1.This project is not eligible for the Nationwide Permit 18 since the proposed discharge of fill is greater than
1/10th of an acre. Please indicate what type of permit you would like to use. The proposed work may fit under
the NWP 39 but there may be other verifications that also work.
We acknowledge that the project is not eligible for Nationwide Permit 18 due to the proposed discharge of fill
being greater than 1/10th of an acre. After reviewing the options, we propose to utilize Nationwide Permit 39 for
this project. Please let us know if there are any additional verifications or requirements we need to address for
this permit type.
2.Please indicate how the project has avoided and minimized impacts to aquatic resources. The information in
section E (1) of the PCN is not sufficient. For example the diveway could be extended and a few building
removed from the front to allow W1 to remain intact. Please include details of the stormwater feature outfall
location and elevations. If the outfall can be routed to W1 or the ditch associated with W1 that would maintain
hydrology.
Driveway and Building Placement: We have considered extending the driveway and removing a few buildings
from the front to preserve Wetland 1 (W1) in its entirety. However, based on the current grading of the property
and the stormwater pond design, as well as the city's specific requirements for setbacks from the road, it has
been determined that the impact on W1 is unavoidable. The layout has been optimized to minimize the footprint
and avoid impacts where feasible. The width of the driveways and the inclusion of turnouts are necessary to
comply with fire code regulations, ensuring safe access for emergency vehicles. These elements are critical for
the safety and functionality of the site and cannot be compromised. Please refer to the attached wetland/ditch
impact site map for further details. The map illustrates the specific areas of impact and the measures taken to
minimize these impacts. These illustrations will additionally clarify the grading of the property along with
appropriate labels for setbacks and turnouts for emergency vehicles.
The site plan shows some of the setback mentioned. The Impact Maps were updated to label the driveways
required by the fire department, and show some proposed contours. The site was designed so that buildings at
the rear of the project would not be building below the existing ground. That causes the front be built a few ft
above ground, and the existing contours show the project's proposed contours in that area along with the pond.
Moving the buildings adjacent to the pond wouldn't really allow the pond to be moved at all, between setback
and contours, the overall size and location of the pond would remain the same.
3. The delineation verified in 2020 was completed under the Navigable Waters Protection Rule (NWPR).
Please delineate/evaluate the site under the current rules and supply the corresponding wetland data sheets.
Additionally, the JD/permit for the adjacent parcel with townhomes constructed show a wetland area that
appears to cross over onto the project area parcel. I will get with SEGi regarding a site visit to verify aquatic
resource boundaries.
Following your recent meeting at the site, we have made thorough evaluations and determinations based on
the conditions observed. We greatly appreciate the insights gained from this on -site review.
4. The proposed impacts would require mitigation. In a complete application we need a mitigation plan but not
necessarily a reservation letter from a bank. I see that there is a note in the PCN that indicates something has
been requested (?). The reservation letter would be required prior to permit authorization, however, for a
complete application please provide a mitigation plan
