined that the proposed work is authorized by Nationwide Permit 58: Utility Line Activities for Water and Other Substances pursuant to authorities under Section 404 of the Clean Water Act (33 U.S.C. § 1344). The proposed work must be accomplished in strict accordance with the general permit conditions, any regional conditions, the special conditions listed in this letter, the application materials, and the enclosed plans. If the extent of the project area and/or nature of the authorized impacts to waters are modified, a revised PCN must be submitted to this office for written approval before work is initiated. Any violation of permit conditions or deviation from your submitted plans may subject the permittee to enforcement action. This verification is valid until March 14, 2026, unless prior to this date the subject NWP(s) is suspended, revoked, or is modified such that the activity no longer complies with the terms and conditions of this NWP. If you commence or are under contract to commence this activity before the date that the relevant NWP is modified or revoked, you will have 12 months from the date of the modification or revocation of the NWP to complete the activity under the present terms and conditions of this NWP. Project Specific Special Conditions: 1. Suitable habitat for tricolored bat (Perimyotis subflavus) may be present at the site. On September 14, 2022, the USFWS published a proposal in the Federal Register to list the tricolored bat as endangered under the Endangered Species Act (ESA). The permittee understands and agrees that all work associated with the clearing and removal of trees and removal or modification of culverts must be completed prior to the effective date of the final listing in the Federal Register. Work associated with the aforementioned activities not completed by that time must cease and the permittee must contact the Corps’ via N. The time limit for completing the work authorized ends on March 14, 2026. 2. You must maintain the activity authorized by this permit in good condition and in conformance with the terms and conditions of this permit. You are not relieved of this requirement if you abandon the permitted activity, although you may make a good faith transfer to a third party in compliance with General Condition 4 below. Should you wish to cease to maintain the authorized activity or should you desire to abandon it without a good faith transfer, you must obtain a modification of this permit from this office, which may require restoration of the area. 3. If you discover any previously unknown historic or archeological remains while accomplishing the activity authorized by this permit, you must immediately notify this office of what you have found. We will initiate the Federal and state coordination required to determine if the remains warrant a recovery effort of if the site is eligible for listing in the National Register of Historic Places. 4. If you sell the property associated with this permit you must obtain the signature of the new owner detailed in General Condition 29 and forward a copy to this office to validate the transfer of this authorization. 5. If a conditioned water quality certification has been issued for your project, you must comply with the conditions specified in the certification as special conditions to this permit. For your convenience, a copy of the certification is attached if it contains such conditions. 6. You must allow a representative from this office to inspect the authorized activity at any time deemed necessary to ensure that it is being or has been accomplished in accordance with the terms and conditions of your permit.
