Issuance of NPDES Permit NCO086070 NC Justice Academy WWTP Henderson County Dear Mr. Irwin: Division personnel have reviewed and approved your application for renewal of the subject permit. Accordingly, we are forwarding the attached NPDES discharge permit. This permit is issued pursuant to the requirements of North Carolina General Statute 143-215.1 and the Memorandum of Agreement between North Carolina and the U.S. Environmental Protection Agency dated May 9, 1994 (or as subsequently amended). This permit includes typo errors which have been corrected from the draft permit sent to the County on October 13, 2005. The corrected typo errors consist of correcting the receiving stream to Lewis Creek on the facility map and Effluent page changes to include, changing the Daily Maximum limit for NH3 as N to a Weekly Average Limit, adding the #2 footnote reflecting the 85% removal rate and adding Influent sampling for BOD and TSS to formulate that 85% removal rate. If any parts, measurement frequencies or sampling requirements contained in this permit are unacceptable to you, you have the right to an adjudicatory hearing upon written request within thirty (30) days following receipt of this letter. This request must be in the form of a written petition, conforming to Chapter 150E of the North Carolina General Statutes, and filed with the Office of Administrative Hearings (6714 Mail Service Center, Raleigh, North Carolina 27699-6714). Unless such demand is made, this decision shall be final and binding. Please note that this permit is not transferable except after notice to the Division. The Division may require modification or revocation and reissuance of the permit. This permit does not affect the legal requirements to obtain other permits which may be required by the Division of Water Quality or permits required by the Division of Land Resources, the Coastal Area Management Act or any other Federal or Local governmental permit that may be required. General information: Facility System Name: NC Justice Academy WWTP Responsible Entity: James Erwin Jr. Person in Charge: James Erwin Jr. Applicable Permit: NPDES # NCO086070 Sludge management plan: This facility builds sludge slowly, due to the low influent flow( averages 4000 gallons per day). As the need for sludge removal becomes apparent it will be wasted to the digester where it will be stored and thickened for cost effective hauling. As we build more information or the flow increases at this facility it may become necessary to increase the frequency in hauling. Sludge removal will be by truck by Mike's Septic, (828-253-2612) a local pump truck contractor. He will haul the sludge to disposal at the Town of Brevard or the City of Hendersonville waste treatment facility. All associated costs of this hauling will be paid by Henderson County Utilities Department Removal and management of this sludge will be done in a timely manner and in the best interests of facility operation and the environment. No sludge has been removed from this facility from start up until June 2003( 3000 gallons removed). Another 1000 gallons was removed in July 2003, the remainder of the load (1500 Gallons was pumped out of the influent lift station for clean up. No sludge has been removed August 2003 to March 2005. Notification: This report will be delivered to Henderson County Utilities Department to the attention of: Mr. James Erwin Jr. Conclusion: The NC Justice Academy waste treatment facility is well designed for the existing flow and is a pleasure to operate. Everyone involved at the Henderson County Utilities Department should be commended for the care and management of this facility and the envirorunent.
