Also, it appears that the buffer impacts proposed (131: 1,013 SF Zone 1 & 678 SF Zone 2) fall under the Neuse Table of
Uses as Deemed Allowable — 15A NCAC 02B .0714 (11)(kk)(i) "Perpendicular crossing with construction corridor of 40 LF
and permanent maintenance easement of 30 LF or less". Therefore, no buffer authorization is required for this impact
as long as all conditions are met. Please confirm that impact B1 will meet these criteria.

I am finishing up my review of the application for Raleigh Road Sewer Outfall (DWR#20231626) and I have
some additional questions before I can proceed.
March 14th comments. See attached
1. Thank you for confirming the wetland impact totals from Emily's email. Thank you
2. Is S2 being impacted - either temporarily or permanent? Boring this location It is
difficult to determine on the impact maps if the trench area is impacting this
feature. Please confirm. Please see the attached site plan for S2. They are going to
bore this location.
3. 1 appear to be missing the original attachment packet in the LF folder. I was able to
find the attached document packet from a previous email chain —was this packet
submitted as part of the 11/27/23 application submission. Let me know if you

I appreciate you sending the revised maps — I looked at the plan drawings and want to make
sure I understand everything by summarizing the proposed impacts.

To calculate the total conversion impacts, we would subtract the permanent fill impacts:
3,296 SF — 20 SF = 3,276 SF
5,040 — 36 SF = 5,004 SF

The fill impacts would require 2.1, so that would equal 112 SF; therefore, total compensatory
mitigation would be for 8,392 SF (0.193-acre).
With the back and forth/plan revisions, will you please confirm this information is accurate,
specifically the impacts?

I'm not seeing the color shaded and/or hatched impacts on the project drawings — the impacts should also be
shown in a legend or somewhere on the page so that I can ensure the impacts are accurate (separating
wetland loss vs. conversion). The piers are considered a loss if those are what holds the aerial pipe in the
wetlands. With looking at the aerial, what does "trenched" mean (0.0761-acre) — I thought this project had
conversion and impacts and some loss for what is called the "piers"?

Hi Adam,
Thank you for the quick response. I believe you may be referring to the Wilmington District Regional
Condition 0.02-acre threshold for stream bed loss, but the forested wetland conversion thresholds are
described in #10 Utility Lines (attached):
d. Any permanently maintained corridor along the utility right of way within forested wetlands shall be
considered a loss of aquatic function. A compensatory mitigation plan will be required for all such impacts
associated with the requested activity if the activity requires a PCN and the cumulative total of permanent
conversion of forested wetlands exceeds 0.1 acres, unless the District Engineer determines in writing that
either some other form of mitigation would be more environmentally appropriate or the adverse effects of the
proposed activity are minimal.
Where permanently maintained corridor within forested wetlands is 0.1 acres or less, the District Engineer
may determine, on a case -by -case basis, that compensatory mitigation is required to ensure that the activity
results in minimal adverse effects on the aquatic environment.
You may be aware, but the hierarchy is private banks and then DMS — please let me know if you have any
questions about compensatory mitigation.
I've cc'd Zach Thomas (DWR), so he's aware that the application is considered incomplete by the Corps until
a mitigation plan is provided. Zach, please let me know if you have questions about this project as well.

Yes, ariel crossing. The NW 58 had us less than 2/10ths to avoid mitigation. I can squire
wetland credits pretty quick. Sorry for any confusion.

lines in a while, is the overall purpose of this to reduce impacts to aquatic resources or is this a better
installation method for other reasons? I also see no mitigation plan included in the PCN for the permanently

Wilmington District typically requires mitigation at a 1:1 ratio for conversion impacts greater than 0.1-acre.
