I believe you may be referring to the Wilmington District Regional Condition 0.02-acre threshold for stream bed loss, but the forested wetland conversion thresholds are described in #10 Utility Lines (attached): d. Any permanently maintained corridor along the utility right of way within forested wetlands shall be considered a loss of aquatic function. A compensatory mitigation plan will be required for all such impacts associated with the requested activity if the activity requires a PCN and the cumulative total of permanent conversion of forested wetlands exceeds 0.1 acres, unless the District Engineer determines in writing that either some other form of mitigation would be more environmentally appropriate or the adverse effects of the proposed activity are minimal. Where permanently maintained corridor within forested wetlands is 0.1 acres or less, the District Engineer may determine, on a case -by -case basis, that compensatory mitigation is required to ensure that the activity results in minimal adverse effects on the aquatic environment. You may be aware, but the hierarchy is private banks and then DMS — please let me know if you have any questions about compensatory mitigation. I've cc'd Zach Thomas (DWR), so he's aware that the application is considered incomplete by the Corps until a mitigation plan is provided. The NW 58 had us less than 2/10ths to avoid mitigation. I can aquire wetland credits pretty quick. Sorry for any confusion. I haven't seen elevated sewer lines in a while, is the overall purpose of this to reduce impacts to aquatic resources or is this a better installation method for other reasons? I also see no mitigation plan included in the PCN for the permanently maintained corridor through forested wetlands (associated with a regulated discharge of fill material). The Wilmington District typically requires mitigation at a 1:1 ratio for conversion impacts greater than 0.1-acre. Please provide a mitigation plan for these impacts.
