Accordingly, we are forwarding the attached NPDES discharge permit. This permit is issued pursuant to the requirements of North Carolina General Statute 143-215.1 and the Memorandum of Agreement between North Carolina and the U.S. Environmental Protection Agency dated October 15, 2007 (or as subsequently amended). The following modifications in the June 22, 2011 draft permit remain in the final permit: • Modifying existing Single Effluent Limits page to Two Effluent limits pages with Phased Effluent flows; o A. (1) 0.010 MGD with BOD limits of Monthly Average 30.0 mg/L and Weekly Average 45.0 mg/L NH3 as N Summer limits of Monthly Average 7.0 mg/L and Weekly Average 18.0 mg/L NH3 as N Winter limits of Monthly Average 20.0 mg/L and Weekly Average 35.0 mg/L o A. Please note that Lewis Creek is listed as an impaired waterbody on the North Carolina 303(d) Impaired Waters List. Addressing impaired waters is a high priority for the Division, and instream data will continue to be evaluated. If there is continual noncompliance with your effluent limits, or if stream impairment can be attributed to your facility's discharge, mitigative measures may be required. Henderson Count BACKGROUND The Henderson County Utilities Department has requested renewal of its NPDES permit NCO028916 for the Western Justice Academy WWTP which has a design flow of 0.03 MGD. The WWTP discharges into Lewis Creek, Class C - Trout water, in the French Broad River Basin. The facility treats domestic waste only and has no industrial dischargers. RECEIVING STREAM INFORMATION This facility is located in Subbasin 04-03-02 and discharges to Lewis Creek, classified C-Trout waters in the French Broad River Basin. The receiving stream is listed on the 2010 303(d) list as impaired. Historically, there have been no 7Q10 values available for stream flows to determine limits for the Western Justice discharge. As of this renewal no additional flow information has been submitted by the facility. Facility will be required to submit flow data during this permit renewal to formulate science based limits at all flow levels. PERMIT RENEWAL SUBMITTAL Permittee submitted a June 9, 2010 letter requesting changes to permit. Increase BOD limits to 45 mg/L daily max, 30 mg/L monthly average. (In 2011 facility submitted the same request for limits to be changed which was denied by DWQ.): • Eliminate upstream/downstream FC and DO sampling • Revise Summer NH3 and N limits to 10 mg/L monthly Avg and 35 mg/L daily max • Revise Winter NH3 and N limits to 25 mg/L monthly Avg and 35 mg/L daily max. The rational utilized by the facility in this limit change request indicates this discharge point is within 0.5 miles of NCO088056 Blacksmith Run which has different permit limits for these parameters which do not characterize a discharge to a zero flow stream.. Fact Sheet NPDES NCO028916 Renewal Page I LIMITS DEVELOPMENT: Existing zero flow denotation is a policy decision made on 11/7/1997 and based on information presented during 9-26-97 public hearing for this facility which stated that unauthorized water diversions from farmers and agricultural practices were drying up Lewis Creek. This information and policy decision generated the 5 & 2 limits with 5 mg/I DO and 17 ug/L TRC placed in the first permit, to ensure the maximum level of treatment. These limits have been incorporated in each subsequent permit renewal until this renewal. ARO indicates that the assumption of unauthorized water diversions was not documented and that agricultural practices have changed since the permit was issued. ARO also agrees that CO should reevaluate the facilities request at this time. Model run by Jackie Nowell using 1.2 cfs as 7Q10 value and utilizing reduced flows at 0.010 MGD predicated compliance from Western Justice. Two effluent pages A. (1) at 0.010 MGD and A. (2). At 0.030 MGD will be incorporated into this permit renewal. Facility will be required to submit new science based (USGS) flow data for all flows which will be utilized in conjunction with the Blacksmith and Western Justice renewals in 2016. PERMIT LIMIT COMPLIANCE Since the permit was renewed in 2006, the facility has received six (6) NOV's for Monitoring Frequency violations and five (5) NOV's for BOD5 violations. DMR DATA (2006-2010) DMR data from January 2006 through July 2010 was reviewed. Monthly and weekly averages for conventional parameters are summarized below. INSTREAM MONITORING Upstream Site: At least 50 feet above the outfall; Downstream site: Approx. 0.5 miles from the outfall. A review of instream data for DO and Temperature indicated no elevated values for these parameters. It is recommended that instream sampling for Temperature and DO be removed from this permit. A review of instream data for Fecal Coliform indicates elevated downstream readings for sampling events during this permit cycle. It is recommended that instream monitoring for Fecal Coliform be continued at the existing frequency. Fact Sheet NPDES NCO028916 Renewal Page 2 INSPECTION / CORRESPONDENCE FILES (2006-2010) The ARO has conducted five (3) Inspections during this permit cycle with no reported compliance issues. Facility appeared to be well operated and maintained during 8-25-2010 inspection. SUMMARY OF PROPOSED CHANGES In keeping with Division policies, the following changes will be incorporated into the permit: • Two effluent pages reflecting Phased flows have been added • A. Re: 7Q10 info Mr. Freeman, In response to your inquiry about the 7Q10 low -flow statistic for a location on Lewis Creek at U.S. Highway 64 near Edneyville in Henderson County, the following initial response is provided: A check of the low -flow files here at the USGS North Carolina Water Science Center does not indicate a previous