Responses to your comments are addressed below: 1. Correct,since the project has not yet been built we are submitting the Division's low density residential subdivision deed restrictions&protective covenants form. We will eventually pursue a permit modification once the permit has been transferred. Until that time,the deed restrictions form is being submitted based on the Lot count and BUA distribution as currently permitted. The successor-owner of the property has requested to transfer the permit without consent of the permit holder in accordance with 15A NCAC 02H.1045(1)(c)and G.S. 143-214.7(c5). A preliminary in-depth review of the documentation submitted with the transfer request determined that the application is incomplete and that additional information is needed. Since the transfer was submitted under 15A NCAC 02H.1045(1)(c)and G.S. 143-214.7(c5), please provide the following documentation in a single,hard copy submittal package to complete the application: 1. 15A NCAC 02H.1045(2)(e): a. The following was requested as item 2 in the Additional Information Request dated August 15, 2023: i. Please provide the recorded deed restrictions and protective covenants limiting the maximum allowed built-upon area for the lots with original signatures. ii. Since the project has not been built,please provide a signed agreement to submit the final recorded deed restrictions and protective covenants. Examples of a signed agreement and proposed language is available on the Division website at: https://deq.nc..gov/about/divisions/energy-mineral-land-resources/energy-mineral-land- rules/stormwater-program/post-construction b. Clarification? Thank you for submitting the deed restrictions form on September l 5,2023. However,the impervious area per lot values listed on that form would set the impervious area as 3,285 square feet for each lot. The impervious area per lot values in the current permit are listed in Attachment A included below. A permit transfer application only changes the ownership of the permit. If changes to the impervious area per lot are needed,that would require a permit modification. Please provide signed and notarized deed restrictions indicating that the impervious area per lot will be as listed in Attachment A. Otherwise,please also apply for a permit modification revising the values to 3,285 square feet for each lot. All of the requested information listed above should be received in this Office by January 8,2024 in accordance with 15A NCAC 02H.1045(4)(a)(i). Please note that only two letters requesting additional information is allowed in the State Stormwater Program, this being the second. If the requited information is not satisfactorily provided by this date,the project will be returned in accordance with 15A NCAC 02H.1045(4)(a)(ii). Deed Restrictions: When you asked me if a deed restrictions form needed a list of lot numbers yesterday or if they could have a single value written on the form, I did not realize that there would be a BUA/lot change associated with a permit transfer. I thought it was a general question about whether or not they needed the list of lots attached to the form. None of the permitted elements should change for a transfer. The current SW8 091210 permit does not have the same BUA per lot for all lots, and those same values should go forward with the permit transfer. If they want to go from having lots at a varying BUA/lot to having all lots at the same BUA/Iot then that is a modification. They need to submit the deed restrictions form signed by the incoming permittee indicating they will transfer the permit as-is, listing the current BUA/lot that is written in the current permit. Then at a later date they can apply for a modification to change the BUA/lot allocation. (FYi,sometimes we do a minor modification with a permit transfer in one letter with both forms. in those cases it is so the outgoing permittee can achieve compliance which requires a modification prior to transferring the permit to the incoming permittee. In those cases the outgoing permittee signs the modification form and it is processed ahead of the permit transfer. We give them a "quick modification"because it is part of achieving compliance. Here, the transfer form is only signed by the incoming permittee. That entity will have to sign the modification form. I do not recommend the "quick modification"here because it is not necessary to get the permit in compliance and transferred. That would be hurrying them through the modification review process.) 2. Inspection: When i first saw that there were two BIMS reports for this I thought it was because there were to inspection events. After we talked, it turns out that one of them was a draft that did not get deleted. I recommend deleting the original draft May BIMS report and renaming the one that was re-written in August as 2023 05 CEI_BIMS 091210. The CAMA narrative states that the owners hope to pursue further residential development of the site,but may need to modify project plans to make the project economically feasible.They are optimistic that the subdivision will be built,but it is not known how, or if, any changes to the current plan will be needed. It is possible(probable)that no changes will be made to project plans.It is impractical at this point to modify the stormwater permit when we do not know the final form of the subdivision.We have been forthcoming with our intentions to only construct stormwater—approved features(upon CAMA authorization)and in no way intended to confuse or mislead agency reviewers.I emphasize that the owners have delayed,not abandoned,plans to develop a subdivision. Per the CAMA permit application, if the piers are constructed prior to the subdivision, a section of the roadway authorized by SW8 091210 will also be constructed at that time to allow for access and parking. Attached