Division personnel have reviewed and approved your application for issuance of the subject permit.
Accordingly, we are forwarding the attached NPDES discharge permit. This permit is issued pursuant to the
requirements of North Carolina General Statute 143-215.1 and the Memorandum of Agreement between North
Carolina and the U.S. Environmental Protection Agency dated October 15, 2007 (or as subsequently amended).
There are the following changes in this final permit from your current permit:
• A new Monthly Average and Daily Max limit has been added for Lead on page A.(L). Monitoring remains
as monthly, which is a change from the draft renewal recently sent to you for review. The new limit is due
to an EPA required statistical review of your discharge data.
• Monitoring for Total Copper and Total Zinc has changed to Quarterly from Monthly in accordance with
our WTP Permitting Strategy.
• Monitoring is removed for Total Iron and Manganese in accordance with our WTP Permitting strategy.
• Monitoring for turbidity has been added in accordance with our WTP Permitting Strategy.
• Instream monitoring (upstream and downstream) has been removed for pH, Temperature, Salinity,
Conductivity, and Dissolved Oxygen. The discharge to a dry ditch makes instream monitoring not
effective at determining impacts on aquatic life.
• Monitoring for Nutrients ('IN and TP) has been changed to Quarterly from Monthly in accordance with our
WTP Permitting Strategy.

If any parts, measurement frequencies or sampling requirements contained in this permit are unacceptable
to you, you have the right to an adjudicatory hearing upon written request within thirty (30) days following receipt
of this letter. This request must be in the form of a written petition, conforming to Chapter 150B of the North
Carolina General Statutes, and filed with the Office of Administrative Hearings (6714 Mail Service Center,
Raleigh, North Carolina 27699-6714). Unless such demand is made, this decision shall be final and binding.
Please note that this permit is not transferable except after notice to the Division. The Division may
require modification or revocation and reissuance of the permit. This permit does not affect the legal requirements
to obtain other permits which may be required by the Division of Water Quality or permits required by the Division
of Land Resources, the Coastal Area Management Act or any other Federal or Local governmental permit that may
be required.

All previous NPDES Permits issued to this facility, whether for operation or discharge are hereby revoked, and as of this
issuance, any previously issued permit bearing this number is no longer effective. Therefore, the exclusive authority to
operate and discharge from this facility arises under the permit conditions, requirements, terms, and provisions included
herein.

1. Continue to operate a drinking water treatment plant with a discharge of filter backwash and

Footnotes:
1. The Division shall consider all effluent TRC values reported below 50 µg/L to be in compliance with the permit.
However, the Permittee shall continue to record and submit all values reported by a North Carolina certified laboratory
(including field certified), even if these values fall below 50 µg/L.
2. The pH shall not be less than 6.8 standard units nor greater than 8.5 standard units.
3. TN = TKN + NO3-N + NO2-N, where TN is Total Nitrogen, TKN is Total Kjeldahl Nitrogen, and NO3-N + NO2-N are
Nitrate and Nitrite Nitrogen, respectively.
4. Acute 24-hour Pass/ Fail Mysid Shrimp at 90%; March, June, September and December; refer to Special Condition A (2).
All samples collected should be from a representative discharge event.
There shall be no discharge of floating solids or visible foam in other than trace amounts.
A. (2.) ACUTE TOXICITY MONITORING (QUARTERLY)
The permittee shall conduct acute toxicity tests on a guarterlX basis using protocols defined in the North
Carolina Procedure Document entitled "Pass/Fail Methodology For Determining Acute Toxicity In A Single
Effluent Concentration" (Revised -July, 1992 or subsequent versions). The monitoring shall be performed as a
Mysid Shrimp (Mysidopsis Bahia) 24 hour static test. The effluent concentration at which there may be at no
time significant acute mortality is 90% (defined as treatment two in the procedure document). Effluent samples
for self -monitoring purposes must be obtained during representative effluent discharge below all waste
treatment. The tests will be performed during the months of March, June, September, and December.
All toxicity testing results required as part of this permit condition will be entered on the Effluent Discharge
Monitoring Form (MR-1) for the month in which it was performed, using the parameter code TGE3E.

