On August 31, 2007, the Wilmington Regional Office received a complete plan revision for
Stormwater Management Permit Number SW8 050309. The revisions include rerouting of
stormwater flow and an additional curb outlet swale. No changes to the number of lots or to the
BUA per lot is proposed. It has been determined that a formal permit modification is not
required for the proposed changes. We are forwarding you an approved copy of the revised
plans for your files and the revised curb outlet supplement form. Please replace the old
approved plan set with the new one, and replace the old curb outlet supplement with the new
one.
Please be aware that all terms and conditions of the permit issued on March 17, 2005,
remain in full force and effect. Please also understand that the approval of this revision to
the approved plans for the subject State Stormwater Permit is done on a case-by-case
basis. Any other changes to this project must be approved through this Office prior to
construction. The issuance of this plan revision does not preclude the permittee from
complying with all other applicable statutes, rules, regulations or ordinances which may
have jurisdiction over the proposed activity, and obtaining a permit or approval prior to
construction.

Dear Mr. Harvell:
The Wilmington Regional Office received some of the previously requested information
regarding the proposed plan revision to the Stormwater Management Permit for Juniper Creek
Subdivision on June 6, 2007. A preliminary review of that information has determined that the
plan revision is not complete. The following information is needed to continue the stormwater
review
1. The revised drainage area map is incomplete: several sections of the road area
are not included within any swale drainage area; there are some grading
problems within those road sections; and there are many more drainage areas
shown than there are swales. All of the road should be collected and directed to
a curb outlet swale (not a Boundary Swale) and there should be 12 drainage
areas delineated, one for each swale.
2. The flume detail does not show the sidewalk. How will runoff from the road pass
under the sidewalk to get into the curb outlet swale?
3. What is happening at the end of the first cul-de-sac on the right? It appears that
the rear lot line swale behind Lots 6 & 7 is being directed into and across the
street to the Phase 1-5 swale. This does not appear to be appropriate drainage
design.
Please note that this request for additional information is in response to a preliminary review.
The requested information should be received in this Office prior to September 6, 2007, or the
application will be returned as incomplete. The return of a project will necessitate resubmittal of
all required items, including the application fee.
If you need additional time to submit the information, please mail or fax your request for a time
extension to the Division at the address and fax number at the bottom of this letter. The
request must indicate the date by which you expect to submit the required information. The
Division is allowed 90 days from the receipt of a completed application to issue the permit.
The construction of any impervious surfaces, other than a construction entrance under an
approved Sedimentation Erosion Control Plan, is a violation of NCGS 143-215.1 and is subject
to enforcement action pursuant to NCGS 143-215.6A.

Please be advised that these repeated attempts to make this application complete must
come to an end. This is not a complicated project. The application will be returned as
incomplete if the above items are not satisfactorily addressed within 30 days.
By copy of this letter to the Brunswick County Building Inspections Department, I am
informing them that this project has not yet received it's modified stormwater permit and,
per the NC Department of Insurance, all building permits and Certificates of Occupancy
for lots within this subdivision should be withheld pending receipt of the modified permit.
Please reference the State assigned project number on all correspondence. Any
original documents that need to be revised have been sent to the engineer or agent. All
original documents must be returned or new originals must be provided. Copies are not

1. Please submit the revised drainage area map which includes the revised
swale drainage areas and the unchanged swale DA's. A revised drainage
area map was not included with the package the Division received on
February 26, 2007.
2. Please label the swale numbers consistently throughout the supplement
form, calculations and plans. The plans received on April 18, 2006, show
swales numbers from 1-12. The plans received on November 7, 2006 and
February 26, 2007 show swale numbers comprised of the Phase number
first and a sequential number after that, such as Swale 1-2, meaning
Swale#2 in Phase 1. The supplement form lists only swales 1-12.
3. Please number the Phase 3 swales on the plans, consistent with the
swale numbers listed on the supplement form.
4. The street section detail with sidewalk previously requested has not been
added to the plan. The cul-de-sac radius is now shown in a section detail
with sidewalk, as previously requested, but a street section detail with
sidewalk has not been provided.

