Bandit Farms Bank Parcel Credit Release — Task 2 (partial)
Dear Mr. Ramsay:
On March 25, 2024, the Division of Water Resources (DWR) received documentation from
RestorEcology Jordan, LLC (REJ) that the Bandit Farms site had been planted and constructed in its
entirety and monitoring plots had been installed. On June 18, 2024, Blake Hartshorn with DWR,
with assistance from staff with REJ, inspected the site and confirmed that the subject site had been
mostly adequately planted and seeded and that all monitoring plots were installed. Additionally, the
conservation easement boundary for the site had been adequately marked. A minor encroachment
was observed off Stream B2 and a 4800 ft2 area off Stream C2 had been missed during initial
planting. On June 18, 2024, REJ submitted documentation to DWR notifying that the encroachment
had been remediated, but that the area missed during initial planting would not be planted until
Fall/Winter 2024. With remaining issues still not fully resolved from the site visit, DWR will issue
15% of the 20% credit release for Task 2, with the remaining 5% to be issued upon submitting proof
that planting has been completed. Proof of planting will need to include two transects, similar in size
to fixed plots, with photos, documenting that the missed area has been adequately planted.
DWR received a performance bond (#GSA2401040) from REJ in the amount of $150,000 to cover
performance obligations for the construction of the subject site. This bond is with The Gray Casualty
& Surety Company and ends with DWR approval of the As -Built Report.
In accordance with the MBI, signed on October 31, 2023, the following Project Milestones have been
partially met and the corresponding credits shall be released:

Adequately marked, all applicable permits obtained, and a site visit

By copy of this correspondence, DWR confirms that you have partially satisfied the above
requirements for the above -referenced tract. Therefore, 15% of your Jordan Lake riparian buffer
Restoration credits (0.15 x 498,733.235 ft2 = 74,809.985 ft2) and 15% of your Jordan Lake riparian
buffer Preservation credits (0.15 x 16,352.400 ft2 = 2,452.860 ft2) are now released.

Additionally, 15% of your delivered nitrogen offset credits (0.15 x 180.453 = 27.068 lb-N) and
15% of your delivered phosphorus credits (0.15 x 5.682 = 0.852 lb-P) are now released. Generated
credits are credits that have not been applied to the appropriate delivery factor.
Please note that the delivered nutrient offset credits can be sold from this bank and used for
impacts in the Upper New Hope Arm of Jordan Lake within the Cape Fear River Basin.
Additionally, riparian buffer credits can only be used to offset impacts located in the Upper
New Hope Sub -watershed of Jordan Lake according to 15A NCAC 02B .0295, which became
effective on November 1, 2015.
