Division personnel have reviewed and approved your request (dated December 2, 2009) to modify the subject permit.
Accordingly, we are forwarding the attached NPDES discharge permit. This permit is issued pursuant to the requirements
of North Carolina General Statute 143-215.1 and the Memorandum of Agreement between North Carolina and the U.S.
Environmental Protection Agency dated October 15, 2007 (or as subsequently amended).
This modified permit includes the following changes from your current permit:
Re -Route of Wastewater from NCO086886 (The Green at Wachovia) to NCO088226 (Wachovia Tryon
Street). Wachovia Tryon will serve as a combined discharge for the two groundwater/dewater
systems. Per your submission, the combined treated wastewater will be used for on -site needs such as
cooling towers, and when the site is fully occupied and operational, the system will be designed to use
up to 100% of the treated groundwater captured from both sites with little to no discharge to the
outfall. However, in the short-term it is anticipated that there will be excess water which will require
intermittent discharge to surface waters. Per our phone discussion, the proposed treatment system will
include RO units, but any RO reject will be sent to the Charlotte -Mecklenburg Utilities (CMU)
sanitary sewer, since Division permitting policies do not allow for discharge of RO reject to
freshwaters given the likely toxicity. The subject NPDES permit will retain Effluent Sheet A.1 for the
existing discharge, and a new Effluent Sheet A.2 has been added for the combined discharge.
Contaminants of concern for each discharge have been combined into the A.2 Effluent Sheet for the
combined discharge. Effluent limitations have also been updated to reflect changes to EPA surface
water quality criteria and/or North Carolina water quality standards.
Authorization to Construct Permit. You will need to obtain an Authorization to Construct (ATC)
permit from DWQ/Construction Grants and Loans prior to constructing the proposed groundwater

treatment system. Effluent Sheet A.2 for the combined discharge will become effective after an
Engineer's Certificate for completion of the treatment system construction is submitted.
Miscellaneous. Following project completion, you should request rescission of permit NCO086886
(The Green at Wachovia), otherwise you will be subject to annual fees and reporting requirements for
that permit. Please note that permit renewal applications for both permits are due no later than January
1, 2010, and a renewal letter was already mailed to the permittee on October 21, 2009. Failure to
renew by this date may result in civil penalty assessments. Finally, if you achieve 100% reuse in the
future with no further need for an NPDES discharge permit, you might want to evaluate conversion to
a DWQ recycle permit, which is issued by Aquifer Protection/Land Application Unit.
If any parts, measurement frequencies or sampling requirements contained in this modification are unacceptable to you,
you have the right to an adjudicatory hearing upon written request within thirty (30) days following receipt of this letter.
This request must be in the form of a written petition, conforming to Chapter 150B of the North Carolina General
Statutes, and filed with the Office of Administrative Hearings (6714 Mail Service Center, Raleigh, North Carolina 27699-
6714). Unless such demand is made, this decision shall be final and binding.
Please note that this permit is not transferable except after notice to the Division. The Division may require modification
or revocation and reissuance of the permit. This permit does not affect the legal requirements to obtain other permits
which may be required by the Division or permits required by the Division of Land Resources, the Coastal Area
Management Act or any other Federal or Local governmental permit that may be required. If you have any questions

All previous NPDES Permits issued to this facility, whether for operation or discharge are hereby revoked. As of this permit
issuance, any previously issued permit bearing this number is no longer effective. Therefore, the exclusive authority to
operate and discharge from this facility arises under the permit conditions, requirements, terms, and provisions included
herein.
Wachovia Bank, N.A. is hereby authorized to:
1. Discharge dewatering water from a project located at 500 Block of South Tryon Street,
Charlotte, Mecklenburg County.
2. After receiving an Authorization to Construct permit, re-route wastewater from The
Green at Wachovia (formerly permitted separately under NPDES permit NC0086886)
and construct and operate a 0.087 MGD combined groundwater treatment system.
3. Discharge from said treatment works at the location specified on the attached map into
an unnamed tributary to Little Sugar Creek, currently classified C waters in subbasin
03-08-34 of the Catawba River Basin.

