Director Mayor Eddie Braxton Town of Scotland Neck 1310 Main St. Scotland Neck, NC 27874 NORTH CAROLINA Environmental Quality July 12, 2024 Subject: Variance Request Approval WQSV00013 (WQCS00157) 2022 ARPA Sewer Improvements Halifax County Dear Mayor Braxton: The Division of Water Resources (Division) has reviewed the submitted variance request received July 8, 2024, as well as the additional information submitted July 12, 2024, for the subject project. The Division will grant the variance request for the rehabilitation and operation of gravity sewer below the minimum required slope, with less than the minimum ground cover, and without use of ductile iron pipe in accordance with the provisions for alternative design under 15A NCAC 02T.0105(n): 1. Pursuant to the variance request received July 8, 2024 from Engineering Services, PA on behalf of the Town of Scotland Neck, a variance is granted for the rehabilitation/replacement and operation of approximately 1,198 linear feet of 8-inch gravity sewer between Manholes MH 110 to MH 109, MH 111 to MH 110, MH 112 to MH 111 at varying slopes between 0.22% and 0.38%; approximately 4,111 linear feet of 10-inch gravity sewer between Manholes MH 23 to MH 22, MH 24 to MH 23, MH 25 to MH 24, MH 26 to MH 25, MH 26A to MH 26, MH 27 to MH 26A, MH 27A to MH 27, MH 28 to MH 27A, MH 29 to MH 28, MH 29A to MH 29, MH 29B to MH 29A, and MH 30 to MH 29B at varying slopes between 0.05% and 0.22%; approximately 735 linear feet of 12- inch gravity sewer between Manholes MH 21 to MH 20 and MH 22 to MH 21 at slopes of 0.21% and 0.12%, respectively as indicated on the provided plans, specifications, and supporting documents, and subject to the following requirements: a. The sections of gravity sewer as described above shall be designated as "high -priority sewer" in accordance with 15A NCAC 02T.0402. b. High -priority sewers shall be inspected by the permittee or its representative at least once every six -months in accordance with the permittee's individual system -wide collection system permit (WQCS00157). 2. Additionally, a variance is granted for the 10-inch segments between Manholes MH 25 to MH 24, MH 29B to MH 29A, and MH 30 to MH 29B for not meeting minimum cover requirements and not using ductile iron pipe as required by 15A NCAC 02T .0305 (f) and (g)(4). Regardless of the variance approval, in the event that the wastewater collection facilities fail to perform satisfactorily, including the creation of nuisance conditions, the Permittee shall take immediate corrective Docusign Envelope ID: 796CD75F-7A3F-488A-8470-5E4E94B939B2 WQSV00013 action, including those as may be required by this Division, such as the construction of additional or replacement facilities. All other elements of this project shall be constructed in accordance with all applicable rules and statues including, 15A NCAC 2T; the Division of Water Resources' (Division) Gravity Sewer Minimum Design Criteria adopted February 12, 1996 as applicable; and the Division's Minimum Design Criteria for the Fast - Track Permitting of Pump Stations and Force Mains adopted June 1, 2000 as applicable. Approval of the variance request does not constitute approval of the permit.
