Cameron.Weaver@ncdenr.gov 910-796-7265 for a later date/time at an offsite location at your expense. Requests for
large plan copies should be attached on top of the file after completion of the review. Allways Graphics can be contacted

7. Written questions may be left with this completed form and a staff member will be in contact with you IF you

Dear Mr. Shuttleworth:
On July 7,2023,the Wilmington Regional Office of the Division of Energy,Mineral and Land Resources
(DEMLR)inspected the subject project,located at Hidden Creek Drive in Brunswick County to
determine the status of compliance with the State Stormwater Management Permit Number SW8 050309
issued on October 20,2020. The site inspection revealed that the site is not in compliance with the terms
and conditions of this permit. Please find a copy of the completed form entitled"Compliance Inspection
Report"attached to this letter,which summarizes the findings of the recent inspection.
As indicated in the attached inspection report,the following deficiencies must be resolved:
1. Submit modification to permitted plans showing swale layout consistent with what has been
constructed.
2. Maintain swales where eroding and/or blocked by debris.
Please be reminded that it is your responsibility as the permittee of record to submit a completed and
signed Permit Transfer Application Form to the Division of Energy,Mineral and Land Resources 30-60
calendar days prior to making any of the below listed changes.This form is available on our website at:

a. An ownership change including the sale or conveyance of the permitted project area in whole or
in part.This does not include the conveyance of subdivided residential lots to individuals which
are made subject to a recorded declaration of covenants and restrictions which contain the
statements required by the stormwater permit;
b. The sale or conveyance of the common areas to a Homeowner's or Property Owner's
Association,subject to the requirements of Session Law 2011-256;
c. Foreclosure proceedings;
d. Filing for Bankruptcy;
e. Dissolution of the partnership,corporate entity or LLC.Pick OnePer NCGS 57D-6-07,a
dissolved LLC shall wind up,which may include continuing the business of the LLC for a
period of time. The person charged with winding up the LLC shall collect the LLC's assets
[which include the stormwater management permit],and distribute the assets as provided in
NCGS 57D-6-08(2). OR Per NCGS 55-14-05,a dissolved corporation continues its corporate
existence but may not cant'on any business except that appropriate to wind up and
liquidate its business and affairs,which includes the stormwater management permit.

g. A name change of the project;

Please be advised that as the permittee,you are required to comply with the terms,conditions and
limitations of the Stormwater Management Permit under Title 15A North Carolina Administrative Code
2H.1003 and North Carolina General Statute 143-214.7, including the operation and maintenance of the
permitted stormwater system and the requirement to submit any changes from the approved plans to the
Division for approval.
Failure to provide the requested information, or to respond to this letter with a plan of action, including a
timeline to resolve the identified deficiencies,by September 9,2023,are considered violations of the
permit. If the requested information is not submitted to this office by the due date,then DEMLR staff
will re-inspect the site and may issue a Notice of Violation.Please also note that any individual or entity
found to be in noncompliance with the provisions of a stormwater management permit or the stormwater
rules is subject to enforcement action as set forth in NCGS 143 Article 21, including the assessment of
civil penalties of up to $25,000 per day.

Dear Mr. McCallion:
On February 13, 2013, Steve Pusey and Chad Coburn from the Wilmington Regional
Office performed a Compliance Inspection of the subject project, located off Old
Fayetteville Road, near Leland, in Brunswick County, North Carolina. This inspection
was performed to follow up on the original joint Notice of Violation (NOV) issued March
18, 2009 (see copy attached), and to determine the status of compliance with
Stormwater Permit Number SW8 050309, issued to you on March 17, 2005 with
approved plan revisions on August 31, 2007. A Continuing Notice of Violation for
compliance with the stormwater permit was issued on May 12, 2009. Others present at
the site were representatives from East Coast Engineering & Surveying, Land
Management Group, and US Army Corps of Engineers.
To summarize the stormwater portion, the project has been found in violation of
Stormwater Permit Number SW8 050309, issued pursuant to the requirements of the
stormwater rules, 15A NCAC 2H.1000. The violations found are:
I. Failure to build according to the approved plan.
Per Section 11.4 of the Permit, the permittee shall submit to the Director and shall
have received approval for revised plans, specifications, and calculations prior to
construction, for any modification to the approved plans.
1. Overall lot layout is not in accordance with the plans, and there are no street
names on the plans.
2. An approximate 3' deep ditch, going through several wetland areas, was
constructed instead of the 1' deep trapezoidal swale specified in uplands. This
ditch has now been filled back and vegetation is established. The swales in
these areas will need to be redesigned.

