Test results indicate that the SHWT is greater than 12 inches below the lowest point of the vegetative swales (Swales AA-LL) for the proposed project. Therefore, the separation requirements between the bottom of the swales and the SHWT have been met for the proposed project. At the time of the delineation maps were not being signed, and therefore no map has been signed On July 25, 2007 a meeting with Brad Shaver was held, with the following decision. Recent court proceedings have given the Corps authority to sign mops, with some changes in their process. The courts have decided that isolated wetlands will have to be verified by the EPA, be/bre a map can be signed Since the map for the Highlands at Queens Creek; was not signed it falls under the new guidelines. A small isolated wetland is located on the project, and the map will be sent to the EPA for review, with a review period time line of 15 days. Once this has taken place the map will be ready for signature. The project is to be located on NCSR 1576 (Queens Haven Road) in Onslow County, North Carolina approximately 0.7 miles north of its intersection with Queens Creek Road. STREETS/PARKING LOTS, ETC.: Once completed, the subdivision will be served by approximately 11,200 linear feet of paved streets that will be 20' wide. There will be a total of six (6) named streets within the subdivision, which are Inverness Drive, Southerland Court, Moray Court, Highlander Drive, Kinroff Drive and Aberdineshire Court. Each street will have a cul-de-sac except for Inverness Drive and Kinroff Drive. Inverness Drive ends at the intersection of Southerland Court and Kinroff Drive will connect to a short extension of Sanders Drive. Sanders Drive is an existing State-maintained street. Two small parking lots (one near each entrance to the subdivision) will be constructed along with a Basketball Court. Paving of streets, parking lots and Basketball Court will consist of an Aggregate Stone Base overlaid with Bituminous Asphalt Paving. All streets are to remain private after construction. The entrance/exits of the community at Queens Haven Road and Sanders Drive will be gated. STORMWATER RUNOFF/EROSION&SEDIMENTATION CONTROL: This development consists of an approximate total land area of 295 acres. No more than 12% of the project area will be impervious. Construction will be performed in two phases, Phase I and Phase II. Roadside ditches and swales will typically serve as street drainage. A section of Highlander Drive between Station 15+10 and Station 22+00 will be a fill section and will not have any roadside swales. There may also be other shorter areas where roadside swales are not required. Roadside swales would not typically be required in the deeper fill sections where the topography is conducive to sheet flow or otherwise. Collected water will then be temporarily stored and released into onsite wetland areas through additional vegetative swales. There will be approximately 97 linear feet of vegetative outlet swales for each drainage acre. At the end of each swale, a level spreader will be provided. All new swales and/or roadside ditches will have a maximum side slope of 3 horizontal to 1 vertical. Swales will typically have a longitudinal slope between 0.3 and 0.5 percent. A vegetative buffer will be maintained where possible; however, we understand that there are no waters classified as streams, perennial streams, surface waters or Waters of the US. Stormwater piping will be limited to street crossings only. Site runoff eventually drains to Queens Creek, Parrot Swamp or Bell Swamp, which are all classified as SA waters. The nearest surface waters of the three water bodies described above are located approximately 0.25 miles or more from the project boundary, but less than 0.5 miles of the project boundary. Erosion and sedimentation control will be achieved using temporary erosion control devices where required, such as rock check dams, stabilized construction entrances, energy dissipaters, silt fence and temporary sediment traps. The project has been designed with a maximum disturbed area of approximately 93 acres. Approximately 61 acres will be disturbed during Phase I and approximately 32 acres will be disturbed during Phase II. Regardless of the phasing, Owner/Contractor is permitted to have a maximum disturbed area of 20 acres at any given time as specified in the Construction Sequence in the Stormwater/Erosion Control/Grading Plans. Many areas of the site are very flat (<0.5 percent or less); however there will be some areas where the existing ground surface is currently, and will remain, on the order of 5 percent. Since some areas at the site are very flat, we expect that fill soils will have to be imported to the site for both street construction and lot grading. The Construction Sequence specifies that all imported fill shall be obtained from a "NCDENR Permitted Mine." Typically, soil waste such as topsoil, will be spread on non-structural areas of lots and common areas. Should excess waste be generated during construction activities, then Construction Sequence specifies disposing of it at a "NCDENR Permitted Landfill." The disturbed limits include grading at individual lots. Grading of lots, for the most part, should be minimal. Cut from the higher areas of the streets and lots can be used as fill in the lower areas of the site, provided it is suitable for its intended purpose. We do not expect cut sections in excess of approximately 7 feet and do not expect fill sections in excess of approximately 4 feet. Once land disturbing activities have been completed, Owner intends to ensure the establishment of permanent ground cover. Permanent ground cover will be maintained after the subdivision is "built- out." If any lots are to be reserved for construction at a later date, then the subject lot shall either be graded and stabilized using vegetation per the plans, or not disturbed at all. WETLANDS: There