Dogtown Bank Parcel Credit Release — Task 2 (final) & Task 4
Dear Ms. McEachran:
On October 24, 2023, the Division of Water Resources (DWR) issued a partial (15%) credit release
for Task 2 with the remaining 5% to be issued when Environmental Banc & Exchange, LLC (EBX)
has confirmed in writing that all remedial actions in the Adaptive Management Plan are complete and
has provided photo documentation of the completion of all work performed.
On April 9, 2024, the Division of Water Resources (DWR) received a Year 1 Monitoring Report
from EBX for the Dogtown buffer Site. Overall, site conditions appear to look good, performance
standards for vegetation were met and no encroachment within the conservation easement areas was
noted. Documentation confirming that all remedial actions of the AMP had been fully implemented
was also included.
DWR received a performance bond (#9442942) issued to EBX from Fidelity and Deposit Company
of Maryland, in the amount of $100,000, to cover monitoring and maintenance at the subject site.
The term of this bond applies beginning April 8, 2024, and ends April 8, 2025. Future credit releases
will be dependent on both the renewal of this performance bond and the annual monitoring reports.
In accordance with the MBI, signed on September 30, 2020, the following Project Milestones have
been met and the corresponding credits shall be released:

By copy of this correspondence, DWR confirms that you have satisfied the above requirements for
the above -referenced tract and therefore, the following credits are being released and are now
available to sell:
• 15% of Catawba Buffer Restoration and Buffer Preservation Credits excluding pond
footprints = (0.15 x 570,384.200 ft2 = 85,557.630 ft2 )
• 10% of Catawba Buffer Restoration Credits within pond footprint)
(0.10 x 81,107 ft2 = 8,110.700 ft2)
Total Catawba Buffer Credits Released: 93,668.33 ft2
Please note that these riparian buffer credits can be provided to offset permitted impacts along
the Catawba River mainstem below Lake James and along mainstem lakes from and including
Lake James to the North Carolina and South Carolina border in the Catawba River Basin
03050101 HUC in accordance with guidelines in the Consolidated Buffer Mitigation Rule, 15A
NCAC 02B .0295, which became effective on November 1, 2015.