During the period beginning on the effective date of the permit and lasting until expiration or receipt
of Engineer's Certificate for a combined discharge treatment system, the Permittee is authorized to

2. The grab sample for oil and grease should be skimmed from the surface in a quiescent zone, such as a holding
tank, if possible.
3. If lead is detected at 25 µg/L or lower during the first eight sampling events, lead monitoring is no longer
required and may be discontinued for the remainder of the permit term. If lead is detected at > 25.0 µg/L
during any of the first eight sampling events, lead monitoring must be continued for the remainder of the
permit term.
4. If this pollutant is not detected above method detection limits during the first eight sampling events, then
monitoring is no longer required and may be discontinued for the remainder of the permit term. If the
pollutant is detected during any of the first eight sampling events, monitoring must continue for the
remainder of the permit term.
5. Chronic Toxicity (Ceriodaphida) P/F at 90%; March, June, September, and December [see A. (3)].
There shall be no discharge of floating solids or foam visible in other than trace amounts.

. A. (3) CHRONIC TOXICITY PASS/FAIL PERMIT LIMIT (QUARTERLY)
The effluent discharge shall at no time exhibit observable inhibition of reproduction or significant mortality to Ceriodaphnia
dubia at an effluent concentration of 90%.
The permit holder shall perform at a minimum, uag rterlt monitoring using test procedures outlined in the "North Carolina
Ceriodaphnia Chronic Effluent Bioassay Procedure," Revised February 1998, or subsequent versions or "North Carolina Phase
II Chronic Whole Effluent Toxicity Test Procedure" (Revised -February 1998) or subsequent versions. The tests will be
performed during the months March, June, September, and December. Effluent sampling for this testing shall be performed
at the NPDES permitted final effluent discharge below all treatment processes.
If the test procedure performed as the first test of any single quarter results in a failure or ChV below the permit limit, then
multiple -concentration testing shall be performed at a minimum, in each of the two following months as described in "North
Carolina Phase II Chronic Whole Effluent Toxicity Test Procedure" (Revised -February 1998) or subsequent versions.
The chronic value for multiple concentration tests will be determined using the geometric mean of the highest concentration
having no detectable impairment of reproduction or survival and the lowest concentration that does have a detectable
impairment of reproduction or survival. The definition of "detectable impairment," collection methods, exposure regimes,
and further statistical methods are specified in the "North Carolina Phase II Chronic Whole Effluent Toxicity Test Procedure"
(Revised -February 1998) or subsequent versions.
All toxicity testing results required as part of this permit condition will be entered on the Effluent Discharge Monitoring Form
(MR-1) for the months in which tests were performed, using the parameter code TGP3B for the pass/fail results and THP3B
for the Chronic Value. Additionally, DWQ Form AT-3 (original) is to be sent to the following address:

Completed Aquatic Toxicity Test Forms shall be filed with the Environmental Sciences Section no later than 30 days after the
end of the reporting period for which the report is made.
Test data shall be complete, accurate, include all supporting chemical/physical measurements and all concentration/response
data, and be certified by laboratory supervisor and ORC or approved designate signature. Total residual chlorine of the
effluent toxicity sample must be measured and reported if chlorine is employed for disinfection of the waste stream.
Should there be no discharge of flow from the facility during a month in which toxicity monitoring is required, the permittee
will complete the information located at the top of the aquatic toxicity (AT) test form indicating the facility name, permit
number, pipe number, county, and the month/year of the report with the notation of "No Flow" in the comment area of the
form. The report shaII be submitted to the Environmental Sciences Section at the address cited above.
Should the permittee fail to monitor during a month in which toxicity monitoring is required, monitoring will be required
during the following month.
Should any test data from this monitoring requirement or tests performed by the North Carolina Division of Water Quality
indicate potential impacts to the receiving stream, this permit may be re -opened and modified to include alternate monitoring
requirements -or limits.
If the Permittee monitors any pollutant more frequently then required by this permit, the results of such monitoring shall be
included in the calculation & reporting of the data submitted on the DMR & all AT Forms submitted.
NOTE: Failure to achieve test conditions as specified in the cited document, such as minimum control organism survival,
minimum control organism reproduction, and appropriate environmental controls, shall constitute an invalid test and will
require immediate follow-up testing to be completed no later than the last day of the month following the month of the initial
monitoring.