Completed Aquatic Toxicity Test Forms shall be filed with the Environmental Sciences Section no later than 30
days after the end of the reporting period for which the report is made.
Test data shall be complete and accurate and include all supporting chemical/physical measurements performed
in association with the toxicity tests, as well as all dose/response data. Total residual chlorine of the effluent
toxicity sample must be measured and reported if chlorine is employed for disinfection of the waste stream.
Should there be no discharge of flow from the facility during a month in which toxicity monitoring is required,
the permittee will complete the information located at the top of the aquatic toxicity (AT) test form indicating
the facility name, permit number, pipe number, county, and the month/year of the report with the notation of
"No Flow" in the comment area of the form. The report shall be submitted to the Environmental Sciences
Section at the address cited above.
Should the permittee fail to monitor during a month in which toxicity monitoring is required, then monthly
monitoring will begin immediately. Upon submission of a valid test, this monthly test requirement will revert
to quarterly in the months specified above.
Should any test data from either these monitoring requirements or tests performed by the North Carolina
Division of Water Quality indicate potential impacts to the receiving stream, this permit may be re -opened and
modified to include alternate monitoring requirements or limits.
If the Permittee monitors any pollutant more frequently then required by this permit, the results of such
monitoring shall be included in the calculation & reporting of the data submitted on the DMR & all AT Forms
submitted.
NOTE: Failure to achieve test conditions as specified in the cited document, such as minimum control
organism survival and appropriate environmental controls, shall constitute an invalid test and will require
immediate follow-up testing to be completed no later than the last day of the month following the month of the
initial monitoring.

TOXICITY TESTING
Current Requirement: Acute toxicity testing at 90% P/F.
Recommended Requirement: Quarterly Acute Toxicity monitoring at 90% in accordance with the
WTP Permitting Strategy. The facility failed one quarterly TOX test in October 2007, one each
in January and September 2010 but has passed nine Quarterly tests.

monitoring (upstream and downstream) has been removed for pH, Temperature, Salinity,
Conductivity, and Dissolved Oxygen. The discharge to a dry ditch makes instream
monitoring not effective at determining impacts on aquatic life.
COMPLIANCE SUMMARY
A Compliance Report dated 3/ 17/ 2010 states that the facility had just been completely
renovated, and was in like new condition. There was one NOV during the time period reviewed,
for flow. Flow is no longer limited on WTP permits.
Reasonable Potential Analysis A)
An EPA required statistical review of discharge data was performed for copper, lead and zinc.
Copper and zinc are both action level parameters; monitoring will be changed to quarterly in
conjunction with Tox. testing with no limit. Lead will be given limits; monitoring will remain at
1/ month.
PROPOSED CHANGES
Oxygen. . After discussions with the ORC and Al Hodge of
the Washington Regional Office, it was apparent that instream monitoring is not recommended,
as the receiving stream is basically a dry ditch, with no normal flow. There is no "upstream" to
sample, and the downstream should be effluent unless it is raining hard. This change should be
considered to be correcting a technical error, which is a minor modification that does not
require public notice.
Permit limits for Lead will be added as 25 µg/ L Monthly Average, and 221 µg/ L Daily
Maximum; monitoring will remain at 1/ month. Monitoring for Copper and Zinc will be
changed to quarterly in conjunction with the WET test. Monitoring for Iron and Manganese
will be removed as there are no NC Criteria for salt water.
Monitoring for nutrients (TN and TP) was changed to quarterly from monthly in accordance
with the WTP permitting strategy.

Dear Sir or Madam:
I have received. and reviewed the above draft NPDES permits for the Pamlico County
Water System. These permits are for the discharge of backwash water from filters and
softeners from the County's four water treatment plants.
I respectfully make the following comments and request:
1. Total Lead: Three of the four permits have the monitoring frequency for total lead
2/month with'the sample type being composite (Kershaw WTP NCO088331 is
only to be done 1/month). Due to financial reasons and the time involved doing
composite samples, we were hoping that composite samples could be done once a
month at each WTP to satisfy all the permit requirements. Reducing composite
samples from 2/month to 1/month would save the staff valuable time each month
collecting samples and that time could be used elsewhere in the system.
Therefore, we request that Grantsboro, Millpond, and Vandemere WTP
requirements for Total Lead be changed to l /month composite or 2/month grab.
2. Up Stream/Down Stream monitoring: We currently contract with a certified lab
to come on site to test for characteristics which, due to holding time requirements,
cannot be sent to a lab to be tested. We currently schedule our lab to visit each of
the four sites monthly to test for these characteristics. It normally takes several
hours to test at each site and travel to the next. Under the new draft permit, we
will be doing field samples a 3 different locations at each WTP. Not only will this
increase cost, but it add additional time requirements for our staff. Therefore, we
request that the sample location for these characteristics remain at the effluent, and
waive the additional requirement of upstream and downstream.
Pamlico County Water System will continue to work with your Division to meet
monitoring requirements under this new permit as we did with our previous permit. If

Please find enclosed one signed original and two copies of the completed application
for renewal of the Millpond WTP NPDES permit. Our current permit NCO088340
expires June 30, 2009.
Please note that all the discharge under the current permit is generated from this water
treatment plant. The backwash water produced comes from 2 iron filters and 2 water
softeners.
There have been no changes in treatment since the issuance of the current permit.
Please note as of February 1, 2009 the dechlorination of the backwash water in order to
meet the total chlorine residual limit will begin. Sulfur dioxide gas will be used in this
process.
Since the backwash water does not produce any solids or sludge, Pamlico County
Water System does not have a sludge management plan or a solids handling plan.