are approximately 154+/- acres of wetlands within the project boundary. Wetlands have been delineated by Mr. Haywood Pitman (Soil Scientist)who has recently met with the US Army Corps of Engineers at the project. We understand that streets will cross wetlands at three (3) locations, which will require USACOE and 401 permitting. We also understand an evaluation by EPA of certain wetland areas at the site are pending. It is our understanding that a combined total of 0.32 acres of wetlands will be impacted and a total of 0.0 acres of stream will be impacted in these three areas. Mitigation will be made by payment to NCEEP for a total of 0.64 acres of non-riparian wetlands. Seven copies of the PCN along with the appropriate plan sheets will be submitted to NCDENR, once the USACOE instructs Owner/Owner's Representative to submit the wetlands"package"to them. OTHER: A water distribution line from the ONWASA will be constructed in the street shoulders to service the development. No lot shall be resubdivided. ARTICLE III:CONSTRUCTION STANDARDS Only site-built homes will be allowed. ARTICLE V:SETBACK LINES No building,structure,fence,hedge,outbuilding, or appurtenance of any nature shall be located closer to any property line or street right of way than the minimum building lines shown on the recorded plat. ARTICLE VI:ANIMALS No animals,livestock or poultry of any kind shall be raised,kept or bred on any Lot,except as follows: dogs,cats or other household pets may be kept,provided they are not kept,bred or maintained for any commercial purposes,and provided they are not allowed to run at large or otherwise become a nuisance to the community.Owners shall be solely and absolutely liable for the acts of any pet kept on their Lot. ARTICLE VII:UTILITY LINES Ali electrical service and telephone lines shalt be placed underground and no outside electrical tines shall be placed overhead unless prior written approval is given by the Declarant or the Association. Any waiver of these restrictions shall not constitute a waiver as to other Lots or lines. The Declarant reserves the tight to subject the Property to a contract with an electric utility company for the instigation of underground electric cables and/or the installation of street lighting,either or both of which may require an initial payment and/or a continuing monthly payment to said utility company by each Lot Owner for a pro rats share of installation and maintenance expenses. The Declarant shall be entitled to reimbursement from each Lot Owner for any water and/or sewer permits,tap fees or meters which have been obtained at the Dectarant's expense. ARTICLE VID:NUISANCES No noxious,offensive or illegal activity shall be carried on or-*conducted upon any Lot nor shall anything be done on any Lot that shall be or become an unreasonable annoyance or nuisance to the neighborhood. All Lots, whether occupied or unoccupied, shall be well-maintained and no unattractive sir:wtii or accumulation of rubbish or debris shall be permitted to remain on a Lot. No automobile,other vehicles or similar items shah be repaired or placed on blocks or stands except in an enclosed garage. ARTICLE X:SIGHT DISTANCE AT INTERSECTIONS No fence,wall,hedge,shrub planting or other item which obstructs sight lines at elevations between two(2)and Four(4)feet hi height shall be permitted to remain on any Lot within any sight triangle easement as shown on the recorded plat,nor within ten(10)feet of the intersection of the road right-of-way line with any driveway,mid no portion of any tree shall be permitted to remain within such areas unless the foliage line is maintained at sufficient height to prevent obstruction of sight lines. ARTICLE XL FENCES No fences in excess of six(6)feet in height(except for eight-foot-high privacy fencing separating the Highlands from Queens Creek Mobile Home Estates)shall be constructed between the front building line and the back lot line ofany Lot;there shall be no fences between the front budding line and the street. ARTICLE Xii:DRAINAGE Drainageways shall conform to the requirements of aP_lawful public authorities,to the full extent of the authority given thew by law. Further,Declarant may,at its option, require more restrictive drainageways if the same would promote the best interest of the development. ARTICLE XIII:FUTURE DEVELOPMENT The Declarant reserves the ogle to annex any property now owned or hereafter acquired by the Declarant and adjoining the Property,and to subject such additional property to the restrictive covenants sex forth herein,without prior approval or consent of the Lot Owners or Association ARTICLE XIV:MEMBERSHIP AND VOTING RIGHTS Section 1. Membership. Every owner of a Lot which is subject to assessment shall be a member of the association. Membership shall be appurtenant to and may not be separated from ownership of any Lot which is subject to assessment. Section 2. Voting Rights. The Association shell have two classes of voting membership. Cl ss A. Class A members shall be all owners,with the exception ofthe Declarant, and shall be entitled to one vote for each Lot owned When more than one person holds an interest in any Lot,ell such persons shall he members. The vote for such Lot shall be exercised as they determine,but in no event shall more than one vote by cast with respect to any Lot. (lass B. Section 3. Maximum Annual.Assessment. Until January I of the year immediately following the conveyance of the first Lot to an Owner,the maximum annual assessment shall be 5350.00 per Lot. There shall be an extra S150.00 per year assessment for each of the forty-eight (48)Lots utilizing the six(6)common septic drainfield areas. a. Section 6, Jjnitbrrn Rate of Assessment, Both annual and special assessments must be fixed at a°uniform rate for ail Lots(except for the additional assessments for Lots utilizing the common septic systems as stated above)and shall be collected on a regular basis.