We have changed the drawing to reflect the review letter of Jan. 30, 2007. Also we have
changed the curb outlet supplement. Calculations have been included along with a
narrative.
We have shown the drainage areas for Phase 3 as previously approved, and no
changes in Phase 3 have been made.
All the stormwater flow is now going to the swale adjacent to the end cul-de-sac
and a detail has been added to show the curb cut and pipes.
The previously approved road detail is now shown on this sheet.
The swale detail now shows 5 foot for the bottom section.
The sidewalks previously shown are now included on this sheet.No additional
sidewalks are planned from what was originally permitted.
The cul-de-sac radius is now shown on the cul-de-sac and in the detail.
The curb outlet form has been revised to include this area. The area for Phase 3 is
included and has not been changed from what was first permitted.

Phase 2
Juniper Creek
The previous design had part of the flow going out of the curb cut at the end of the
cul-de-sac and the remainder along to a swale back of the lots 63 and 64.This revision
combines all the flow to one curb cut swale.
The total for Phase 2 swale 2 is 0.65 cfs for the 10 year storm and 1.33 cfs for swale 3.
With the existing canal at elevation 22.0,it is not possible to get the flow from the
property borders to flow on the surface of the road and still make it to the canal.To lower
the road might place it at the existing water table. The flow from the property border
swales will flow across grassed channels and into 10"pipes and go around the cul-de-sac
and discharge across riprap into the five foot wide grassed swale.The end of the cul-de-
sac will have the curb cut so the water can flow across riprap and into the same-grassed
Swale.The combined flow from all three sources will have a velocity of 1.06 feet per
second from the 10-year storm.

Subdivision on November 7, 2006. A preliminary review of that information has determined
that the plan revision is not complete. The following information is needed to continue the
stormwater review:
1. In addition to the revised swale drainage areas, the new DA delineation map
should also show the previously approved unchanged swale DA's. The drainage
area map to be permitted with this project must show all of the swale DA's.
2. The entire cul-de-sac surrounded by Lots 59-64 should be directed into Swale
PH2-2, not just half of it. If it's got curbing on it, the runoff on the other half will
need to go somewhere. Please correct the drainage area map and revise the
swale calculations.
3. The revised Sheet C2-C is missing the previously approved entrance road detail
(referred to as "Inset B" on the previous plans.)
4. Please specify the 5' swale bottom width on the swale detail.
5. Please show the sidewalk on the street details. Only the plans approved on
March 17, 2005, included road section details with a sidewalk. If sidewalk is no
longer being constructed, please provide a revised Page 2 of the application, and
recalculate the BUA.
6. Please specify the cul-de-sac pavement radius on the plans.
7. As previously requested, a revised curb outlet supplement will be needed to
account for the Drainage Area changes.

Linda,
We have finally gotten around to revising the plans after our earlier meeting. To recap, the
imperious area is not being increased and the number of lots remains the same. This is just
the switching of direction of flow after it leaves the curb cuts. The hammerhead cul-de-sac
in Phase 2 has been changed as you suggested and it does eliminate some piping.
However, we could not get all of the flow to go to the end of the cul-de-sac because it
increases the depth too much.
All swales have a five-foot bottom and side slopes of 5:1 so the velocity is really slow.
No changes are made in Phase 3.
Calculations are attached.
One sheet has the drainage areas marked in green.

Linda,
Juniper Creek is complicated, and difficult, both for the designer and reviewer. We have
some field grade data along with the restrictions for wetlands and state property that all
involve the design.
We request a meeting and we can bring more data on the surrounding property lines and
boundaries that are causing problems. I think it would speed up the review process.
We need about 20 minutes, and I know that time is hard to get so we can meet anytime next
week except Tuesday afternoon the 25th and Friday afternoon and all other times are open.

