HomeMy WebLinkAbout20160517 Ver 2_DCM Permit_20240703Permit Class MODIFICATION/MINOR Permit Number 47-87 STATE OF NORTH CAROLINA Department of Environmental Quality and Coastal Resources Commission er M t for X Major Development in an Area of Environmental Concern pursuant to NCGS 113A-118 X Excavation and/or filling pursuant to NCGS 113-229 Issued to NC State Ports Authority, PO Box 9002, Wilmington, NC 28402 Authorizing development in New Hanover County at Areas F-West and H-Yard at the Port of Wilmington , as requested in the permittee's letter dated 3/21/23, including the attached workplan drawings (9) Sheet 1-9 of 9 dated "received March 26, 2024" This permit, issued on July 3, 2024 , is subject to compliance with the application (where consistent with the permit), all applicable regulations, special conditions and notes set forth below. Any violation of these terms may be subject to fines, imprisonment or civil action; or may cause the permit to be null and void. Bulkhead Repair and Encasement 1) Unless specifically altered herein, this Minor Modification authorizes the concrete encasement of the existing bulkhead and replacement of an existing concrete access ramp, all as expressly and specifically set forth in the attached letter and workplan drawings. Any additional development activities may require a modification of this permit. [07J .0202(c); 07H .0209; G.S. 113-229(b)] 2) Live concrete shall not be allowed to contact waters of the State or waters that will enter waters of the State. In accordance with commitments made by the permittee, a coffer dam shall be placed waterward of the bulkhead prior to construction. [07H .0208(a)(2)(B)] (See attached sheet for additional conditions) This permit action may be appealed by the permittee or other qualified persons within twenty (20) days of the issuing date. This permit must be accessible on -site to Department personnel when the project is inspected for compliance. Any maintenance work or project modification not covered hereunder requires further Division approval. All work must cease when the permit expires on December 31, 2027 In issuing this permit, the State of North Carolina agrees that your project is consistent with the North Carolina Coastal Management Program. Signature of Permittee NC State Ports Authority ADDITIONAL CONDITIONS Permit No. 47-87 Page 2 of 3 3) The bulkhead encasement shall be constructed in accordance with the alignment depicted on the attached workplan drawings. [07H .0208(b)(7)(D)] 4) The bulkhead encasement shall be constructed prior to any backfilling activities. [07H .0208(b)(7)(C); 07H .0209 (d)(4)] 5) The bulkhead encasement shall be structurally tight so as to prevent seepage of backfill materials through the structure. [07H .0208(b)(7)(C); 07H .0209(d)(4)] 6) This permit does not authorize any excavation waterward of the approved alignment. [07H .0206] Upland Development outside AEC 7) Unless specifically altered herein, this permit authorizes the grading and other land disturbing activities associated with the development of the above referenced property, including the regrading and repaving of an existing 13.85 acres of asphalt pavement and replacement of hi -mast lighting, fire hydrants, and an existing stormwater system with no change to existing outfalls, all as expressly and specifically set forth in the attached permit application and workplan drawings. [07J .0202(c); 07H .0209(d)] Sedimentation and Erosion Control 8) In order to protect water quality, runoff from construction shall not visibly increase the amount of suspended sediments in adjacent waters. [07H .0209(d)(4); G.S. 113A-102(a); 07H .0207; 07H .0208] 9) Appropriate sedimentation and erosion control devices, measures or structures shall be implemented to ensure that eroded materials do not enter adjacent wetlands, watercourses or properties. [07H .0209(d)(4); G.S. 113A-102(a); 07H .0207; 07H .0208] General 10) The permittee and/or his or her contractor shall meet with a representative of the Division prior to project initiation. [07J .0209(a)] 11) All conditions and stipulations of the active permit remain in force unless specifically altered herein. [07J.0209(a)] NOTE: This Minor Modification shall be attached to the original Permit No. 47-87, which was issued to the permittee on 2/17/87, as well as all subsequent modifications, refinements, and renewals, and copies of all documents must be readily available on site when Division personnel inspect the project for compliance. NOTE: This permit does not eliminate the need to obtain any additional state, federal or local permits, approvals or authorizations that may be required.