is a drawing that indicates the section of the stormwater-permitted roadway to be constructed (highlighted in yellow)and areas of the road to be used for parking(red on drawing).Construction of the road section will not require any reallocation of built-upon-area(BUA)as authorized by SW8 091210. The drawing is also being provided to the Division of Coastal Management, since the roadway section must be constructed simultaneously with the piers. That discrepancy has now been remedied.We have notified the Division of Coastal Management(DCM)that the walkway widths are reduced to 4',thus bringing the BUA for the pathways into consistency with the stormwater permit. What would be the point of having these 2 piers if there was nowhere to park your car to access and use them?Without the subdivision in place, access and parking are an issue. On page 5 of the narrative that M&M Land Development submitted, they say that if the piers are constructed prior to development of the subdivision, then they will "rough in" sections of the permitted roads in order to provide access to parking for users of the dock. This would be high ground development and if added to the earthen paths, may disturb >1 acre total. By the way, DWQ considers the earthen paths as built-upon area. From my perspective, because we already have a stormwater permit for the now abandoned subdivision, and approved plans that are not being followed, I will be requiring the developer to submit a permit modification to add this particular scheme of development to the permit, or to replace the previously permitted plans with this scheme. They will also need to account for the BUA in the paths and show what roads will be built with this phase, and where those pier users will park their cars. Also, the only place that the width of the earthen path (6 feet) is mentioned is in the narrative. A multi agency meeting was conducted previously on 6/3/09 by Mr. Barry Guthrie (previous field rep for the Stella Area within Carteret County). 9. Narrative Description: The M & M Land Development, Inc project is located along Wetherington Landing Road, approximately 1,800' south of the Stella Bridge in Stella, Carteret County. Wetherington Landing Road is found by following NC Hwy 24 east from the Swansboro area over the existing Swansboro/Cedar Point Bridge. Follow until you reach the 4-way stoplight within Cape Carteret(EI to the right) and turn left onto NC 58 (North toward Stelia).Follow NC 58 for approximately 8.49 miles and turn left onto Stella Road. Follow Stella Road until it intersects Wetherington Landing Road then turn left. The property is located on the right approximately 1/4 of a mile(1,169'). This area of Stella is known for large bear population so all agencies should be aware and prepared due the current time of year(hibernation ending). The subject property is 138.7 acres (6,042,208 sf) in its entirety, has 7000' of shoreline on the White Oak River and averages 8' in elevation above NHW. Currently on the high ground portion of the site is an existing open field, dirt road,typical vegetation(grass) and native trees (pines etc.). Along the property(adjacent to the White Oak River) is densely populated with coastal and 404 jurisdictional wetlands that is approximately 320' x 1,500' in area and contains Juncus roemerianus (Black Needlerush).There are several canals (relic mosquito ditches that are a max width of 30')that were previously dredged through the coastal wetlands. The ditches are not navigable during nlw due to the shallow water depths but are navigable at high tide with kayaks and small john boats. There is a tidal creek along the eastern portion of the site that would not be impacted by this project. Field verification determined that the water depths along the White Oak River shoreline for proposed dock A are an average of-3.6' with connecting water depths ranging from-5' nlw inshore to -14'nlw offshore. Project Description: The applicant is proposing to build two 10-slip docking facilities, finger piers, platforms, boatlifts and two earthen pathways for the undeveloped tract.No other upland development is proposed at this time. A total of 7,500 ft2 of high ground would be graded,filled or disturbed during the process for the proposed earthen pathways (approximately 640' above nhw for path A and 30' above nhw(canal area) for path B). The impervious surface is .086%within the Coastal Shoreline AEC and 0%for the entire tract. The applicant previously obtained a Stormwater Management Permit(SW8 091210) and preliminary subdivision sketch approval from the Carteret County Technical Review Committee however no documentation was supplied with the major permit application due to the fact there are no other plans for high ground development due to the poor economy. A Sedimentation and Erosion Control Plan was not submitted to the Division of Land Resources due to the minimal land disturbance (<1 acre). The applicant is proposing to disturb 7,500 square feet of high ground with the placement of two earthen paths for the proposed docking facilities. All portions of the earthen pathways would be a minimum of 30' above nhw for path B and 640' above nhw for path A. Path A would be 3' above existing grade, 6' in width, 166' in length and would connect to pier A which is located on the northeast side of the property(near the existing railroad tracts). Path B would be 3' above existing grade, 6' in width, 709' in length and would connect to pier B which is located on the southeast side of the property. No parking is proposed in this application. The applicant is also proposing a 6' x 766' fixed pier and access (A) along the (northeast) White Oak River portion of the property. It would house 10 slips with 13' x 13' boatlifts, (6) 3' x 16' finger piers, one 8'x 24' platform and one 12' x 24' covered platform