NOTIFICATION OF
INTENT TO ISSUE A
CONSENT ORDER
This is a Public Notice
of intent to issue an amended
State Consent Order to the fol-
lowing:
The Town of Burnsville
(P.O. Box 87, Burnsville, NC
28714-0087) has requested an
amendment to existing Special
Order by Consent S21-003 for
its wastewater treatment facility
under the authority of discharge
permit NC0020290. The Burns-
ville WWTP discharges treated
domestic wastewater to the
Cane River in the French Broad
River Basin.
The Environmental Man-
agement Commission proposes
to issue the amended Order per
Article 21 of Chapter 143, N.C.
General Statutes, and other
regulations effective August
1;2024.
Compliance with this
amended Order requires the
adjustment of completion.dates
for construction of improve-
ments to the current WWTP,
which include:
Complete overhaul and
rehabilitation of the 0.5 MGD
treatment train at the Burnsville
WWTP. Completion of the proj-
ect will provide the Town with
the ability to adequately treat
incoming wastewater, properly
manage solids and aid the facil-
ity in returning to compliance
with its NPDES permit.
Funding has been secured
by Burnsville for the neces-
sary construction activities.
Burnsville shall comply with its
existing NPDES permit limits.
This Order will expire on March
31, 2027.

Comments on the proposed
amended Order received no
later than July 15, 2024 will be
considered in the final determi-
nation. A public meeting may
be held if there is a significant
degree of public interest.

attached hereto, was published in The Yancey Common Times
Journal (The Yancey Journal Inc.) on the following dates:
June 19, 2024
and that the said newspaper in which such notice, paper,
document, or advertisement was published was, at the time of
each and every such publication, a newspaper meeting all of
the requirements and qualifications of Section 1-597 of the
General Statutes of North Carolina and was a qualified
newspaper within the meaning of Section 1-597 of the
General Statutes of North Carolina.
