REQUEST FOR MORE INFORMATION
Dear Mr- Matthews:
On June 17, 2005, the Division of Water Quality (DWQ) received your applicatio to
impact 3,367 square feet of lake bed and 721.5 square feet of shoreline far the purpose
of shoreline stabilization. The pWQ has determined that your application was
incomplete and/or provided inaccurate information as discussed below. The DWQ will
require additional information in order to process your application to impact protected
wetlands and/or streams on the subject properly- Therefore, unless we receive the
additional information requested below, we will have to move toward denial of your
application as required by 15A NCAC 2H .0506 and will place this project on hold as
incomplete until we receive this additional information. Please provide the following
information so that we may continue to review your project.

- - ~- - 1. Impact Justification (Avoidance and Minimization)
No description of the amount of erosion, photographs (with scale), etc have been
provided to justify the requested impact- You must submit, at a minimum,
photographs (with a scale) and a description of how the work will be pertormed (not
just a barge, but spill plans, sediment and erosion control measures, etc.) to justify
the impact.

2. Materials
Your application requests the use of river rock for stabilization_ The removal of
river rock from stream consfiitutes a violation of North Carolina General Statutes via
the removal of best use of that particular stream segment_ Additionally, the use of
smooth river rock on shoreline stabilization does not provide the aquatic habitat
that rip-rap provides. Lastly, river rock generally is not large enough to stabilize a
shoreline due to it's general size_ You must modify your plan to eliminate the use
of river rock and choose a suitable stabilizing material for your project_
Please respond within ten {10) business days of the date of this letter by sending this
informs#ion to me in writing and Kevin Barnett of the DWQ Asheville Regional Qffice. If
we do not hear from you within ten {10) business days, we will assume that you no
longer wait to p~:~rsue this project and w° will consider the project a5 withdrawn_
This letter only addresses the application review and does not authorize any impacts to
wetlands, waters ar protected buffers. Please be aware that any impacts requested
within your application are not authorized (at this time) lay the DWQ. Please call Ms.
