Sue & Billy:
Attached are the updated DMS acceptance letter and an updated SOA from EcoTerra. Still no word from
the Williams on the proposed agreement. This may simply take awhile to work out with them, but HIM is
clearly acting in best interest and there's certainly no certainty that the proposed work would even
impact their wells as they're a good distance away and further upstream from the project.
Mary Ann will be sending a follow up email shortly with the two exhibits and narrative response to Billy's
questions.
We're both around next week if you all have any questions.

I'm meeting with Mary Ann this afternoon to go over the additional information Billy requested in his July
2nd email below.
We'll discuss this as well. But yes we will request an updated DMS acceptance letter and will check back
with the bank to confirm the buffer mitigation credits. We'll forward you the updated documents. I don't
believe that there are any updates on the well protection plan.

Given that the DMS acceptance letter expires in a couple weeks, would you consider getting it updated for our

Can you tell us if there are any updates to the Well Protection Plan for Mr. Williams.

I have one more question regarding the additional alternative provided (Alternative 5, Southern Pit
Plan). Based on the alternative analysis summary table, it appears that the preferred alternative
(Alternative 4, Western Pit Plan) would allow for the continued operation of the mine for an additional
42 years but Alternative 5 would only allow for 5 additional years of operation. However, based on the
exhibits, it appears that the expansion area for Alternative 4 is roughly twice that of Alternative 5 but
the difference in additional tonnage is roughly 8 times different (5.4M tons with Alt 5 and 46.6M tons
with Alt 4). Can you please clarify why there is such a difference in reserves based on expansion area?
Perhaps quantifying the area of expansion with each alternative would help since I'm only estimating
based on the exhibits.

Please find attached the applicant's responses and additional information that you
requested within your May 24, 2024 letter.
We were hoping to have obtained a formal agreement with the Williams to address their
concerns regarding their wells before the 30-day response deadline, but as the deadline is
scheduled for this Monday and as the Williams and Heidelberg Materials (HM) will need
additional time to finalize the agreement, we decided best to go ahead and provide you this
response now. We believe that it is unlikely that the expansion project would have an
impact on their wells, given the distance from and being uphill of the quarry site and since
the existing pit has been at depth for many years without a documented impact to their
wells. That said, HM still wants to help alleviate any concerns that they may have and
mitigate any impacts to the wells that are documented in the future. As such, HM has
proposed an agreement like the example provided which has been used successfully at
other HM quarries to help ensure that their concerns are addressed if any impacts are
documented in the future.
The rest of your questions have been addressed within the attached response including the
analysis of the additional Alternative 5 (Stream F and associated wetland avoidance).
Unfortunately, this new alternative was found to not provide adequate reserves.
We have also copied NCDWR on this response to assist them in their continued review of
the application. For both of your convenience, I've also attached the previously provided
response to the NCDWR April[ 22, 2024 letter including the updated impact table, impact
maps and mitigation plan.
