These impacts are necessary for the construction of an industrial distribution/warehouse logistics center that consists of two warehouse buildings and associated infrastructure, including trailer and employee parking, truck courts, access roads, a sanitary sewer, and three storm water control measures. Any violation of the attached conditions or deviation from your submitted plans may subject the permittee to a stop work order, a restoration order, a Class I administrative penalty, and/or appropriate legal action. This verification will remain valid until the expiration date identified below unless the nationwide and/or regional general permit authorization is modified, suspended or revoked. If, prior to the expiration date identified below, the nationwide and/or regional general permit authorization is reissued and/or modified, this verification will remain valid until the expiration date identified below, provided it complies with all requirements of the modified nationwide permit. If the nationwide and/or regional general permit authorization expires or is suspended, revoked, or is modified, such that the activity would no longer comply with the terms and conditions of the nationwide permit, activities which have commenced (i.e., are under construction) or are under contract to commence in reliance upon the nationwide and/or regional general permit, will remain authorized provided the activity is completed within twelve months of the date of the nationwide and/or regional general permit's expiration, modification or revocation, unless discretionary authority has been exercised on a case -by -case basis to modify, suspend or revoke the authorization. Activities subject to Section 404 (as indicated above) may also require an individual Section 401 Water Quality Certification. For activities occurring within the twenty coastal counties subject to regulation under the Coastal Area Management Act (CAMA), prior to beginning work you must contact the N.C. In order to compensate for impacts associated with this permit, mitigation shall be provided in accordance with the provisions outlined on the most recent version of the attached Compensatory Mitigation Responsibility Transfer Form. The requirements of this form, including any special conditions listed on this form, are hereby incorporated as special conditions of this permit authorization. 2. Stream CH 100 must be relocated using natural channel design techniques. The approved stream relocation is shown on Permit Figures 7 and 8 of the enclosed plans. This stream must be relocated according to the plans and descriptions shown on Permit Figures 8 through 20 of the enclosed plans. These activities shall be completed no later than May 31, 2022. Once the stream relocation work is complete, you must submit an initial report within 30 days detailing the work completed, including a photograph record sufficient to document the entirety of the stream relocation reach. 3. Following submittal of the initial report (see Special Condition 2), the relocated stream shall be monitored annually, and an annual report submitted to the U.S. Army Corps of Engineers, Wilmington District, Raleigh Regulatory Field Office (Corps) no later than December 311t of each year. The monitoring report shall include photographs of re -occurring vegetation plots to assess plant survival, and collection and analysis of data to assess stability of the longitudinal profile and four marked cross sections. Over the life of the monitoring period, two bankfull events shall be documented, if available. Monitoring shall continue for a minimum of five years or until the Corps determines that monitoring can be discontinued. 4. If, after the monitoring period has concluded, the stream relocation is not successful for any reason, including due to erosion, instability, or hydrology insufficient to render the feature jurisdictional according to Section 404 of the Clean Water Act, the Corps will require contingency measures. Contingencies may include re-evaluation of this Nationwide Permit 39 authorization pertaining to compensatory mitigation requirements for Impacts S1 through S4. 5. Groundwater base flow below the authorized impact limits at Impacts W4 and S4/W5 must be maintained per the filtered trench drains as shown on Permit Figure 6 (i.e. "Filtered Trench Drain @ Wetland Disturbances") of the enclosed plans. 6. The temporary stream impacts proposed at the three open -cut sewer line crossings (S5, S6, and S7) must be installed in the dry. Stream substrate must be excavated and stockpiled separately from soil and other material not compatible with stream substrate. Following sewer line installation, these streams must be restored by reconstructing the stream channel bed and banks to the pre-existing channel dimensions, with suitable stockpiled stream substrate placed back into the stream bed. The stream banks must be stabilized with a regionally appropriate native seed mix and coir matting. SAW-2019-02059 7. Please note that future impacts and/or phases of the Reedy Fork commercial/industrial development, and related activities associated with Corps Action ID: SAW-2019-02059, may be considered part of a single and complete project; these impacts may be considered cumulative with impacts authorized during earlier phases with respect to compensatory mitigation and Nationwide Permit thresholds.
