RE: Minzie Creek Notice of Violations NOV-2024-LV-0532 and NOV 2024-LV-0531
Dear David,
I hope this letter finds you well. I responding to the NOVs referenced herein on behalf of
Minzies Creek Sanitary District.
Based on conversations with the plant operators it is our un&istwnding that because of
higher than normal solids in the system the plant did have higher than normal flow razes at
beginning of 2023. Upon learning of this, the operators took the following steps to address the
issue:
1. A redistribution of solids occurred.
2. Adjustment of the Pump Floats
3. Adjustment of the Chlorine added
4. Increased mai_nte ce cycle of solids removal from tanks to twice per year versus just
once.
We believe these actions have helped bring the plant back into compliance. As you are
well aware, this plant is old and requires a great deal of attention to maintain. Also, it is my
understanding that Nfinzies Creek has been working with NCDEQ and others with the hope of
getting a new system. We would ask that NCDEQ continue to work with us and consider the
actions taken as a show of good faith relieving the necessity for any furthef fines. Minzies Creek
is already facing what to it is significant fines for prior violations, and adding additional fines
would be devastating for an already underfimded sanitary district.
We look forward to the agency's response, and any filrther guidance the agency can give
as far as further corrective actions.
