Accordingly, we are forwarding the attached NPDES discharge permit. This permit is issued pursuant to the requirements of North Carolina General Statute 143-215.1 and the Memorandum of Agreement between North Carolina and the U.S. Environmental Protection Agency dated May 9, 1994 (or as subsequently amended). Division personnel have reviewed your request for changes to BOD5 and NH3 - N limits. Based on the amount of public interest and the irrigation practices of the area, the Division must deny your request. These stringent limits would not normally be imposed where the receiving stream has significant flow, however several water withdrawals from the creek (for irrigation) cast doubt on the low -flow estimates of this stream. The hearing officer also took the public comments into account and recommended the strictest effluent limits possible as an extra precaution. If any parts, measurement frequencies or sampling requirements contained in this permit are unacceptable to you, you have the right to an adjudicatory hearing upon written request within thirty (30) days following receipt of this letter. This request must be in the form of a written petition, conforming to Chapter 150B of the North Carolina General Statutes, and filed with the Office of Administrative Hearings (6714 Mail Service Center, Raleigh, North Carolina 27699-6714). Unless such demand is made, this decision shall be final and binding. Please note that this permit is not transferable except after notice to the Division. The Division may require modification or revocation and reissuance of the permit. As a part of the renewal process I would like to request that the following changes be made to the referenced Permit: BOD25 (April 1-October 31) NH3 as N (April 1-October 31) Current limits Requested limits Monthly Weekly Monthly Weekly Average Average Avera e Average 5.0 mg/I 7.5 mg/I 10.0 mg/1 15.0 mg/1 2.0 mg/1 4.0 mg/I If the "anti -degradation clause" was a major factor in requiring strict limits for BOD25 and NH3 as N, I believe it would be appropriate to make the limits less strict due to the following: Lewis Creek, at the discharge point for the subject Permit, is not a pristine mountain stream, but rather a stream that is being affected by farming and commercial activities. Additionally, I believe the comparison of the actual average daily flow to the 7Q10 flow of Lewis Creek supports our request for the referenced limit changes. The subject treatment plant is currently permitted for 30,000 gallons per day, however, the Justice Academy is the only customer discharging to the treatment plant in question and even with the dormitory and cafeteria �g399 now in operation the actual daily flow is only 3,180 gallons per day compared to a summer 7Q10 flow in Lewis Creek of 1CFS (646,272 gallons per day). The actual flow into the subject treatment plant is not expected to increase significantly over the next 5-year permitting period. If I can provide additional information, please let me know.