3. Many lots and road sections are under water, 2'-3' in some places, due to high
water table and flooding due to recent rain. The wetlands are going to be
redelineated on a new jurisdictional wetlands survey signed by the Corps of
Engineers. Once the new jurisdictional wetlands determination is complete, the
stormwater plans should be modified accordingly.
To correct these violations you must:
Provide a written "Plan of Action"which outlines the actions you will take to
correct the violation(s) and a time frame for completion of those actions, on or
before March 27, 2013. Your plan of action should address the time frame for
providing a jurisdictional wetlands survey, and submittal of an application to
modify the permit, including revised site plans, grading /drainage plans, and
revised calculations as applicable to the new design.
Failure to provide the "Plan of Action" by March 27, 2013, or to correct the violations by
the date designated in the "Plan of Action", are considered violations of 15A NCAC
2H.1000, and may result in the initiation of enforcement action which may include
recommendations for the assessment of civil penalties, pursuant to NCGS 143-215.6A.
By copy of this letter to the Brunswick County Building Inspector, this Office is
requesting that the Building Inspector consider withholding building permits and
Certificates of Occupancy for this project until this matter is satisfactorily resolved.

2. Drainage swales are not constructed according to the plans in many areas. The end
of the northernmost cul-de-sac in Phase 2 and the end of the main road were under
water due to the high water table and recent rain. Many lots in this area were also
under water, 2 - 3 feet deep in some places.
3.An approximate 3'deep ditch, going through several wetlands areas,was constructed
instead of the 1'deep trapezoidal swale specified. This ditch has been filled back in and
restored to wetlands. The wetlands are going to be redelineated on a new jurisdictional
wetland survey.
4. A revised site plan and grading/drainage plan need to be submitted for review after
the site is redesigned. Calculations will be needed to show that swaies can handle the
flow rate, and that the outlets to wetlands are non-erosive for a 10-year, 24 hr storm.

On May 12, 2009, Mr. Steve Pusey and Mr. Chad Coburn from the Wilmington Regional Office,
performed a Compliance Inspection of the subject project, located off Old Fayetteville Road,
near Leland, in Brunswick County, North Carolina. The inspection was performed to review the
overall terms of the original NOV issued on March 18, 2009, and to determine the status of
compliance with Stormwater Permit Number SW8 050309, issued to you on March 17, 2005
with approved plan revisions on August 31, 2007. Others present at the site were
representatives from East Coast Engineering &Surveying, US Army Corps of Engineers, and
the EPA.
To summarize the stormwater portion, the project has been found in violation of Stormwater
Permit Number SW8 050309, issued pursuant to the requirements of 15A NCAC 2H.1000. The
violations found are:
1. Overall lot layout has changed and is not in accordance with the plans. It appears that
at least one or more lots have changed on this project. Specifically, Lot 2 appears to
have 2 houses on it, and many lot numbers in the field do not match the plans. Also,
there are no street names on the plans.
2. Drainage swales in the back of many lots and throughout the project site are not
constructed in accordance with the plans. An approx. 3' ditch has been constructed
instead of a 1' deep trapezoidal swale, as specified.
3. Drainage swales have not been maintained properly. All swales require modification to
bring them into compliance.
To correct these violations you must:
1. Provide a written "Plan of Action" which outlines the actions you will take to correct the
violation(s) and a time frame for completion of those actions, on or before June 15,
2009.

2. Submit a revised site plan and grading /drainage plan with proposed changes. Revised
plans must show any proposed changes to the drainage pattern. We recommend
keeping the basic concept of the overall drainage system by routing the runoff from the
northernmost drainage areas towards the relic ditch in the wetlands north of the
property.
3. Convert existing ditches on the site to trapezoidal swales with 5:1 slope, as shown in the
plan details.
4. Submit revised calculations, as needed, to show that flow through the swales and outlets
is non-erosive for a 10-year storm.
5. Show riprap, scour holes, and/or level spreaders on the plans, as needed, to diffuse the
flow at the outlet areas.
Failure to provide the "Plan of Action" by June 15, 2009, or to correct the violations by the date
designated in the "Plan of Action", are considered violations of 15A NCAC 2H.1000, and may
result in the initiation of enforcement action which may include recommendations for the
assessment of civil penalties, pursuant to NCGS 143-215.6A.
By copy of this letter to the Brunswick County Building Inspector, this Office is requesting that
the Building Inspector consider withholding building permits and Certificates of Occupancy for
this project until this matter is satisfactorily resolved.