Dear Mr. Harvell:
The Wilmington Regional Office received a plan revision regarding the Stormwater
Management Permit for Juniper Creek Subdivision on April 18, 2006. A preliminary review of
that information has determined that the plan revision is not complete. The following
information is needed to continue the stormwater review:
1. I disagree that the only changes are after the runoff leaves the curb outlet
swales. Based on the flow changes shown, which appear to have caused high
points and low points to be shifted, drainage areas 6, 7, 12 ,13 and 14 are all
affected.
2. Are the inverts for Swale 14 correct? Based on the inverts shown on Sheet C3, it
appears that Swale 14 is now flowing toward the road, instead of away from it, as
previously permitted.
3. Swale 7 now appears to take in runoff from Swale 5. Drainage from Swale 5 •
appears to be picked up by a new swale between the open Space and Lot 49.
Stacking of swales does not meet the intent of the low density development
rules. Is there a way to close off the new swale adjacent Lot 49 such that the
runoff exiting Swale 5 can flow on down to the larger ditch?
4. A revised drainage area map will be needed to delineate the new drainage areas
due to comments #1 and #3.
5. Revised swale calculations will be necessary to account for the Drainage Area
changes.
6. A revised curb outlet supplement will be needed to account for the Drainage Area
changes.
Please note that this request for additional information is in response to a preliminary review.
The requested information should be received in this Office prior to August 11, 2006, or the
application will be returned as incomplete. The return of a project will necessitate resubmittal of
all required items, including the application fee.

If you need additional time to submit the information, please mail or fax your request for
a time extension to the Division at the address and fax number at the bottom of this
letter. The request must indicate the date by which you expect to submit the required
information. The Division is allowed 90 days from the receipt of a completed application
to issue the permit.
The construction of any impervious surfaces, other than a construction entrance under
an approved Sedimentation Erosion Control Plan, is a violation of NCGS 143-215.1 and
is subject to enforcement action pursuant to NCGS 143-215.6A.
Please reference the State assigned project number on all correspondence. Any
original documents that need to be revised have been sent to the engineer or agent. All
original documents must be returned or new originals must be provided. Copies are not

Linda,
In reference to your email of April 13, none of the impervious areas are changing. We
have attached 2 sets of plans of the original drawings and of the changes. The changes are
in the flow directions only.
We are still using the same curb cuts and curb outlet swales as originally proposed. The
changes come after the water leaves the ends of the curb cut swales.
We included a third set of plans on which we made hand written comments to show the
changes and make the review items easier to locate.
When Noelle reviews the plans and visits the site,we will be glad to meet her at the site to
explain the need for the changes. We also are aware of the adjacent wetlands and have
avoided making the swales too deep.
We are having additional surveying conducted for phases 2 and 3 to determine if a similar
problem exists in those phases. If it looks like a similar situation will occur, we will
contact Mr. Snowdon and you prior to construction. Thanks for your help.

Regarding this modification, I think it will probably be just a plan revision,
since nothing about the project's BUA or number of lots is changing. I don't have
to rewrite the permit, so that should make it a plan revision. However, in order to
be a plan revision, you will need to show all of the previously approved details on
the current plans, such as road sections, cul-de-sacs, swale details, swale
information, etc. , and submit two copies of those revised drawings.
The narrative indicates that some of the swales are changing flow direction. Have
you looked at the previously approved drainage areas for the curb outlet swales to
make sure that they are not changing as a result of these changes?
It appears that the elevation of the swales is being lowered by quite a bit (3' in
one case) . I'm copying this email to Noelle Lutheran in regards to her opinion as
to whether or not the swales will drain off the wetlands.
The new plans appear to show roadside swales in some locations. Additionally, the
sidewalk that was previously permitted is no longer shown. Is this project still
utilizing curb and gutter? Is the sidewalk still being proposed? Please include
this information on the plans.

I spoke with Don Butler today of our Leland office, and yes he is planning to submit a stormwater permit
modification for Juniper Creek. The lot layout has not changed, or the BUA per lot. However, they are making
some revisions on how they want to grade the roads, and where they are directing runoff. He is in the process
now of preparing that revision for submittal. If you require any additional information prior to his submittal, his

I received a copy of a Notice of Receipt of Revised Erosion Control Plan on March
13, 2006. This permit was issued last year- what is the reason for this revised SEC
plan, and does it impact the approved stormwater plan in any way?

listed above. G.S. 113A-54.1(a)requires that this office approve or disapprove a submitted revised plan within
15 days of receipt of such plan. Failure to act by this office within this time period shall be deemed approval of
the revised plan.
Commencement or continuation of a land-disturbing activity under the jurisdiction of this Act prior to
the approval of an erosion and sediment control plan is a violation of the Act.
We have performed a preliminary review of your submitted plan and have determined that additional
information will be necessary before a final review can be completed. Enclosed is a checklist of items that