- A. (3) CHRONIC TOXICITY PASS/FAIL PERMIT LIMIT (QUARTERLY)
The effluent discharge shall at no time exhibit observable inhibition of reproduction or significant mortality to CoHodaphnia
dubia at an effluent concentration of 90%.
The permit holder shall perform at a minimum, quarterly monitoring using test procedures outlined in the "North Carolina
Ceriodaphnia Chronic Effluent Bioassay Procedure," Revised February 1998, or subsequent versions or "North Carolina Phase
II Chronic Whole Effluent Toxicity Test Procedure" (Revised -February 1998) or subsequent versions. The tests will be
performed during the months March, June, September, and December. Effluent sampling for this testing shall be performed
at the NPDES permitted final effluent discharge below all treatment processes.
If the test procedure performed as the first test of any single quarter results in a failure or ChV below the permit limit, then
multiple -concentration testing shall be performed at a minimum, in each of the two following months as described in "North
Carolina Phase II Chronic Whole Effluent Toxicity Test Procedure" (Revised -February 1998) or subsequent versions.
The chronic value for multiple concentration tests will be determined using the geometric mean of the highest concentration
having no detectable impairment of reproduction or survival and the lowest concentration that does have a detectable
impairment of reproduction or survival. The definition of "detectable impairment," collection methods, exposure regimes,
and further statistical methods are specified in the "North Carolina Phase II Chronic Whole Effluent Toxicity Test Procedure"
(Revised -February 1998) or subsequent versions.
All toxicity testing results required as part of this permit condition will be entered on the Effluent Discharge Monitoring Form
(MR-1) for the months in which tests were performed, using the parameter code TGP3B for the pass/fail results and THP3B
for the Chronic Value. Additionally, DWQ Form AT-3 (original) is to be sent to the following address:

Completed Aquatic Toxicity Test Forms shall be filed with the Environmental Sciences Section no later than 30 days after the
end of the reporting period for which the report is made.
Test data shall be complete, accurate, include all supporting chemical/physical measurements and all concentration/response
data, and be certified by laboratory supervisor and ORC or approved designate signature. Total residual chlorine of the
effluent toxicity sample must be measured and reported if chlorine is employed for disinfection of the waste stream.
Should there be no discharge of flow from the facility during a month in which toxicity monitoring is required, the permittee
will complete the information located at the top of the aquatic toxicity (AT) test form indicating the facility name, permit
number, pipe number, county, and the month/year of the report with the notation of "No Flow" in the comment area of the
form. The report shall be submitted to the Environmental Sciences Section at the address cited above.
Should the pernttee fail to monitor during a month in which toxicity monitoring is required, monitoring will be required
during the following month.
Should any test data from this monitoring requirement or tests performed by the North Carolina Division of Water Quality
indicate potential impacts to the receiving stream, this permit may be re -opened and modified to include alternate monitoring
requirements or limits.
If the Permittee monitors any pollutant more frequently then required by this permit, the results of such monitoring shall be
included in the calculation & reporting of the data submitted on the DMR & all AT Forms submitted.
NOTE: Failure to achieve test conditions as specified in the cited document, such as minimum control organism survival,
minimum control organism reproduction, and appropriate environmental controls, shall constitute an invalid test and will
require immediate follow-up testing to be completed no later than the last day of the month following the month of the initial
monitoring.

Roger- DWQ received your application for permit modification on 11/13/2009. Following a quick
review, I noticed a proposed RO treatment system, and left a phone message with you about
potential issues with an RO discharge to freshwater streams. Per our phone conversation today
and your subsequent email, it appears that you have an agreement with CMU to accept any RO
reject from this proposed project to their sanitary system. Consequently, DWQ will proceed
to modify the NCO088226 permit (Wachovia Tryon) to accept the reroute of wastewater from
NCO086886 (The Green at Wachovia). This will eliminate one discharge (NCO086886), and the
treated combined discharge from NCO088226 will be composed of non-RO wastewater. This permit
mod will need to be public noticed for 30-day public comment, and I indicated this will
require a permit modification fee of $260. Following this permit modification, you should
formally request rescission of permit NCO086886, so that annual fees and permit renewal
requirements are no longer in force for that discharge. Let me know if you have further

National Pollutant Discharge Effluent System (NPDES) permit number NCO088226 issued to
Wachovia Bank, N.A. Essentially, this modification is to incorporate the water presently being
discharged from the catty -corner property located at The Green at Wachovia under NPDES
permit number NCO086886 and incorporating a water treatment system designed by Aquapura,
Inc. that utilizes the water for on -site needs such as in cooling towers thereby lowering the
amount of municipal water required. When the site building is fully occupied and operational,
the system is designed to use up to 100% of the treated groundwater captured from the both
sites and little to no discharge to the outfall is expected. However, in the short term it is
anticipated that there will be excess water which will require intermittent discharge of the outfall.
Attached to this document is a completed NPDES Permit Application — Short Form C — GW for
the revised permit and various supporting documents and figures. The following sections
summarize the current site groundwater system (at Wachovia and The Green at Wachovia), the
— existing NPDES permits, and the modified permit requested.
Please note that the building is nearly completed and the startup of the new water system is
essentially waiting on the approval of this permit modification. Therefore, representatives of
Wachovia, ECS, NCDENR Division of Water Quality from the Mooresville Regional Office, and
Mecklenburg County have conducted site meetings, discussions and site walk through visits in
an attempt to expedite the approval of this modification. As such, the various representatives
are available to meet with NCDENR Raleigh permitting personnel to further assist in expediting
the permit approval. Please feel free to contact ECS to schedule a meeting at your earliest