determination for your specific point of interest on Lewis Creek at U.S. Highway 64 near Edneyville. In the absence of discharge records sufficient for a low -flow analysis, estimates of low -flow discharges are determined by assessing a range of low -flow yields (expressed as flow per square mile drainage area, of cfsm) at nearby locations where low -flow discharges have been determined. A preliminary assessment of available information at nearby locations where low -flow discharges were published in a statewide low -flow report for North Carolina (Giese and Mason, 1993; available online at htti)://Pubs.er.uscis.gov/#search:advance/page=1/page size=100/series cd=WSP/report number-2403:0) indicates the 7Q10 low -flow yields for streams in vicinity of Edneyville range from about 0.3 to about 0.7 cfsm (average between 0.4 and 0.5). The regional relations presented in the above -referenced report for Hydrologic Area 10 indicate that a 7Q10 low -flow yield (using a drainage area 5 sgmi and mean annual runoff at 1.5 cfsm) is 0.24 cfsm. A preliminary drainage area of 4.6 sgmi was determined for your point of interest using the online StreamStats application available for the upper French Broad River basin (http://water.usgs.gov/osw/streamstats/north carolina.html). I talked to Charles and Roger about the renewals for Blacksmith Run (NC0088056) and Western Justice Academy (NC0086070). Blacksmith Run is located within 0.5 mile upstream of the Western Justice Academy. They both discharge into Lewis Creek (C-Trout). Both permits are up for renewal. The Justice Academy sent you a letter (dated July 9, 210), requesting the following changes: 1. Increase current BOD limits: From: Summer 5.0 mo ave and 7.5 weekly ave To: Summer 30 mo ave and 45 daily ave From: Winter 30 mo ave and 15 weekly ave To: Winter 30 mo ave and 45 daily ave (Which is 30/45 year round.) 2. Increase ammonia nitrogen limits: From: Summer 2.0 mo ave and 6 weekly ave To: 30 mo ave and 35 daily ave From: Winter 4 mo ave and 12 weekly ave To: 25 mo ave and 35 daily ave 3. Eliminate the upstream and downstream monitoring requirements for: fecal coliform dissoived oxygen (and I would also include: temperature) :. These requested changes for the Justice Academy would reflect the current requirements for Blacksmith Run. A copy of both limit pages were sent with the Justice Academy's letter. Since both of these facilities discharge into Lewis Creek within half a mile of each other, we would like to see permits limits for both facilities be more balanced. The ARO is requesting that the Justice Academy's limits be relaxed and Blacksmith Run's limits stay the same. I spoke with Soil and Water staff regarding current agricultural practices in the area. Based on our discussions, we don't feel that the same irrigation practices are being used now, compared to those that were used in 1998 (when the permit was originally issued). This is due to farms becoming GAP (good agricultural practices) certified, so that their produce can be sold to local grocery stores under the USDA guidelines. Most produce farmers are no longer using surface water for irrigation, they are using groundwater or other protected sources. In light of these recent developments, the ARO feels that the proposed limit changes are justified for the Justice Academy. Charles recommended sending this info to you and Bob, since Bob is handling the renewal of the Justice Academy. Charles. Upon permit renewal, Western Justice requested that their limits be relaxed and be made equal to Blacksmith Run WWTP. Existing limits of Western Justice are tertiary (5/2/6) for protection of nearly zero flow stream situation caused by farmer irrigation. Blacksmith's limits were developed without the low flow situation as a concern and are based on oxygen consumption and NH3 toxicity (30/10 (s) and 30/25 (w), no effluent DO limit). I" modeling scenario - Both dischargers at existing limits. Historical headwater 7g10 flow of 1.2 cfs was used at Western Justice, based on current information that the sandbagging of stream that caused zero/low flow conditions upstream are no longer in practice. Result: Instream DO of 6 mg/I is protected downstream, however stream profile indicates that NH3 toxicity criteria of 4.5 mg/I is exceeded instream below the Blacksmith Run discharge. 2"d scenario— Dischargers at equivalent limits (BOD5=30,NH3 tox=10.8, DO =5). This is what Western Justice requested. Applicable Permit: NPEDS # NCO086070 Description of treatment process: The 0.030 MGD extended aeration facility consists of a bar screen, flow recorder, equalization basin, duel aeration basins, dual secondary clarifiers, tertiary filters, post aeration, disinfection / chlorination, and an aerated sludge holding basin. The monthly average effluent BOD5 and Total Suspended Residue concentrations shall not exceed 15 % of the respective influent value (85% removal). This facility is located in Edneyville at the WNC Justice Academy on US 64 in Henderson County. Sludge Management This facility builds sludge slowly, due to the low influent flow. As the need for sludge removal becomes apparent it will be wasted to the digester where it will be stored and thickened for cost effective hauling. As the flow increases at this facility it may become necessary to increase the frequency in hauling. Sludge removal will be by Mike's Septic, (828-775-1658) a local pump truck contractor. He will haul the sludge to disposal at the Town of Brevard or the City of Hendersonville waste treatment facility. All associated costs of this hauling will be paid by Henderson County Utilities Department. Removal and management of this sludge will be done in a timely manner and in the best interests of the facility operation and the environment.
