NCG020000, Vulcan Materials Company, LLC (Vulcan) is submitting notification within the 7 days of an upset condition that occurred during an April 9, 2024 storm event. On the morning of April 9, 2024, Vulcan became aware of an upset condition causing an overflow of stormwater one of the facility's sedimentation ponds and subsequent discharge from the site to the Laurel Fork Creek. Vulcan determined that the pump float switch at our pond near the ABC stockpile malfunctioned causing the stormwater overflow. Vulcan initiated corrective action and repaired the pump early that afternoon (i.e., within 8 hours of detection). The discharge from the site was stormwater run-off only as no facility wastewater (e.g.- wash screen water, etc.) is commingled with that pond. The overflow did not contain any pollutants other than particulates. Vulcan also discussed the issue with Jack Lawry-Popelka, Engineer II with NC Department of Environmental Quality on the morning of April 10t", within 24 hours of detection of the upset condition.