BACKGROUND INFORMATION
The subject site is the Wachovia tower and subgrade parking deck at 550 South Tryon Street,
also known as WCC or First Street Development (soon to be known as the Duke Energy
Center, or DEC) currently undergoing construction located at the 500 block of South Tryon
Street in Charlotte, Mecklenburg County, North Carolina. The Wachovia tower and parking
deck site is bound by Church Street to the northwest, 1st Street to the northeast, Stonewall
Street to the southwest and South Tyron Street. Currently, the site is operating under NPDES
permit No. NCO088226 and discharging groundwater to a storm sewer located in South Tryon
PW Street. The storm sewer ultimately discharges to Little Sugar Creek, a Class C surface water in
the Catawba River Basin. Figures 1 and 2 indicate the location of this site and outfall location.
A catty -corner property located at 401 South Tryon Street in Charlotte, Mecklenburg County,
ma North Carolina (known as The Green at Wachovia) is occupied by an active subgrade parking
deck, discharges treated groundwater to the storm sewer system under NPDES permit No.
NC0086886. This permit authorizes the discharge of treated groundwater to the storm sewer
em system which also ultimately discharges to Little Sugar Creek. Figures 1 and 2 indicate the
location of this site.
® During design of the Wachovia tower it became apparent that when the building is fully
operational, large volumes of water would be required for non -potable purposes. Therefore, in
and effort to reduce the volume of municipal supplied water required to operate the tower, and
in an environmentally sustainable response, Wachovia elected to capture and reuse water
(groundwater from dewatering of the subgrade site structure and rainwater from Wachovia
tower roof drains) from the site. Wachovia will treat the water and use it for the non -potable
building needs. Depending upon the volume of water required for site use and the amount of
site water captured, there may be intermittent discharge of the water to the storm sewer. Since
the current NPDES site permit was designed and approved for the capture and discharge of the
site water during construction and prior to building operation (i.e., without water capture and
reuse), a modification to this permit is required for the future operation of the site system.
Additionally, when the site building is fully operational, it is anticipated that additional water will
_ Y be required to meet the non -potable demands. Therefore, as part of this permit modification
request, Wachovia is also requesting to incorporate the water captured from the catty -corner
subgrade parking from The Green at Wachovia.
The following sections describe the current systems and the new system design to support the
permit modification request in order to discharge treated water that can not be used onsite.
Included in Appendix A of this document is a completed NPDES Permit Application — Short
Form C — GW for the permit modification. Since the current design and building use
expectations are to intermittently discharge excess treated water for the life of the building, it is
expected that discharge to surface water will be conducted for an indefinite time period and
therefore the modified NPDES permit will be required for an unknown time period.
EXISTING SYSTEMS
As previously stated, there are two existing groundwater discharge systems that are anticipated
to be combined for this modified permit. The following generally describe these two existing
systems.

Wachovia
In order to prevent the flooding of groundwater into the subgrade parking levels beneath the
Wachovia tower, dewatering takes place beneath the lowest levels of the subgrade parking.
The system collects groundwater beneath the site via a subslab french drain systems located
below the bottom level of the subgrade building parking level at an approximate depth of 80 to
100 feet below grade. The captured groundwater is piped to a holding tank where various floor
drains from within the subgrade parking levels and various roof drains of the site building are
also collected. When the level within the holding tank rises to a predetermined depth, a float
switch triggers a pump within the tank to pump the water through piping within the subgrade
parking deck and out to the storm sewer manhole located within South Tryon Street where it is
discharged.
FM In accordance with the current NPDES permit, the Wachovia system does not currently include
treatment of the water prior to discharge. However, the permit does require that the discharge
be monitored, sampled, and reported. Additionally, a monthly Direct Monitoring Report (DMR)
® is required to be submitted to the North Carolina Department of Environment and Natural
Resources, Division of Water Quality (NCDENR, DWQ). The DMR requires the monthly
monitoring, including the collection of grab effluent samples for laboratory analysis, and
reporting of:

