Please find a copy of the Preconstruction Notification for the above referenced
residence in Raleigh. The subjectivity of the stream located within the property is not in
question. The survey plat depicts the location of the existing structure with the steps
intruding into Zone 2 of the riparian buffer. The total impact is 54 square feet.
As per the site visit conducted on December 13, 2007, the new impact (stairs and
stringer) intrudes into Zone 2 of the buffer but is elevated above the protected zone. If

USACE - lh accordance with the Final Notice of Issuance and Modification of Nationwide
Permits, published in the Federal Register an January 15, 2002, mitigation will be required when
necessary to ensure that adverse effects to the aquatic environment are minimal. Factors
iincluding size and type of proposed impact and function and relative value of the impacted
aquatic resource will be considered in determining acceptability of appropriate and practicable
mitigation as proposed Examples of mitigation that maybe appropriate and practicable include,
but are not limited to: reducing the size of the project; establishing and maintaining wetland
andlor upland vegetated buffers to protect open waters such as streams; and replacing losses of
aquatic resource functions and values by creating, restoring, enhancing, or preserving similar
funcxions and vetoes, preferable in the same watershed,

for LJSACB or DWQ to consider the application complete for processing. Any application
lacking a required mitigation plan or NCEEP concurrence shall be placed on hold as incomplete.