with an 12' x 12' unenclosed covered gazebo on the south east side of the platform located at the end of the pier. It would be 6' wide x 822' long and house two platforms ( one with a unenclosed covered gazebo), 6 finger piers, 10 slips with(10) 13' x13' boatlifts. Pier B would be 6' in width and extend over coastal and 404 jurisdictional wetlands for 84'. It would then cross over the existing manmade mosquito canal (30' wide) and would be elevated to a minimum height of 5' above nhw over the canal portion and a minimum of 3' above the marsh substrate. It would continue for 295' over coastal wetlands where at this point it would intersect an 8' x 24' observation platform. It would then continue for 287' over coastal wetlands until it reaches the edge of marsh.At this point it would extend over open water for a final 101' and connect with a 12' x 24' platform which would house a 12' x 12' unenclosed covered gazebo on the south east end. All slips would be located on the landward side of the platform with slips 1-5 located on the west side of the pier and slips 6-10 located on the east side. Slips 1-5 would contain (3) 3' x 16' finger piers and (5) 13' x 13' boatlifts with slips 6-10 consisting of the same design(3) 3' x 16' finger piers and(5) 13' x 13' boatlifts. The water depths for pier B are an average of-7.25' nlw with connecting water depths from -5'nlw nearshore and-16' nlw offshore. The pier and platform would not extend farther than 113' from the edge of marsh into a 667' wide water body. 11. Anticipated Impacts: This proposed installation of the dock and pilings would result in temporary turbidity during installation. The pier placement would shade 1,698 ft2 of shallow bottom habitat for pier A and 180 ft2 of shallow bottom habitat for pier B while incorporating 3,910 square feet for pier A and 180 square feet for pier B of this same habitat. Pier B would shade a total of 1,170 square feet of deep bottom habitat while incorporating 4,254 square feet Estuarine and Public Trust Waters.A total of 4,374 square feet of coastal and 404 jurisdictional wetlands would be shaded as well. The platforms located over the wetland areas have the potential to cause greater shading impacts due to the 8' width(min. 6' allowed over coastal wetlands).The high ground work would fill a total of 7,500 ft2 of the property with 312 ft2 of fill/disturbance occurring within the 75' AEC. The impervious surface would be .086% within the Estuarine Shoreline AEC and 0%for the entire tract. There should be no impacts to shallow bottom from dock A due to the fact that the water depths within this area are an average of-3.6' nlw. Each pier will transition to an elevated walkway to cross over wetlands and then connect to earthen walkways to connect to highground portions of the site. The structures are identified as Pier A and Pier B on project plans. The project consists of the two piers and associated walkways. There are no current plans to further develop the property. Prior to the current economic downturn the owners hoped to develop a single-family residential subdivision on the site.A sketch plan was reviewed by the Carteret County Technical Review Committee in November 2007 and the owners also received a low-density residential stormwater permit. However, due to the poor economy and the pessimistic outlook for new residential sales the owners have now abandoned their original plans. They hope to develop the site in the future, but at this point it is not known if or how a residential plan will be pursued. In the event they decide to go further with the project, any proposed development in the CAMA AECs will be addressed in a modification request for the major CAMA permit that may be issued for this proposal. Site Description The project site consists of± 138.71 acres of undeveloped land located adjacent the White Oak River in Stella.The Camp Lejeune to Cherry Point Railroad passes along the north of the property and is an adjacent riparian neighbor of the project site. The railroad property is owned by the United States of America, and is managed through Camp Lejeune Marine Corps Base. The project site is connected to Wetherington Landing Road (NCSR 1101) by a recorded right- of-way crossing and re-crossing agreement over the railroad property. The adjacent riparian property on the east is owned by First and Last Child, LLC and is utilized as a camp ground. Stella Bridge Landing Piers M and M Land Development,Inc. Major CAMA Permit Application March 2,2012 Page 1 The parcel contains extensive coastal and non-coastal wetlands, including a large peninsula- shaped a-ea of coastal wetlands located on the western portion of the site. The US Army Corps of Engineers approved the Section 404 wetland delineation of 28.02 acres on December 19, 2007 (copy enclosed with this application). Staff of the NC Division of Coastal Management provided assistance with the delineation of coastal wetlands and the locations of Normal High Water as shown on project plans. The shoreline of the property measures about 7,000 linear feet, including the wetland peninsula. Several canals were previously dredged through the coastal wetlands and are not navigable at normal low water, although some can be passed through at high tide.The site also contains a tidal creek that meanders along the eastern portion of the site. The creek is not impacted by this project. The White Oak River varies in width at the site. It is 506' wide at the location of Pier A (see plans) and 667' at Pier B, measured from the waterward edge of marsh. Existing normal low water depths in the river range from -1.0' near the shoreline of the main portion of the property to more than -15.0' in the center of the channel. Boat slips are located in a minimum of-3.0' NLW as requested by the Division of Marine Fisheries. Depths at the waterward