Office of the Division of Water Quality conducted a site inspection for the tract/project known as Juniper
Creek, located in Leland,North Carolina.
The site visit and file review revealed that the subject project has an approved Erosion and
Sedimentation Control Plan and is covered by Stormwater General Permit NCG010000. A Construction
Stormwater General Permit(NCG010000)is issued upon the approval of an Erosion and Sedimentation
Control Plan. This permit applies to projects that receive a Division of Land Resources(DLR)(or local
delegated program)Erosion and Sedimentation Control Plan for land disturbance of 1 acre or greater.
Specifically,the General Permit(NCG010000)authorizes the discharge of stormwater under the National
Pollutant Discharge Elimination System(NPDES)in accordance with Title 15A North Carolina
Administrative Code 2H.0100. In addition,this project was inspected for compliance with the 401 Water
Quality Certification with Additional Conditions covered by certification number 3402 granted on March
17,2005 and for compliance with the State Stormwater Permit also issued on March 17, 2005. These
inspections revealed that the subject property has the following violations as detailed below:

II. 401 Water Quality Certification-The WQC approved the impact of 0.381 acres of 404
wetlands to complete your project as described in your March 11,2005 application. It appears
that new construction has begun in the wetland area north of the cul-de-sac on Creek Bend
Road.
a) Condition 1 of the 401 WQC states,"No waste, spoil, solids, or fill of any kind
shall occur in wetlands,waters, or riparian areas beyond the footprint of the
impacts depicted in the PCN. All construction activities shall be performed
so that no violations of state water quality standards, statutes, or rules occur."
b) Condition 2 of the 401 WQC states,"Deed notifications or similar mechanisms or
similar mechanisms shall be placed on all remaining wetlands. These
mechanisms shall be in place within 30 days of the date of issuance of the 401
Certification letter or the issuance of the 404 permit.
III. Wetlands Standards—Ditches have been dug directly adjacent to the northern 404 wetland
boundary along the entire site. This is a violation of the following:
15A NCAC 02B.0231 (b)(1)requires that:
Liquids, fill or other solids or dissolved gases may not be present in amounts that may
cause adverse impacts on existing wetlands uses.
15A NCAC 02B .0231 (b)(5)requires that:
Hydrological conditions necessary to support the biological and physical characteristics
naturally present in wetlands shall be protected to prevent adverse impacts on:
(A)Water currents,erosion or sedimentation patterns;
(C)The chemical,nutrient and dissolved oxygen regime of the wetland;
(D)The movement of aquatic fauna;
(F)Water levels or elevations

IV. State Stormwater Permit-Failure To Build According To Plan-Permit conditions
require that the permittee shall submit to the Director and shall have received approval
for revised plans, specifications, and calculations prior to construction, for any
modification to the approved plans.
a) It appears that at least one or more lots have changed on this project. Specifically, lot 2
currently has 2 houses built on it.
b) Many, if not all lot numbers in the field do not match the plans.
Required Response-You are directed to respond to this letter in writing within 30 days of receipt.
Your response should include the following:
1. A statement documenting that the approved Erosion and Sediment Control Plan is on-site and
available for review and that a rain gauge has been properly installed as required by the permit.
2. Include all rain gauge data collected from the date of land disturbance up to the date of your
response. If you do not have data,explain why.
3. Provide all inspection records from the date of land disturbance up to the date of your response.
If you do not have records,explain why.
4. Provide proof of the recorded deed restrictions and preservation map.
5. Have the approved, delineated wetlands staked out on the site per the approved survey.
6. Explain why new construction has begun north of the cul-de-sac at the end of Creek Bend Road
in 404 wetlands and provide a restoration plan for these wetlands.
7. Provide a restoration plan for the impacted wetlands adjacent to the ditches on the site including a
description of the methods that will be used to remove the side-cast fill in the wetlands and the
methods that will be used to stabilize and replant the impacted areas. The swales permitted in the
State Stormwater plan should be installed at a 3:1 slope and stabilized in accordance with the
permit.
8. Explain why some lots have more than one house built on them.
9. Explain the discrepancies between the approved site plan and what has actually been built at the
site with respect to the lot numbers and street names.
10. Submit an accurate and revised stormwater plan and a site plan with the correct lot areas and
numbers.
11. Indicate in your response a detailed schedule with dates explaining when the wetland restoration
activities will be accomplished,and if you plan to seek a permit for the impacts,when an
application will be submitted.
