PERMISSION IS HEREBY GRANTED TO H & S Cleaners FOR THE CONSTRUCTION OF A MONITORING WELL SYSTEM consisting of one monitoring well owned by H & S Cleaners, 105 West NC Highway 54, Durham, NC 27713. The wells will be located on the property owned by North Carolina department of Transportation located at i-40 Right of Way south of the eastbond rqmp at Exit 276. This Permit is issued in accordance with the application received on April 17, 2024, in conformity with specifications and supporting data, all of which are filed with the Department of Environmental Quality and are considered integral parts of this Permit. This Permit is for well construction only and does not waive any provision or requirement of any other applicable law or regulation. Construction of any well under this Permit shall be in strict compliance with the North Carolina Well Construction Regulations and Standards (15A NCAC 02C .0100), and other State and Local Laws and regulations pertaining to well construction. If any requirements or limitations specified in this Permit are unacceptable, you have a right to an adjudicatory hearing upon written request within 30 days of receipt of this Permit. The request must be in the form of a written petition conforming to Chapter 150B of the North Carolina General Statutes and filed with the Office of Administrative Hearings, 6714 Mail Service Center, Raleigh, North Carolina 27699-6714. Unless such a demand is made, this Permit is final and binding. This Permit will be effective for one year from the date of its issuance and shall be subject to other specified conditions, limitations, or exceptions as follows: 1. Issuance of this Permit does not obligate reimbursement from State trust funds, if these wells are being installed as part of an investigation for contamination from an underground storage tank or dry cleaner incident. 2. Issuance of this Permit does not supersede any other agreement, permit, or requirement issued by another agency. 3. The well(s) shall be located and constructed as shown on the attachments submitted as part of the Permit application. 4. Each well shall have a Well Contractor Identification Plate in accordance with 15A NCAC 02C .0108(o). 5. Well construction records (GW-1) for each well shall be submitted to the Division of Water Quality’s Information Processing Unit within 30 days of the well completion. 6. When the well is discontinued or abandoned, it shall be abandoned in accordance with 15A NCAC 02C .0113 and a well abandonment record (GW-30) shall be submitted to the Division of Water Quality’s Information Processing Unit within 30 days of the well abandonment. 7. Olson: This letter is in response to your request to conduct test drillings for groundwater sampling at the intersection of 276 Exit Ramp and SR-1118 in Durham County. An Encroachment Agreement will not be required for the above-mentioned work; however, there are several stipulations that will need to be followed. • Contact Dane Barber djbarber3@ncdot.gov or Ed Shiplett edshiplett@ncdot.gov prior to starting any work within the right-of-way. Both can be reached at 919-317-4770. • No borings will be allowed in the roadway/pavement. • Any work requiring equipment or personnel within 5' of any travel lane shall require a full lane closure with appropriate traffic control. This shall be performed in conformance with the latest NCDOT Roadway Standard Drawings and Standard Specifications for Roads and Structures and Amendments or Supplements thereto. When there is no guidance provided in the Roadway Standard Drawings or Specifications, comply with the Manual on Uniform Traffic Control Devices for Streets and Highways and Amendment or Supplement thereto. All flagging operations within NCDOT Right of Way require qualified and trained Work Zone Flaggers. • All portable or stationary Work Zone Signing shall use Type VII, VIII, or IX fluorescent orange retro-reflective sheeting or better without adhesive backing for roll-up or composite portable work zone signs. Signs and sign stands assemblies must meet or exceed the requirements of the NCHRP 350 for Work Zone Category II Devices. • No lane of traffic shall be closed or restricted between the hours of 6:00 AM to 9:00 AM and 4:00 PM to 7:00 PM Monday through Friday. Traffic shall be maintained at all times. Any violation of these hours will result in termination of this agreement. In addition, the Contractor shall not close or narrow a lane of traffic on all roads, detain and/or alter the traffic flow on or during holidays, holiday weekends, special events, or any other time when traffic is unusually heavy. • NCDOT reserves the right to further limit, restrict, or suspend operations within the Right of Way if, in the opinion of NCDOT, safety or traffic conditions warrant such action. DocuSign Envelope ID: 761EA315-2EE7-4313-AF6D-2D8F7FBA8F52 Page 2 of 2 • At the end of each working day, equipment shall be parked a minimum of 30 feet from the edge of any travel lane and be barricaded in order not to have any equipment obstruction within the clear recovery zone. • No parking or material storage shall be allowed along the shoulders of any NCDOT roadways. • All personnel shall wear NCDOT approved Class 2 - Level 2 orange safety vests or similar apparel with same standards. • It is the responsibility of the contractor to determine the location of utilities within the work area. The encroacher shall be responsible for notifying other utility owners and providing protection and safeguards to prevent damage or interruption to existing facilities, and maintain access to existing utilities. • If there are any existing traffic signals, signal equipment, or NCDOT signs in the area of proposed work, contact Ron Garrett at (919) 536-4000, prior to beginning any work on State Right of Way. Any damage to NCDOT signs, signals, or associated equipment shall be the responsibility of the contractor. • If any pavement failures occur due to the proposed work, the existing pavement will be repaired with material approved by the Division of Highways and to a strength equivalent to the existing pavement. • Existing drainage patterns shall be maintained at all times throughout the proposed work. The contractor shall keep the roadway clean of dirt and debris at all times throughout the duration of the project. Proper temporary measures shall be used to control erosion and sedimentation in accordance with all local, State and Federal regulations. • Excavated material shall not be placed on the roadway at any time. Drainage structures shall not be blocked with excavation materials. • Seeding and mulching shall be performed in accordance with section 1660 of The North Carolina Department of Transportation Standard Specifications for Roads and Structures. Application rates per acre shall be as follows Dolomitic Limestone 4000 lbs. Fertilizer 10-20- 20 500 lbs. Pensacola Bahiagrass 50 lbs. KY 31 Tall Fescue 50 lbs. The work will not be conducted in the roadway or on the shoulder, but in the grassed area south of the Interstate-40 eastbound off-ramp for Exit 276 to Highway 54 (Fayetteville Road). The 4.5-inch diameter boring will be advanced using a solid-stem auger drilling rig. After boring advancement, PVC pipe and screen will be installed in the boring to facilitate collection of a groundwater sample. Upon completion of sampling, the boring will be properly abandoned and patched to match surface conditions. To allow time for groundwater to develop, the boring will be advanced the first day of field activities, then sampling and abandonment will occur on the second day of field activities. The boring will be abandoned within 24 hours of installation. Utilities will be located prior to drilling via NC One Call (811) and a private utility locator. Per guidelines issued by the NCDOT specifically for DSCA sites, the temporary borings require written authorization from the regional district engineer, but do not require an encroachment agreement. If the information detailed in this submittal appears acceptable, please respond with your written authorization. A figure showing the proposed boring location is attached.