end of Pier A measure-3.7' NLW. Depths at the waterward end of Pier B are-10' NLW. No submerged aquatic vegetation or shellfish were observed at the site. The White Oak River at the project site is classified as SA by the Environmental Management Commission. This portion of the river is also classified as a Primary Nursery Area by the Marine Fisheries Commission and is considered to be an Essential Fish Habitat. Project impacts to these resources will be minimal, with no dredging proposed. Boat slips will be located in a minimum of-3' NLW and will extend no more than one-fourth the width of the river. The bottom of the pier decking over wetlands will be elevated a minimum of 3' above the wetland substrate.The proposed piers will provide for wet dockage only; no marina services are included. Earthen walkways connecting to the piers are the only proposed upland development.The walkways have been located to avoid wetland areas and are outside the coastal shoreline AEC. There are no existing wastewater treatment facilities, drinking water supply•sources, stormwater management or treatment systems, or man-made structures on the site, other than the previously mentioned unpaved road.The large peninsula-shaped area of wetlands located on the western portion of the site will not be impacted by this project. Project Description The owners propose to construct two 10-slip fixed piers with associated elevated and earthen walkways. The elevated walkway sections will cross wetland areas and will transition to earthen paths or walkways to be constructed on the highground portion of the site. All components of the two piers will be fixed. Pier A measures 766' in length by 6'wide. The length measurement is based on 113' from the waterward end of the pier to normal high water plus 653' of elevated walkway over coastal and non-coastal wetlands. The proposed earthen path/walkway connecting to this pier measures an additional 166' and is 6'wide. Pier B measures 822' in length by 6'wide. Of this length, 101' extends from the waterward end to normal high water with an additional 721' of elevated walkway over wetlands. The proposed earthen path/walkway connecting to Pier B measures 709' x 6 '. Pier B will be elevated a minimum of 5' above NHW for a span of 6' at the canal crossing, as shown on Sheet 4 of project plans. (Pier A does not incorporate a canal crossing) The bottom of the decking over wetlands (both Pier A and Pier B)will be elevated a minimum of 3' above the wetland substrate. A t-head platform measuring 12' by 24' will be located at the waterward end of each proposed structure. A section of each t-head platform will contain a covered gazebo measuring 9' x 12' with a 16" overhang. The remaining area of the t-head platform will not be covered. An observation platform measuring 8' x 8' with 45'angled sides will be located in the section to be elevated over wetlands (see proposed pier plan view on sheet 4 of project plans). • The two piers will be located more than 1500' apart, as shown on project plans. Pier A will be located 150'from the adjacent riparian corridor and more than 800'from adjacent docking facilities (per Google Earth). As previously noted, each pier will contain 10 boat slips, for a total of 20 slips for the project. Boat lifts measuring 12.5' x 12.5' are proposed for each slip. Six finger piers measuring 16' x 3' are proposed for each pier,for a total of 12 finger piers. Cantilevered fish cleaning stations are proposed adjacent the t-head platforms and along the pier landward of the slips,for a total of two per pier or four total (see pier details on Sheet 4). Upland Development Proposed upland development is limited to the earthen walkways connecting to the elevated walkway sections of the two piers. All upland work will occur outside the CAMA AEC. The project will disturb approximately 7500 square feet, with .086 %of the entire tract being covered with impervious surfaces (compacted dirt walkways). No impervious surfaces are proposed for the coastal shoreline AEC. No parking is proposed for this project. Normal High Water. Construction Methods Dock construction in the river will employ conventional marine construction techniques using barge mounted equipment with pile driving capability. Walkway pilings over wetlands will be installed by portable pile-driving equipment. A small tractor for mowing and light grading will be used for construction of the earthen walkways. The barge will be stored in deep water. The portable pile-driving equipment and tractor will be stored onsite on highground. Summary The proposed project is limited to two 10-slip fixed piers in the White Oak River with elevated sections over wetlands, connecting to earthen highground walkways. Each pier will include two platforms—one at the waterward end of the structure and an observation platform over wetlands. Lifts are proposed for each boat slip. Project impacts will be minimal, with no dredging or other development proposed. Boat slips will be located in a minimum of-3' NLW and will extend no more than one-fourth the width of the river. Piers will be elevated a minimum of 5' above NHW for a span of 6' at the canal crossings. The bottom of the pier decking over wetlands will be elevated a minimum of 3' above the wetland substrate. The proposed piers will provide for wet dockage only; no services are included. Two earthen walkways (one for each pier) connecting to the piers are the only proposed upland development.The walkways have been located to avoid wetland areas. No impervious surfaces are proposed for the coastal shoreline AEC. This proposal will cover a very small percentage (< .1%) of the entire tract with impervious surfaces. The owners hope to eventually pursue further residential development of the site. At this time it is not known if, or how,future plans will be developed.