Flow;
➢
Total Suspended Solids (TSS);
➢
Oil and Grease;
➢
Benzene, Toluene, Ethylbenzene, total Xylenes (BTEX);
➢
Methyl tert-butyl ether (MTBE);

total Lead;
➢
1,2-Dichloroethane (1,2-DCA);
➢
Naphthalene; and
➢
n-Butylbenzene.
Once per quarter, additional grab samples of the effluent are required to be collected and
submitted laboratory analysis for chronic toxicity with results submitted to the NCDENR. A copy
® of the current NPDES permit (NC0088226) is included in Appendix B and the most recent,
DMR and AT-1 reports for the month of September 2009 are included in Appendix C.
The Green at Wachovia
In order to prevent the flooding of groundwater into the subgrade parking levels of the parking
deck at The Green at Wachovia, dewatering takes place beneath the lowest levels of the
subgrade parking. The system collects groundwater beneath the site via a subslab french drain
systems located below the bottom level of the parking deck. The captured groundwater is piped
to a holding tank located within an equipment storage room in the bottom parking level, where it
is then pumped through a carbon filtration system prior to being discharged to the storm sewer.
In accordance with the current NPDES permit, The Green at Wachovia system does include
treatment of the water prior to discharge, via the carbon filtration system. The permit also

PROPOSED MODIFIED SYSTEM
As previously stated, the proposed modified system incorporates the water currently being
discharged from the Wachovia and The Green at Wachovia systems in order to supply the non -
potable water demand for the site building, once it is in full operation. However, there will be
times when there will be more water generated than will be required for use by the building.
Therefore, this permit modification is requested to allow the intermittent discharge of the excess
water from the modified system.
The new system will generally consist of three collection sumps located below the bottom level
of the Wachovia subgrade parking deck where the groundwater at the Wachovia and The Green
at Wachovia will collect. Water within the sumps are then routed to a 2,500 gallon mixing tank
of the Aquapura system, which begins the water treatment, prior to being pumped into one of
several subgrade holding tanks, where the treated water will remain until needed as part of the
non -potable use of the building. The non -potable water use consists of makeup water for the
cooling towers located upon the top of the Wachovia building. Figure 3. is'a site plan showing
the generalized modified system, including the current and potential future location of the flow
meter, and the effluent sampling location.
The Aquapura system is designed to handle 87,840 gallons per day (gpd) of groundwater, but it
is only estimated to collect and treat approximately 69,840 gpd. Of this treated amount, 9 °o ?
an (approximately 66,348 gpd) will be used in the cooling towers, with the remaining 5% ,492
gpd) potentially being discharged to the storm sewer via the NPDES permit.
® Aquapura System
The Aquapua treatment system is situated within a separate room within the base level of the
subgrade parking deck of the Wachovia tower. The major components of the system generally
consist of the following:
➢ Chlorine dosing tank (to limit bacterial growth);
➢ Air stripper (to remove volatile organics);

Zeolite media filter;
➢
Anti -scaling dosing system;
➢
Sodium Metabisulfate dosing system;
➢
Ultra -filtration system;
➢
Reverse osmosis (RO) systems; and
➢
Permeate storage tanks.
The chemicals introduced within the system include liquid dechlorination agent (liquid sodium
hypochlorite 12%); antiscalant/antifoulant; and liquid sodium bisulfate. Although these
chemicals are being added at various locations within the treatment system, they will be
removed prior to exiting the system and/or will not be included in the effluent discharged to the
storm sewer. Appendix F includes copies of the MSDSs for chemical additives to be used in
the Aquapura treatment system.
According to calculations conducted by Tempest Environmental Systems, Inc., designer of the
Aquapura treatment system, the system is designed to treat and pump up to 61 gallons per
minute of water with removal rates of up to 99.9% of the volatile organic compounds (VOCs).
Figure 4 is a generalized diagram of the Aquapura treatment system.
SUMMARY AND CLOSING
Wachovia is requesting a permit modification to existing permit number NC0088226 to
incorporate not only the existing water from the Wachovia tower site located at the 500 Block of
South Tryon Street, but to also accept the groundwater currently being discharged from the
catty -corner property known as The Green at Wachovia, under existing permit number
NC0086886. Additionally, the permit modification is requested in order to accept excess water
after treatment via a new water treatment system being installed at the site that will allow the
reuse of up to 95% of the water generated from the two sites.
The information and figures within this document are generalized in order to simplify the
4M understanding of the permit modification request. However, should more detailed figures and
information be required, they can be provided to the NCDENR, upon request. Additionally, as
stated in the opening cover letter, the various representatives of Wachovia, ECS, and Tempest
FMO Environmental, Inc. are available to meet with NCDENR Raleigh personnel to further assist in
review of the modification request information and to expedite the permit approval process.
