Sullins, Director Division of Water Quality December 18, 2007 DWQ Project # 2007-1998 Wake County CERTIFIED MAIL: RETURN RECEIPT REQUESTED Duke Construction Attn: Mr. Brian King 3005 Carrington Mill Blvd Morrisville, NC 27560 Subject Property: Hotel Sierra: The Market at Perimeter Park, Morrisville, NC Stirrup Iron Creek [030402, 27-33-4-2, C, NSW] REQUEST FOR MORE INFORMATION Dear Mr. King: On November 28, 2007, the Division of Water Quality (DWQ) received your application dated November 26, 2007 to impact 2,770 square feet (ftz) of Zone 1 protected riparian buffers and 730 square feet (ft2) of Zone 2 protected riparian buffers to construct the proposed commercial development at the above- referenced property. The DWQ has determined that your application was incomplete and/or provided inaccurate information as discussed below. The DWQ will require additional information in order to process your application to impact protected wetland, streams and/or buffers on the subject property. Therefore, unless we receive the additional information requested below, we will have to move toward denial of your application as required by 15A NCAC 2H .0506 and 2B .0233(8) and will place this project on hold as incomplete until we receive this additional information. Please provide the following information so that we may continue to review your project. Additional Information Requested: 1. You must provide documentation that the scour hole will provide diffuse flow with the present slopes. Per DWQ's BMP manual, your slopes must not exceed 4%. It appears from your plan sheet that the slopes do exceed 4%. 2. It appears that the proposed mulch path in Zones 1 & 2 of the protected riparian buffers can be moved or reconfigured to only impact Zone 2 of the protected riparian buffer. Please revise your plan sheet to reflect this. 3. The detention pond outlet will need to be removed from the buffer. Please reconfigure your plan sheet to reflect this change. Please respond within three weeks of the date of this letter by sending this information to me in writing and Lauren Witherspoon of the DWQ Raleigh Regional Office. If we do not hear from you within three weeks, we will assume that you no longer want to pursue this project and we will consider the project as withdrawn. This letter only addresses the application review and does not authorize any impacts to wetlands, waters or protected buffers.
